    Regulations Respecting Television Broadcasting

     In these Regulations,

    advertising material

    advertising material  means any commercial message and programming that promotes a station, network or program, but does not include

    • (d) a promotion for a Canadian program or a Canadian feature film, notwithstanding that a sponsor is identified in the title of the program or the film or is identified as a sponsor of that program or that film, where the identification is limited to the name of the sponsor only and does not include a description, representation or attribute of the sponsor’s products or services; (matériel publicitaire)

    baseband

    baseband  means signals in the frequency range 0 to 120 kHz that are used as input to the sound transmitter of a station; (bande de base)

    broadcast day

    broadcast day , in respect of a licensee, means the period of up to 18 consecutive hours, beginning each day not earlier than six o’clock in the morning and ending not later than one o’clock in the morning of the following day, as selected by the licensee; (journée de radiodiffusion)

    Canadian program

    Canadian program  means a program

    • (a) in respect of which a Canadian film or video production certificate, as defined in subsection 125.4(1) of the Income Tax Act, has been issued; or

    • (b) that qualifies as a Canadian program in accordance with the criteria established by the Commission in

    ethnic station  means a station that is licensed as an ethnic station; (station à caractère ethnique)

  2. Television Broadcasting Regulations, 1987 - SOR/87-49 (Section 18)
    Regulations Respecting Television Broadcasting
    •  (1) The following definitions apply in this section.

      community station

      community station means a station that is licensed as a community station. (station communautaire)

      native station

      native station means a station that is licensed as a native station. (station autochtone)

    • (2) Except as otherwise provided under a condition of its licence, a licensee shall implement on all stations that it is licensed to operate, by no later than March 31, 2015, a public alerting system that broadcasts without delay, on a given station, any alert that it receives, in a form including both text and audio content, from the National Alert Aggregation and Dissemination System that

      • (b) is designated by the applicable issuing authority for immediate broadcast in all or part of the area within the station’s Grade B official contour or noise-limited bounding official contour, as the case may be.

    • (6) The licensee shall take all reasonable measures to ensure that the alerts that it broadcasts are in conformity with the specifications and recommended practices set out in the document entitled National Public Alerting System Common Look and Feel Guidance, produced at the request of the Federal/Provincial/Territorial Public Alerting Working Group of Senior Officials Responsible for Emergency Management with the support of Defence Research and Development Canada, Centre for Security Science, Canadian Safety and Security Program, and in consultation with the public-private Common Look and Feel Working Group, as that document is amended from time to time.

  3. Television Broadcasting Regulations, 1987 - SOR/87-49 (Section 16)
    Regulations Respecting Television Broadcasting
    •  (1) For the purposes of this section, distant television station has the same meaning as in section 1 of the Broadcasting Distribution Regulations.

    • (2) Except as otherwise provided under a condition of its licence, a licensee shall not offer its programming service for distribution as a distant television station as part of a package with other programming services unless it also makes its programming service available as a distant television station on a stand-alone basis.

    •  (1) For the purposes of this section,

      associate

      associate , when used to indicate a relationship with any person, includes

  5. Television Broadcasting Regulations, 1987 - SOR/87-49 (Section 10)
    Regulations Respecting Television Broadcasting
    •  (1) Subject to any condition of licence, a licensee shall

      • (c) cause to be entered in the log or record each day the following information:

        • (v) in relation to each program broadcast,

          • (D) the code set out in Schedule II indicating the language, type or group, as applicable, and

    • (3) Except as otherwise provided under a condition of its licence, a licensee shall furnish to the Commission, within 30 days after the end of each month, the program log or machine-readable record of the licensee for that month, together with a certificate signed by or on behalf of the licensee attesting to the accuracy of the contents of the log or record.

    • (7) Where a program is broadcast during reserved time by a station operator who operates as part of a television network, subsection (5) applies only to the network operator.
