lims:fid="505864" lims:id="1455319"><Label>4</Label><Text>A participant who is absent from duty must contribute to the Consolidated Revenue Fund an amount equal to the amount the participant would be required to contribute under section 53 of the Act if the participant were not absent from duty.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="505866" lims:enacted-date="2024-05-09" lims:fid="1452074" lims:id="1455324">Subject to subsection (2) and section 7, a participant who is absent from duty without pay must pay the contributions that are required to be paid in respect of that absence</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505870" lims:id="505870"><Label>(a)</Label><Text>in a lump sum within 30 days after the participant’s return to duty; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505871" lims:id="505871"><Label>(b)</Label><Text>by reservation in equal instalments from the salary payable to the participant for a period equal to twice the period of absence commencing on the expiration of the period of absence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="505872" lims:id="505872"><Label>(2)</Label><Text lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1452075" lims:id="1455325">If payment under paragraph (1)(b) would cause the participant financial hardship, the participant may choose to make payment by reservation from their salary of approximately equal instalments over a period not exceeding the lesser of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505873" lims:id="505873"><Label>(a)</Label><Text>three times the period of absence, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505874" by a participant who is absent from duty without pay to serve as described in any one of the following paragraphs, must be paid in advance, annually:</Text><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455328" lims:id="1455328"><Label>(a)</Label><Text>with an international organization;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455329" lims:id="1455329"><Label>(b)</Label><Text>with the government of a country other than Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455330" lims:id="1455330"><Label>(c)</Label><Text>as a full-time paid official of a public service employee organization;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455331" lims:id="1455331"><Label>(d)</Label><Text>as a full-time paid official of a credit union;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455332" lims:id="1455332"><Label>(e)</Label><Text>outside the public service on an inquiry established under Part I of the <XRefExternal reference-type="act" link="I-11">Inquiries Act</XRefExternal>, or with any board or agency that is an agent of His Majesty in right of Canada.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="505885" lims:id="1455333" lims:enactId="1451984">SOR/2024-85, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2024-06-01" lims:fid="505886" lims:id="505886"><Label>7.1</Label><Text lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1452082" lims:id="1455433">Where an amount payable by a contributor under section 4 is unpaid at the time the contributor ceases to be employed in the public service, the amount shall be deducted from any benefit that is or will become payable under the Act to the contributor</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505887" lims:id="505887"><Label>(a)</Label><Text>where the benefit is an annuity or annual allowance,</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="505888" lims:id="505888"><Label>(i)</Label><Text>by reservation from the monthly instalments of the annuity or annual allowance of an amount equal to the amount of any instalment otherwise payable by the contributor under section 6 or 30 per cent of the gross monthly annuity or annual allowance, whichever is the lesser, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="505889" lims:id="505889"><Label>(ii)</Label><Text>in a lump sum, if the contributor so elects, at the time the annuity or annual allowance becomes payable; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505890" lims:id="505890"><Label>(b)</Label><Text>in any other case, in a lump sum, at the time the benefit becomes payable.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="505892" lims:fid="505894" lims:id="1455334"><Label>8</Label><Text>The contributions required to be paid by a participant who is a seasonal employee or sessional employee for the period during which they are not on duty in the public service must be paid at the time and in the manner that contributions would be payable under section 6 as if the employee were, during that period, a participant described in Receiving Less than Normal Salary</TitleText></Heading><Section lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:lastAmendedDate="2024-06-01" lims:fid="505898" lims:id="1455337"><Label>9</Label><Subsection lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455338" lims:id="1455338"><Label>(1)</Label><Text>For the purposes of Part II of the Act, when a participant engaged otherwise than on a full-time basis during an educational leave or a period of seasonal lay-off receives, during the educational leave or period of lay-off, salary that is less than what they would have received had they not been on leave or lay-off, they are deemed to have been, while so engaged, employed in the public service and the salary that they are deemed to have received during that leave or period of lay-off is the salary that they would have received had they not been on leave or lay-off.</Text></Subsection><Subsection lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455339" lims:id="1455339"><Label>(2)</Label><Text>The contributions required to be paid by a participant described in subsection (1) must be paid at the time and in the manner that contributions would be payable under section 6 as if the participant were, during their educational leave or period of lay-off, a participant described in that section.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455341" level="1"><TitleText>Contributions by Elective Participants</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="505905" lims:id="505905">SOR/92-716, s. 8(F)</HistoricalNoteSubItem></HistoricalNote></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2024-06-01" lims:fid="505906" lims:id="505906"><Label>10</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="505907" lims:id="505907"><Label>(1)</Label><Text lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1452076" lims:id="1455342">Subject to subsection (2), every elective participant must contribute to the Consolidated Revenue Fund $0.15 each month for every $1,000 of the basic benefit if the participant</Text><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505908" lims:id="1455343"><Label>(a)</Label><Text>on ceasing to be employed in the public service is entitled to an immediate annuity under Part I of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505909" lims:id="1455436"><Label>(b)</Label><Text>on ceasing to be employed in the public service after March 31, 1995 is entitled to and has opted for an annual allowance payable within thirty days after so ceasing;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505910" lims:id="505910"><Label>(c)</Label><Text>on ceasing to be required to contribute to the Retirement Compensation Arrangements Account by section 8 or 9 of the <XRefExternal reference-type="regulation">Retirement Compensation Arrangements Regulations, No. 1</XRefExternal> is entitled to an immediate annuity;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505911" lims:id="505911"><Label>(d)</Label><Text>on ceasing to be required to contribute to the Retirement Compensation Arrangements Account by section 8 or 9 of the <XRefExternal reference-type="regulation">Retirement Compensation Arrangements Regulations, No. 1</XRefExternal> is entitled to an immediate annual allowance; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505912" lims:id="505912"><Label>(e)</Label><Text>on March 31, 1995 was an elective participant and</Text><Subparagraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505913" lims:id="1455437"><Label>(i)</Label><Text>was receiving an annual allowance under Part I of the Act and had been receiving the annual allowance since a date not later than 30 days after ceasing to be employed in the public service, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505914" lims:id="1455438"><Label>(ii)</Label><Text>had been receiving an annual allowance under Part I of the Act since a date not later than 30 days after ceasing to be employed in the public service but, on March 31, 1995, was entitled to an immediate annuity under that Part.