lims:fid="80674" lims:id="80674"><Text><DefinedTermEn>educational institution</DefinedTermEn> means a technical or vocational school, a university, college or other school of higher education in Canada, approved by the Minister for the education or instruction of students pursuant to this Act; (<DefinedTermFr>établissement d’enseignement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="80675" lims:id="80675"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Veterans Affairs; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="80676" lims:id="80676"><Text><DefinedTermEn>student</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="80677" lims:id="80677"><Label>(a)</Label><Text>a child on whose behalf a pension is being paid under or by virtue of any of the enactments set out in the schedule at a rate set out for a child in Schedule II to the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="80678" lims:id="80678"><Label>(b)</Label><Text>a child on whose behalf payment of a pension was being made under or by virtue of any of the enactments set out in the schedule but was, either before, on or after July 1, 1953, discontinued pursuant to the enactment under or by virtue of which the payment was being made,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="80679" lims:id="80679"><Label>(c)</Label><Text>a child on whose behalf no pension has been paid under or by virtue of any of the enactments set out in the schedule and who is, except for age, eligible for a pension under or by virtue of any of the enactments set out in the schedule at a rate provided for a child in Schedule II to the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="80680" lims:id="80680"><Label>(d)</Label><Text>a child who, but for the operation of section 25 or 26 of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, would be included in paragraph (a) of this definition,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="80681" lims:id="80681"><Label>(e)</Label><Text>a child of a member or a veteran, as those terms are defined in subsection 2(1) of the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>, if the member or veteran dies</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="80682" lims:id="80682"><Label>(i)</Label><Text>of an injury or a disease that was attributable to or was incurred during special duty service or arose out of or was directly connected with service in the Canadian Forces, within the meaning of that Act, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="80683" lims:id="80683"><Label>(ii)</Label><Text>of an injury or a disease that was aggravated, if the aggravation was attributable to or was incurred during special duty service or arose out of or was directly connected to service in the Canadian Forces, within the meaning of that Act, or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="80684" lims:id="80684"><Label>(f)</Label><Text>a child of a member or a veteran, as those terms are defined in subsection 2(1) of the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>, if</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="80685" lims:id="80685"><Label>(i)</Label><Text>the member or veteran is deceased,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-06-21" lims:fid="80686" lims:id="1121247"><Label>(ii)</Label><Text>a disability award or pain and suffering compensation has been granted under that Act in respect of the member or veteran, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-06-21" lims:fid="80687" lims:id="1121248"><Label>(iii)</Label><Text>the member’s or veteran’s extent of disability, in respect of the aggregate of all of the member’s or veteran’s disability assessments under that Act and, if applicable, the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, is equal to or greater than the lowest extent of disability set out in column 2 of Schedule 3 to the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal> in respect of a rate of C-28, s. 3; R.S., 1985, c. 12 (2nd Supp.), s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2003-11-07" lims:lastAmendedDate="2003-11-07" lims:fid="80697" lims:id="80697"><Label>3.1</Label><Text><Repealed>[Repealed, 2003, c. 27, s. 2]</Repealed></Text></Section><Section lims:inforce-start-date="2003-11-07" lims:lastAmendedDate="2003-11-07" lims:fid="80698" lims:id="80698"><MarginalNote lims:inforce-start-date="2003-11-07" lims:fid="80699" lims:id="80699">Amount of allowance</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2003-11-07" lims:fid="80700" lims:id="80700"><Label>(1)</Label><Text>The amount of the monthly allowance that may be paid to or in respect of a student during the period in which the student pursues a full-time course of study in an educational institution is the aggregate of</Text><Paragraph lims:inforce-start-date="2003-11-07" lims:fid="80701" lims:id="80701"><Label>(a)</Label><Text>$300.00, and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-11-07" lims:fid="80702" lims:id="80702"><Label>(b)</Label><Text>if no pension is being paid on behalf of the student under or by virtue of any of the enactments set out in the schedule, an additional amount equal to the monthly rate of pension for one orphan child provided in Schedule II to the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-11-07" lims:fid="80703" lims:id="80703"><MarginalNote lims:inforce-start-date="2003-11-07" lims:fid="80704" lims:id="80704">Total period covered</MarginalNote><Label>(2)</Label><Text>The total period for which an allowance and costs may be paid to or in respect of a student under this Act shall not exceed four academic years or thirty-six months, whichever is the lesser.</Text></Subsection><Subsection lims:inforce-start-date="2003-11-07" lims:fid="80705" lims:id="80705"><MarginalNote lims:inforce-start-date="2003-11-07" lims:fid="80706" lims:id="80706">Costs</MarginalNote><Label>(3)</Label><Text>The costs of education or instruction that may be paid in respect of a student under this Act shall include such tuition and other fees and costs as may be prescribed by regulation.