BROADCASTING ACTOrder Declining to Refer Back to the CRTC Decisions CRTC 2006-323 and 2006-324P.C.2006-1150200610

Whereas the Canadian Radio-television and Telecommunications Commission (“the Commission”) rendered Broadcasting Decisions CRTC 2006-323 and 2006-324 on August 2, 2006, which respectively approved the applications by Newcap Inc. for a broadcasting licence to operate a new English-language commercial FM radio station in Calgary and the application by CHUM Limited for a broadcasting licence to operate a new English-language commercial FM radio station in Calgary;Whereas, subsequent to the rendering of those Decisions, the Governor in Council received a petition requesting that the Decisions be referred back to the Commission for reconsideration and hearing of the matters;And whereas the Governor in Council, having considered the petition, is not satisfied that the Decisions derogate from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Acta;aS.C. 1991, c. 11Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Acta, hereby declines to refer Broadcasting Decisions CRTC 2006-323 and 2006-324 of August 2, 2006 back to the Commission for reconsideration and hearing.
