AMENDMENTS NOT IN FORCE

    • Replacement of “trade-mark” in regulations
      • 366 (3) Unless the context requires otherwise, “trade-mark”, “trade-marks”, “Trade-mark”, “Trade-marks”, “trade mark” and “trade marks”, are replaced by “trademark”, “trademarks”, “Trademark” or “Trademarks”, as the case may be, in the English version of any regulation, as defined in subsection 2(1) of the Statutory Instruments Act.

      • 8 (1) Paragraphs 3(4)(a) and (b) of the Trade-marks RegulationsFootnote 2 are replaced by the following:

        • (a) if the correspondence is delivered to the establishment on a day when the Office of the Registrar of Trade-marks is open to the public for all or part of that day, the correspondence is deemed to be received by the Registrar on that day; and

        • (b) in any other case, the correspondence is deemed to be received by the Registrar on the day when the Office is next open to the public.

      • (2) Subsections 3(3) and (5) of the English version of the Regulations are amended by replacing “for business” with “to the public”.

      • (3) Subsections 3(7) and (8) of the Regulations are replaced by the following:

        • (7) For the purposes of subsection (6), if, according to the local time of the place where the Office of the Registrar of Trade-marks is located, the correspondence is delivered on a day when the Office is open to the public for all or part of that day, it is deemed to be received by the Registrar on that day.

        • (8) For the purposes of subsection (6), if, according to the local time of the place where the Office of the Registrar of Trade-marks is located, the correspondence is delivered on a day when the Office is closed to the public for all of that day, it is deemed to be received by the Registrar on the day when the Office is next open to the public.

    • 9 The Regulations are amended by adding the following after section 14:

      • 14.1 The following days are prescribed for the purposes of subsection 66(1) of the Act:

        • (a) Saturday;

        • (b) Sunday;

        • (c) January 1 or, if January 1 falls on a Saturday or Sunday, the following Monday;

        • (d) Good Friday;

        • (e) Easter Monday;

        • (f) the Monday before May 25;

        • (g) June 24 or, if June 24 falls on a Saturday or Sunday, the following Monday;

        • (h) July 1 or, if July 1 falls on a Saturday or Sunday, the following Monday;

        • (i) the first Monday in August;

        • (j) the first Monday in September;

        • (k) the second Monday in October;

        • (l) November 11 or, if November 11 falls on a Saturday or Sunday, the following Monday;

        • (m) December 25 and 26 or

          • (i) if December 25 falls on a Friday, that Friday and the following Monday, and

          • (ii) if December 25 falls on a Saturday or Sunday, the following Monday and Tuesday; and

        • (n) any day on which the Office of the Registrar of Trade-marks is closed to the public for all or part of that day during ordinary business hours.
