(<DefinedTermFr>présentation de drogue nouvelle</DefinedTermFr>)</Text></Definition><Definition generate-in-text="no" Code="se=&quot;3&quot;,ss=&quot;1&quot;,df=&quot;{supplement to a new drug submission}{supplément à une présentation de drogue nouvelle}&quot;"><Text><DefinedTermEn>supplement to a new drug submission</DefinedTermEn> means a supplement to a new drug submission or a supplement to an extraordinary use new drug submission as those terms are used in Division 8 of Part C of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._870">Food and Drug Regulations</XRefExternal>, but excludes such a supplement that is based solely on one or more of the matters mentioned in any of paragraphs C.08.003(2)(<Emphasis style="italic">b</Emphasis>) and (<Emphasis style="italic">d</Emphasis>) to (<Emphasis style="italic">g</Emphasis>) and subparagraphs C.08.003(2)(<Emphasis style="italic">h</Emphasis>)(iv) and (v) of those Regulations. To maintain the register, the Minister may refuse to add or may delete any patent or other information that does not meet the requirements of that section.</Text></Subsection><Subsection Code="se=&quot;3&quot;,ss=&quot;3&quot;"><Label>(3)</Label><Text>If a patent is listed on the register in respect of a new drug submission or supplement to a new drug submission for a drug for which the identification number has been cancelled under paragraph C.01.014.6(1)(<Emphasis style="italic">a</Emphasis>) of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._870">Food and Drug Regulations</XRefExternal>, the Minister shall delete the patent from the register 90 days after the date of cancellation.</Text></Subsection><Subsection Code="se=&quot;3&quot;,ss=&quot;4&quot;"><Label>(4)</Label><Text>Subsection (3) does not apply if the identification number is cancelled under paragraph C.01.014.6(1)(<Emphasis style="italic">a</Emphasis>) of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._870">Food and Drug Regulations</XRefExternal> because of a change in manufacturer.</Text></Subsection><Subsection Code="se=&quot;3&quot;,ss=&quot;5&quot;"><Label>(5)</Label><Text>If, after an identification number is cancelled under paragraph C.01.014.6(1)(<Emphasis style="italic">a</Emphasis>) of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._870">Food and Drug Regulations</XRefExternal>, an identification number is assigned for the same drug, the Minister shall add to the register the patent that was deleted under subsection (3) when the Minister receives the document required by section C.01.014.3 of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._870">Food and Drug Regulations</XRefExternal> in respect of the drug.</Text></Subsection><Subsection Code="se=&quot;3&quot;,ss=&quot;6&quot;"><Label>(6)</Label><Text>The register shall be open to public inspection during business hours.</Text></Subsection><Subsection Code="se=&quot;3&quot;,ss=&quot;7&quot;"><Label>(7)</Label><Text>No patent on a patent list or other information submitted under section 4 shall be added to the register until after the Minister has issued a notice of compliance in respect of the new drug submission or the supplement to a new drug submission, as the case may be, to which the patent or information relates.</Text></Subsection><Subsection Code="se=&quot;3&quot;,ss=&quot;8&quot;"><Label>(8)</Label><Text>For the purpose of deciding whether a patent, patent list or other information will be added to or deleted from the register, the Minister may consult with officers or employees of the Patent Office.</Text></Subsection><HistoricalNote><ul><li>SOR/98-166, s. 2;</li><li> SOR/2006-242, s. 2;</li><li> SOR/2011-89, s. 2.</li></ul></HistoricalNote><a startdate="20061005" title="Link to previous version of this section">Previous Version</a></Section><Section Code="se=&quot;3.1&quot;"><Label>3.1</Label><Subsection Code="se=&quot;3.1&quot;,ss=&quot;1&quot;"><Label>(1)</Label><Text>The Minister shall not delete from the register a patent on a patent list that was submitted before June 17, 2006, unless</Text><Paragraph Code="se=&quot;3.1&quot;,ss=&quot;1&quot;,p1=&quot;a&quot;"><Label>(<Emphasis style="italic">a</Emphasis>)</Label><Text>the patent has expired;</Text></Paragraph><Paragraph Code="se=&quot;3.1&quot;,ss=&quot;1&quot;,p1=&quot;b&quot;"><Label>(<Emphasis style="italic">b</Emphasis>)</Label><Text>a court has, under subsection 60(1) of the <XRefExternal reference-type="act" link="P-4">Patent Act</XRefExternal>, declared that the patent is invalid or void;</Text></Paragraph><Paragraph Code="se=&quot;3.1&quot;,ss=&quot;1&quot;,p1=&quot;c&quot;"><Label>(<Emphasis style="italic">c</Emphasis>)</Label><Text>the identification number assigned to the drug in respect of which the patent is listed is cancelled under paragraph C.01.014.6(1)(<Emphasis style="italic">a</Emphasis>) of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._870">Food and Drug Regulations</XRefExternal>; or</Text></Paragraph><Paragraph Code="se=&quot;4&quot;,ss=&quot;3&quot;,p1=&quot;c&quot;"><Label>(<Emphasis style="italic">c</Emphasis>)</Label><Text>in the case of a change in use of the medicinal ingredient, the patent contains a claim for the changed use of the medicinal ingredient that has been approved through the issuance of a notice of compliance in respect of the supplement.