Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 2001-628 on October 4, 2001, which approved an application by Newcap Inc. for a broadcasting licence for an English-language FM radio programming undertaking at Ottawa/Hull, operating on the frequency 89.9 MHz (channel 210C1) with an effective radiated power of 27,000 watts;

Whereas, subsequent to the rendering of that Decision, the Governor in Council received a petition requesting that that Decision be referred back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing of the matter by the Commission;

And whereas the Governor in Council, having considered the petition, is not satisfied that that Decision derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting ActFootnote ^a;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting ActFootnote ^a, hereby declines to set aside or to refer back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing Decision CRTC 2001-628 of October 4, 2001.
