Order Designating the Province of Prince Edward Island for the Purposes of the Definition “applicable guidelines” in Subsection 2(1) of the Divorce Act

Whereas the Province of Prince Edward Island, pursuant to subsection 2(5)Footnote a of the Divorce ActFootnote b, has established comprehensive guidelines for the determination of child support that deal with the matters referred to in section 26.1Footnote c of that Act;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to subsection 2(5)Footnote a of the Divorce ActFootnote b, hereby makes the annexed Order Designating the Province of Prince Edward Island for the Purposes of the Definition “applicable guidelines” in Subsection 2(1) of the Divorce Act.

Designation

 The Province of Prince Edward Island is hereby designated for the purposes of the definition applicable guidelines in subsection 2(1) of the Divorce Act.

Guidelines

 For the purposes of subsection 2(5) of the Divorce Act, the laws that constitute the comprehensive guidelines for the Province of Prince Edward Island are paragraph 1(1)(c), paragraph 1(1)(e), read without reference to the words “and applied pursuant to Part III of the Act”, and section 5 of the Child Support Guidelines Regulations, EC668/97.

Coming into Force

 This Order comes into force on January 1, 1998.