</Text></Subsection><Subsection lims:inforce-start-date="2003-11-07" lims:fid="80707" lims:id="80707"><MarginalNote lims:inforce-start-date="2003-11-07" lims:fid="80708" lims:id="80708">Minister may extend</MarginalNote><Label>(4)</Label><Text>The Minister may extend the total period for which an allowance and costs may be paid to or in respect of a student under this Act where the Minister is of the opinion that the student’s progress and achievements in his course of study are such that it would be in the interest both of the student and of the public that the payments under section 3 be continued during a further period.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-11-07" lims:fid="80710" lims:id="80710">R.S., 1985, c. C-28, s. 4; 1990, c. 43, s. 45; 2003, c. 27, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="80711" lims:id="80711"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="80712" lims:id="80712">Age limit</MarginalNote><Label>5</Label><Text>No allowance or costs shall be paid under this Act in respect of a student who</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="80713" lims:id="80713"><Label>(a)</Label><Text>has attained the age of twenty-five years, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="80714" lims:id="80714"><Label>(b)</Label><Text>where, pursuant to subsection 4(4), the Minister has extended the total period for which an allowance and costs may be paid beyond the year in which the student attains the age of twenty-five years, has attained the age of thirty years,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="80715" lims:id="80715"><Text>except in so far as may be necessary to enable the student to complete the academic year in which he attains that age.</Text></ContinuedSectionSubsection><Provision lims:inforce-start-date="2002-12-31" lims:fid="80716" lims:id="80716" format-ref="indent-0-0" language-align="no" list-item="no"><Label>(2) and (3)</Label><Text><Repealed>[Repealed, 1990, c. 43, s. 46]</Repealed></Text></Provision><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="80718" lims:id="80718">R.S., 1985, c. C-28, s. 5; 1990, c. 43, s. 46</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="80719" lims:id="80719"><Label>6</Label><Text><Repealed>[Repealed, 1990, c. 43, s. 47]</Repealed></Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="80720" lims:id="80720"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="80721" lims:id="80721">Failure to be promoted</MarginalNote><Label>7</Label><Text>No allowance or costs shall be paid to or in respect of a student for any education or instruction obtained after the student fails to meet the requirements of an educational institution for promotion to the next succeeding level of the full-time course of study that the student is pursuing at that educational institution, unless</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="80722" lims:id="80722"><Label>(a)</Label><Text>the student failed to meet the requirements for promotion, in the opinion of the Minister, for reasons beyond the student’s control, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="80723" lims:id="80723"><Label>(b)</Label><Text>the student is subsequently, in the opinion of the Minister, promoted to the next succeeding level of that full-time course of study or of another full-time course of study having equivalent levels at that or another educational institution.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="80725" lims:id="80725">R.S., 1985, c. C-18, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="80730" lims:id="80730" level="1"><TitleText>Annual Adjustment of Allowances</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="80731" lims:id="80731"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="80732" lims:id="80732">Annual adjustment</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="80733" lims:id="80733"><Label>(1)</Label><Text>Where any allowance has become payable under this Act, the basic monthly amount of that allowance shall be adjusted annually, in such manner as may be prescribed by the Governor in Council, so that the amount payable for a month in any following year is an amount equal to the product obtained by multiplying</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="80734" lims:id="80734"><Label>(a)</Label><Text>the amount that would have been payable for that month if no adjustment had been made under this section with respect to that following year,</Text><Provision lims:inforce-start-date="2002-12-31" lims:fid="80735" lims:id="80735" format-ref="indent-0-0" language-align="no" list-item="no"><Text>by</Text></Provision></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="80736" lims:id="80736"><Label>(b)</Label><Text>the ratio that the Consumer Price Index for the twelve month period ending on the thirty-first day of October immediately before that following year bears to the Consumer Price Index for the twelve month period immediately before that twelve month period.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="80737" lims:id="80737"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="80738" lims:id="80738">Meaning of certain references</MarginalNote><Label>(2)</Label><Text>In this section and section 11,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="80739" lims:id="80739"><Label>(a)</Label><Text>a reference to the Consumer Price Index for any twelve month period means the average of the Consumer Price Index for Canada, as published by Statistics Canada under the authority of the <XRefExternal reference-type="act" link="S-19">Statistics Act</XRefExternal>, for each month in that twelve month period; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="80740" lims:id="80740"><Label>(b)</Label><Text>a reference to the basic monthly amount of any allowance shall be construed as a reference to the amount of that allowance, expressed in terms of a monthly amount and calculated without regard to the provisions of this section.