</Text></Paragraph></Subsection><Subsection Code="se=&quot;4&quot;,ss=&quot;4&quot;"><Label>(4)</Label><Text>A patent list shall contain the following:</Text><Paragraph Code="se=&quot;4&quot;,ss=&quot;4&quot;,p1=&quot;a&quot;"><Label>(<Emphasis style="italic">a</Emphasis>)</Label><Text>an identification of the new drug submission or the supplement to a new drug submission to which the list relates;</Text></Paragraph><Paragraph Code="se=&quot;4&quot;,ss=&quot;4&quot;,p1=&quot;b&quot;"><Label>(<Emphasis style="italic">b</Emphasis>)</Label><Text>the medicinal ingredient, brand name, dosage form, strength, route of administration and use set out in the new drug submission or the supplement to a new drug submission to which the list relates;</Text></Paragraph><Paragraph Code="se=&quot;4&quot;,ss=&quot;4&quot;,p1=&quot;c&quot;"><Label>(<Emphasis style="italic">c</Emphasis>)</Label><Text>for each patent on the list, the patent number, the filing date of the patent application in Canada, the date of grant of the patent and the date on which the term limited for the duration of the patent will expire under section 44 or 45 of the <XRefExternal reference-type="act" link="P-4">Patent Act</XRefExternal>;</Text></Paragraph><Paragraph Code="se=&quot;4&quot;,ss=&quot;4&quot;,p1=&quot;d&quot;"><Label>(<Emphasis style="italic">d</Emphasis>)</Label><Text>for each patent on the list, a statement that the first person who filed the new drug submission or the supplement to a new drug submission to which the list relates is the owner of the patent or has an exclusive licence to the patent, or has obtained the consent of the owner of the patent to its inclusion on the list;</Text></Paragraph><Paragraph Code="se=&quot;4&quot;,ss=&quot;4&quot;,p1=&quot;e&quot;"><Label>(<Emphasis style="italic">e</Emphasis>)</Label><Text>the address in Canada for service, on the first person, of a notice of allegation referred to in paragraph 5(3)(<Emphasis style="italic">a</Emphasis>) or the name and address in Canada of another person on whom service may be made with the same effect as if service were made on the first person; and</Text></Paragraph><Paragraph Code="se=&quot;4&quot;,ss=&quot;4&quot;,p1=&quot;f&quot;"><Label>(<Emphasis style="italic">f</Emphasis>)</Label><Text>a certification by the first person that the information submitted under this subsection is accurate and that each patent on the list meets the eligibility requirements of subsection (2) or (3).</Text></Paragraph></Subsection><Subsection Code="se=&quot;4&quot;,ss=&quot;5&quot;"><Label>(5)</Label><Text>Subject to subsection (6), a first person who submits a patent list must do so at the time the person files the new drug submission or the supplement to a new drug submission to which the patent list relates.</Text></Subsection><Subsection Code="se=&quot;4&quot;,ss=&quot;6&quot;"><Label>(6)</Label><Text>A first person may, after the date of filing of a new drug submission or a supplement to a new drug submission, and within 30 days after the issuance of a patent that was issued on the basis of an application that has a filing date in Canada that precedes the date of filing of the submission or supplement, submit a patent list, including the information referred to in subsection (4), in relation to the submission or supplement.</Text></Subsection><Subsection Code="se=&quot;4&quot;,ss=&quot;7&quot;"><Label>(7)</Label><Text>A first person who has submitted a patent list must keep the information on the list up to date but, in so doing, may not add a patent to the list.</Text></Subsection><Subsection Code="se=&quot;4&quot;,ss=&quot;8&quot;"><Label>(8)</Label><Text>The Minister shall insert on the patent list the date of filing and submission number of the new drug submission or the supplement to a new drug submission in relation to which the list was submitted.</Text></Subsection><HistoricalNote><ul><li>SOR/98-166, s. 3;</li><li> SOR/2006-242, s. 2;</li><li> err. or</Text></Paragraph><Paragraph Code="se=&quot;6&quot;,ss=&quot;5&quot;,p1=&quot;b&quot;"><Label>(<Emphasis style="italic">b</Emphasis>)</Label><Text>on the ground that it is redundant, scandalous, frivolous or vexatious or is otherwise an abuse of process in respect of one or more patents.