His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 6 of the Aeronautics Act, is pleased hereby to approve the annexed Regulations respecting zoning at Fort Simpson Airport, made by the Minister of Transport.Short TitleThese Regulations may be cited as the Fort Simpson Airport Zoning Regulations.InterpretationIn these Regulations,airport means the Fort Simpson Airport, in the vicinity of Fort Simpson, in the Northwest Territories; (aéroport)airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part III of the schedule; (surface d’approche)Minister means the Minister of Transport; (ministre)outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part IV of the schedule; (surface extérieure)strip means the rectangular portion of the landing area of the airport, including the runway prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part V of the schedule; (bande)transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part VI of the schedule. (surface de transition)For the purposes of these Regulations, the assigned elevation of the airport reference point is deemed to be 165.81 m above sea level.ApplicationThese Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, that consist ofthe lands within, andthe lands directly under that portion of an approach surface that extends beyondthe outer limits described in Part II of the schedule.GeneralNo person shall erect or construct, on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point anyapproach surface;outer surface; ortransitional surface.Natural GrowthWhere an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may make a direction that the owner or occupier of the land on which that object is growing remove the excessive growth.Disposal of WasteNo owner or occupier of any land to which these Regulations apply shall permit such land or any part of it to be used for the disposal of any waste edible by or attractive to birds.(ss. 2 and 3)Description of the Airport Reference PointThe airport reference point is a point coincidental with the Department of Transport airport control survey monument No. 840-305, located at latitude 61°45′20.2905″, longitude 121°13′59.6865″.Description of the Outer Limits of LandThe following described boundaries are the outer limits of lands:COMMENCING at a point in the northern boundary of Protective Easement for Lot 19, Group 911, Plan 59432 (C.L.S.R.) 1037 (L.T.O.), where it is intersected by the circumference of a circle having a radius of 4 000 m and centered at the airport reference point as described in Part I of the schedule; THENCE, in a northeasterly direction following the circumference of the said circle clockwise to the point where it intersects the southern boundary of Protective Easement for Lot 19, Group 911, Plan 59432 (C.L.S.R.) 1037 (L.T.O.); THENCE, westerly along the southerly boundary of said Protective Easement to the southwest corner thereof; THENCE, northerly along the westerly boundary of said Protective Easement to the northwest corner thereof; THENCE, easterly along the northerly boundary of said Protective Easement to the point of commencement, as said outer limits are shown on Department of Transport Fort Simpson Airport Zoning Plan No. E.1544.Description of the Approach SurfacesThe approach surfaces, shown on Department of Transport Fort Simpson Airport Zoning Plan No. E.1544, are surfaces abutting each end of the strips associated with the runways designated 12-30 and 17-35 and are described as follows:a surface abutting the end of the strip associated with runway approach 12, anda surface abutting the end of the strip associated with runway approach 30,consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip, 300 m measured vertically above the elevation at the end of the strip, and 15 000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; anda surface abutting the end of the strip associated with runway approach 17, anda surface abutting the end of the strip associated with runway approach 35,consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip, 75 m measured vertically above the elevation at the end of the strip, and 3 000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 375 m from the projected centre line.Description of the Outer SurfaceThe outer surface, shown on Department of Transport Fort Simpson Airport Zoning Plan No. E.1544, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the assigned elevation of the airport reference point except where that common plane is less than 9 m above the surface of the ground, the imaginary surface is located 9 m above the surface of the ground.Description of the StripsThe strips, shown on Department of Transport Fort Simpson Airport Zoning Plan No. E.1544, are described as follows:the strip associated with runway 12-30 is 300 m in width, 150 m being on each side of the centre line of the runway, and 1 948.8 m in length; andthe strip associated with runway 17-35 is 150 m in width, 75 m being on each side of the centre line of the runway, and 1 644 m in length.Description of Each Transitional SurfaceEach transitional surface, shown on Department of Transport Fort Simpson Airport Zoning Plan No. E.1544, is a surface consisting of an inclined plane having a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and centre line produced of each strip and extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip.
