Order Declining to Set Aside or to Refer Back to the CRTC a Decision Respecting Radio Station CIWW Ottawa

Whereas the Canadian Radio-television and Telecommunications Commission rendered a number of decisions reported in the Decision CRTC 94-923 document dated December 19, 1994;

Whereas, amongst these decisions, were decisions to renew the licence for radio station CIWW Ottawa and to issue licences for cable television undertakings in Thunder Bay, Sault Ste. Marie, Niagara Falls and St. Catharines;

Whereas, under section 28 of the Broadcasting Act, the Governor in Council may, on petition of any person or on the Governor in Council's own motion, set aside or refer back to the Commission any decision to issue, amend or renew a broadcasting licence, if the Governor in Council is satisfied that it derogates from the attainment of the objectives of the broadcasting policy for Canada;

Whereas the Governor in Council has received petitions requesting that the decisions to issue or to renew licences, as contained in the Decision CRTC 94-923 document, be set aside or referred back to the Commission for reconsideration and hearing;

And Whereas the Governor in Council, having considered these petitions, is not satisfied that these decisions to issue or to renew licences derogate from the attainment of the objectives of the broadcasting policy for Canada;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Communications, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or to refer back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing, those decisions reported in the Decision CRTC 94-923 document dated December 19, 1994, approving the applications to renew the broadcasting licence for radio station CIWW Ottawa and the applications to issue licences for cable television undertakings in Thunder Bay, Sault Ste. Marie, Niagara Falls and St. Catharines.
