Order Declining to Set Aside or to Refer Back to the CRTC a Decision Respecting a Broadcasting Licence

Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 96-731 on November 1, 1996 approving the applications by Craig Broadcast Systems Inc. (CBSI), on behalf of a company to be incorporated (A - Channel Inc./A - Channel), for broadcasting licences to carry on new, independent, English-language (television) programming undertakings in Alberta;

Whereas, subsequent to the rendering of Decision CRTC 96-731, the Governor in Council has received a petition requesting that the said decision be set aside;

And whereas the Governor in Council, having considered the petition, is not satisfied that Decision CRTC 96-731 derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or to refer Decision CRTC 96-731 of November 1, 1996 back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission.
