Marginal note:Liability of directors for wages unpaid

  •  (1) The directors of the company are jointly and severally liable to the clerks, labourers, servants and apprentices thereof, for all debts, not exceeding six months wages due for services performed for the company while they are such directors respectively, but no director is liable to an action therefor, unless the company has been sued for the debt within one year after the debt became due, nor unless such director is sued therefor within one year from the time when he ceased to be a director, nor unless an execution against the company at the suit of such clerk, labourer, servant or apprentice is returned unsatisfied in whole or in part.

  • Marginal note:Amount recoverable

    (2) The amount unsatisfied on such execution is the amount recoverable with costs from the directors.
