Expropriation Fees Regulations

The Minister of Public Works and Government Services, pursuant to subsection 4.1(4)Footnote a of the Expropriation Act, subsection 6(4)Footnote b of the Dry Docks Subsidies Act, subsection 31(3.1)Footnote c of the Northwest Territories Waters ActFootnote d, subsection 7(1.3)Footnote e of the Dominion Water Power Act and subsection 31(3.1)Footnote f of the Yukon Waters ActFootnote g, hereby makes the annexed Expropriation Fees Regulations.

Amount and Interest

 For the purposes of subsection 4.1(4) of the Expropriation Act, subsection 6(4) of the Dry Docks Subsidies Act, subsection 31(3.1) of the Northwest Territories Waters Act, subsection 7(1.3) of the Dominion Water Power Act and subsection 31(3.1) of the Yukon Waters Act, for every billable hour that each employee of the Department of Public Works and Government Services assigned to an expropriation works on the expropriation, fees are prescribed in the amount of twice the hourly rate of each employee prorated from the employee’s salary per diem, based on a productivity rate of 220 days per year, plus employee benefits (20% of total chargeable salaries).

 The rate of interest payable in respect of overdue fees shall be calculated in accordance with section 5 of the Interest and Administrative Charges Regulations.

Coming into Force

 These Regulations come into force on the day on which they are registered.