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="80742" lims:id="80742">R.S., 1985, c. C-28, s. 9; 1990, c. 43, s. 49</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="80743" lims:id="80743"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="80744" lims:id="80744">Limitation</MarginalNote><Label>10</Label><Text>Notwithstanding anything in section 9, the amount of any allowance that may be paid to a person for a month in any calendar year shall not, by reason only of that section, be less than the amount of the allowance that was or may be paid to that person for any month in the immediately preceding calendar year.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="80746" lims:id="80746">1972, c. 12, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="80747" lims:id="80747"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="80748" lims:id="80748">Where basis of Consumer Price Index changed</MarginalNote><Label>11</Label><Text>Where at any time the Consumer Price Index for Canada, as published by Statistics Canada under the authority of the <XRefExternal reference-type="act" link="S-19">Statistics Act</XRefExternal>, is adjusted to reflect a new time basis or a new content basis, a corresponding adjustment shall be made in the Consumer Price Index for any twelve month period that is used for the purpose of calculating the amount of any allowance that may be paid.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="80750" lims:id="80750">1972, c. 12, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="80751" lims:id="80751" level="1"><TitleText>Regulations</TitleText></Heading><Section lims:inforce-start-date="2003-11-07" lims:lastAmendedDate="2003-11-07" lims:fid="80752" lims:id="80752"><MarginalNote lims:inforce-start-date="2003-11-07" lims:fid="80753" lims:id="80753">Regulations</MarginalNote><Label>12</Label><Text>The Governor in Council may make regulations</Text><Paragraph lims:inforce-start-date="2003-11-07" lims:fid="80754" lims:id="80754"><Label>(a)</Label><Text>prescribing the manner of payment of the allowances and costs under this Act to or in respect of students and the manner of computing the amount of allowances and costs payable in respect of any period;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-11-07" lims:fid="80755" lims:id="80755"><Label>(a.1)</Label><Text>prescribing the maximum amount of costs under this Act payable in respect of a student, and providing for the annual adjustment of that amount as a function of the Consumer Price Index;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-11-07" lims:fid="80756" lims:id="80756"><Label>(b)</Label><Text>prescribing the conditions in addition to those specified in this Act under which the payment of allowances or costs may be terminated; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-11-07" lims:fid="80757" lims:id="80757"><Label>(c)</Label><Text>generally, for carrying out the purposes and provisions of this Act.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-11-07" lims:fid="80759" lims:id="80759">R.S., 1985, c.           — 2003, c. 27, s. 12</TitleText></Heading><Section><MarginalNote>Authority to make allowance and pay costs</MarginalNote><Label>12</Label><Subsection><Label>(1)</Label><Text>The Minister of Veteran Affairs may, for the purposes of the <XRefExternal reference-type="act" link="C-28">Children of Deceased Veterans Education Assistance Act</XRefExternal>, make allowances to or in respect of, and pay the education or instruction costs in respect of, a student who was not entitled to them by reason only of section 3.1 of that Act before its repeal by section 2 of this Act.</Text></Subsection><Subsection><MarginalNote>Amount of allowance</MarginalNote><Label>(2)</Label><Text>For the purposes of subsection (1), the amount of the monthly allowance that may be paid to or in respect of a student for the period beginning on February 28, 1995 and ending on August 31, 2003 is $167.47, in lieu of the aggregate of the amounts referred to in paragraphs 4(1)(a) and (b) of the <XRefExternal reference-type="act" link="C-28">Children of Deceased Veterans Education Assistance Act</XRefExternal>.</Text></Subsection><Subsection><MarginalNote>Maximum amount of education or instruction costs</MarginalNote><Label>(3)</Label><Text>For the purposes of subsection (1), the maximum amount of education or instruction costs payable in respect of a student for any academic year falling, in whole or in part, within the period beginning on February 28, 1995 and ending on August 31, 2003 is $1,500.</Text></Subsection><Subsection><MarginalNote>Maximum period covered</MarginalNote><Label>(4)</Label><Text>For the purposes of subsection (1), subsection 4(4) of the <XRefExternal reference-type="act" link="C-28">Children of Deceased Veterans Education Assistance Act</XRefExternal> does not apply.</Text></Subsection></Section></RelatedOrNotInForce><RelatedOrNotInForce><Heading level="5" style="nifrp"><TitleText>
          — 2003, c. 27, s. 13</TitleText></Heading><Section><MarginalNote>Definition of <DefinitionRef>amending regulation</DefinitionRef></MarginalNote><Label>13</Label><Subsection><Label>(1)</Label><Text>In subsection (2), <DefinedTermEn>amending regulation</DefinedTermEn> means the first regulation amending paragraph 5(3)(a) of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._399">Children of Deceased Veterans Education Assistance Regulations</XRefExternal> that is made after this Act is assented to.</Text></Subsection><Subsection><MarginalNote>Maximum amount of education or instruction costs</MarginalNote><Label>(2)</Label><Text>For the purposes of the <XRefExternal reference-type="act" link="C-28">Children of Deceased Veterans Education Assistance Act</XRefExternal> and notwithstanding paragraph 5(3)(a) of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._399">Children of Deceased Veterans Education Assistance Regulations</XRefExternal>, the maximum amount of education or instruction costs payable in respect of a student for any academic year falling, in whole or in part, within the period beginning on September 1, 2003 and ending on the day on which the amending regulation comes into force is $4,000.</Text></Subsection></Section></RelatedOrNotInForce></BillPiece></Schedule></Statute>
