Order Referring Back to the CRTC a Decision Issuing a Broadcasting Licence to Omineca Cablevision Limited
Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 84-899 on October 19, 1984 issuing a broadcasting licence to Omineca Cablevision Limited;
Whereas, subsequent to the rendering of Decision CRTC 84-899, the Governor in Council has received a petition from the Fort St. James T.V. Society requesting that the said Decision CRTC 84-899 be referred back to the Commission for reconsideration and hearing by the Commission, and has considered this petition;
Whereas the Governor in Council is of the opinion that it is material to the application for the issuance of the said broadcasting licence that the Commission consider and identify whether and to what extent the issuance may diminish both the number and the variety of television programming services presently available to persons residing outside of the immediate limits of the Village of Fort St. James, British Columbia;
Whereas the Governor in Council is of the further opinion that it is material to the application for the issuance of the said licence that the Commission consider and identify, in the event the number and the range of such television programming services are diminished by virtue of the issuance of the said licence, what solutions may be proposed to remedy this situation in the best interests of persons residing outside of the immediate limits of the Village of Fort St. James, British Columbia;
And Whereas the Governor in Council is of the opinion that the Commission did not consider or did not consider adequately these matters in rendering Decision CRTC 84-899.
Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Communications, pursuant to section 23 of the Broadcasting Act, hereby refers Decision CRTC 84-899 of October 19, 1984 issuing a broadcasting licence to Omineca Cablevision Limited back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission.