</Text></Paragraph></Subsection><Subsection Code="se=&quot;6&quot;,ss=&quot;5.1&quot;"><Label>(5.1)</Label><Text>In a proceeding in respect of an application under subsection (1), the court shall not dismiss an application in whole or in part solely on the basis that a patent on a patent list that was submitted before June 17, 2006 is not eligible for inclusion on the register.</Text></Subsection><Subsection Code="se=&quot;6&quot;,ss=&quot;6&quot;"><Label>(6)</Label><Text>For the purposes of an application referred to in subsection (1), if a second person has made an allegation under subparagraph 5(1)(<Emphasis style="italic">b</Emphasis>)(iv) or (2)(<Emphasis style="italic">b</Emphasis>)(iv) in respect of a patent and the patent was granted for the medicinal ingredient when prepared or produced by the methods or processes of manufacture particularly described and claimed in the patent, or by their obvious chemical equivalents, it shall be considered that the drug proposed to be produced by the second person is, in the absence of proof to the contrary, prepared or produced by those methods or processes.</Text></Subsection><Subsection Code="se=&quot;6&quot;,ss=&quot;7&quot;"><Label>(7)</Label><Text>On the motion of a first person, the court may, at any time during a proceeding,</Text><Paragraph Code="se=&quot;6&quot;,ss=&quot;7&quot;,p1=&quot;a&quot;"><Label>(<Emphasis style="italic">a</Emphasis>)</Label><Text>order a second person to produce any portion of the submission or supplement filed by the second person for a notice of compliance that is relevant to the disposition of the issues in the proceeding and may order that any change made to the portion during the proceeding be produced by the second person as it is made;                     — SOR/2008-211, s. 4</TitleText></Heading><Section><Label>4.</Label><Subsection><Label>(1)</Label><Text>Words and expressions used in this section have the same meaning as in the <XRefExternal reference-type="regulation">Patented Medicines (Notice of Compliance) Regulations</XRefExternal>.</Text></Subsection><Subsection><Label>(2)</Label><Text>If, after March 29, 2007, the Minister deleted from the register a patent on a patent list that was submitted before June 17, 2006 solely on the basis that the patent was not relevant to the submission for a notice of compliance to which the patent list relates, the first person may, within 30 days after the day on which these Regulations come into force, deliver a written request to the Minister asking that the patent be added to the register.</Text></Subsection><Subsection><Label>(3)</Label><Text>The Minister shall, within 30 days after the day on which the request referred to in subsection (2) is received, add the patent to the register.</Text></Subsection><Subsection><Label>(4)</Label><Text>If, after March 29, 2007, the Minister refused to add to the register a patent on a patent list submitted before June 17, 2006 solely on the basis that the patent was not relevant to the submission for a notice of compliance to which the patent list relates, the first person may, within 30 days after the day on which these Regulations come into force, deliver a written request to the Minister asking that the patent be added to the register.</Text></Subsection><Subsection><Label>(5)</Label><Text>The Minister shall, within 30 days after the later of the day on which the request referred to in subsection (4) is received and the day on which the notice of compliance referred to in that subsection is issued, add the patent to the register.</Text></Subsection><Subsection><Label>(6)</Label><Text>A second person is not required to comply with subsection 5(1) of the <XRefExternal reference-type="regulation">Patented Medicines (Notice of Compliance) Regulations</XRefExternal> in respect of a patent added to the register under subsection (3) or (5) on or after the date of filing of the submission referred to in that subsection 5(1).</Text></Subsection><Subsection><Label>(7)</Label><Text>A second person is not required to comply with subsection 5(2) of the <XRefExternal reference-type="regulation">Patented Medicines (Notice of Compliance) Regulations</XRefExternal> in respect of a patent added to the register under subsection (3) or (5) on or after the date of filing of the supplement referred to in that subsection 5(2).</Text></Subsection><Subsection><Label>(8)</Label><Text>Subsection 6(5.1) of the <XRefExternal reference-type="regulation">Patented Medicines (Notice of Compliance) Regulations</XRefExternal> does not apply to a motion of the second person brought under subsection 6(5) of those Regulations before the date of the publication of these Regulations in Part I of the <XRefExternal reference-type="other">Canada Gazette</XRefExternal>.</Text></Subsection></Section></RelatedOrNotInForce></RegulationPiece></Schedule></Regulation>
