B-9.01Broadcasting ActSI/97-130199711262013012820051014BROADCASTING ACTOrder Declining to Set Aside or to Refer Decision CRTC 97-370P.C.1997-15981997114Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 97-370 on August 6, 1997 approving the application by Teleglobe Inc. and others, on behalf of a company to be incorporated and to be known as LOOK TV Inc., for a licence to carry on a radiocommunication distribution undertaking to transmit broadcasting services in encrypted mode by means of a digital multipoint distribution system (MDS) to serve various southern Ontario communities;Whereas, subsequent to the rendering of Decision CRTC 97-370, the Governor in Council has received petitions requesting that the said decision be set aside;And whereas the Governor in Council, having considered the petitions, is not satisfied that Decision CRTC 97-370 derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or to refer Decision CRTC 97-370 of August 6, 1997 back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission.
