B-9.01Broadcasting ActSI/97-5119975142013012820051014BROADCASTING ACTOrder Declining to Set Aside or to Refer Back to the CRTC a Decision Respecting CFJO-FMP.C.1997-6831997424Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 97-47 on February 6, 1997 which amended the broadcasting licence of CFJO-FM Thetford Mines/Victoriaville, Quebec, by increasing the effective radiated power from 16,600 watts to 100,000 watts and by changing the frequency from 103.3 MHz (channel 277 B) to 97.3 MHz (channel 247C1);Whereas, subsequent to the rendering of Decision CRTC 97-47, the Governor in Council has received a petition requesting that the said decision be set aside or referred back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing;And whereas the Governor in Council, having considered the petition, is not satisfied that Decision CRTC 97-47 derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or to refer Decision CRTC 97-47 of February 6, 1997 back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission.