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="505915" lims:id="505915"><Label>(2)</Label><Text>The contribution required under subsection (1) is reduced by $1.50 per month, in respect of a participant who is 65 years of age or older and who</Text><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505916" lims:id="1455439"><Label>(a)</Label><Text>on ceasing to be employed in the public service is entitled to an immediate annuity under Part I of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505917" lims:id="505917"><Label>(b)</Label><Text>is a person who is entitled to an immediate annual allowance; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505918" lims:id="505918"><Label>(c)</Label><Text>on ceasing to be required to contribute to the Retirement Compensation Arrangements Account by section 8 or 9 of the <XRefExternal reference-type="regulation">Retirement Compensation Arrangements Regulations, No. 1</XRefExternal> is entitled to an immediate annuity.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="505919" lims:id="505919"><Label>(3)</Label><Text>The reduction referred to in subsection (2) is effective on the earlier of April 1st or October 1st after the day on which the participant attains 65 years of age.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem 25(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2024-06-01" lims:fid="505922" lims:id="505922"><Label>11</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="505923" lims:id="505923"><Label>(1)</Label><Text lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1452077" lims:id="1455345">Subject to section 12, every elective participant, other than an elective participant referred to in subsection 10(1), must contribute to the Consolidated Revenue Fund each year, in advance, for every $2,000 of the basic benefit of the participant</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505924" lims:id="505924"><Label>(a)</Label><Text>during any period in which neither an annuity under Part I of the Act or under the <XRefExternal reference-type="act" link="C-17">Canadian Forces Superannuation Act</XRefExternal> nor a pension under the <XRefExternal reference-type="act" link="D-1.3">Defence Services Pension Continuation Act</XRefExternal> is being paid to the participant, the amount set out in Part I of Schedule I; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505925" lims:id="505925"><Label>(b)</Label><Text>during any period in which an annuity or a pension is being paid to the participant under the Part or an Act referred to in paragraph (a), 12 times the amount set out in Part II of Schedule I.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="505926" lims:id="505926"><Label>(1.1) and (2)</Label><Text><Repealed>[Repealed, SOR/99-378, s. 3]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="505927" lims:id="505927"><Label>(2.1)</Label><Text lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1452078" lims:id="1455346">Subject to section 12, a participant referred to in subsection (1) must pay</Text><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505928" lims:id="1455441"><Label>(a)</Label><Text>the first contribution on or before the thirtieth day after the day on which the participant ceased or ceases to be employed in the public service; and</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505929" lims:id="1455442"><Label>(b)</Label><Text>subsequent such contributions each year on or before the thirtieth day after the anniversary of the day on which the participant ceased or ceases to be employed in the public service.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505930" lims:id="1455347"><Label>(3)</Label><Text>If an elective participant does not pay their annual contribution in accordance with subsection (2.1) because they received erroneous or misleading information as to their obligations under the Act from a person employed in the public service whose ordinary duties include giving advice about the application of the Act, the participant must pay their annual contribution within three months after the day on which they receive a notice with the correct information; however, the due date of each annual contribution after that contribution remains as set out in paragraph (2.1)(b).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="505932" paragraphs (b) to (e), on the day after the last day for which they receive pay for their employment in the public service;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505984" lims:id="1455379"><Label>(b)</Label><Text>in the case of a participant who dies, on the day after the day of their death;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505985" lims:id="505985"><Label>(c)</Label><Text>in the case of a participant who is on authorized leave of absence without pay, on the earlier of</Text><Subparagraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505986" lims:id="1455380"><Label>(i)</Label><Text>the day after the day on which their deputy head advises the Minister in writing that the participant has ceased to be employed in the public service, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505987" lims:id="1455381"><Label>(ii)</Label><Text>the day on which, under any other Act of Parliament governing employment outside the public service, the participant becomes a contributor to any other superannuation or pension fund or plan;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505988" lims:id="1455382"><Label>(d)</Label><Text>in the case of a participant who is on unauthorized leave of absence without pay, on the day after the day on which their deputy head advises the Minister in writing that the participant has ceased to be employed in the public service;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505989" lims:id="1455383"><Label>(e)</Label><Text>in the case of a participant who is under suspension under any Act of Parliament, on the day on which they cease to be employed in the public service as certified by their deputy head; or</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="505990" lims:id="1455384"><Label>(f)</Label><Text>in the case of a participant who ceases to be required to contribute under Part I of the Act by reason of becoming a person described in paragraph 5(1)(g) or (h) or subsection 5.1(1) of the Act, on the day after the last day on which they are required to contribute.</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="505991" in which they are or were employed advises the Minister in writing that the participant will cease or has ceased to be employed on a day earlier than that first day.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="505998" lims:id="505998"><Label>(2)</Label><Text>Subsection (1) does not apply to a sessional employee in respect of a special or emergency session of Parliament at which the employee is not required to perform any services.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:id="506014"><Label>(3)</Label><Text>No benefit shall be paid upon the death of a participant to any person purporting to be the widow of the participant until proof of marital status has been established in accordance with section 49 of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1358">Public Service Superannuation Regulations</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="506015" lims:id="506015"><Label>(4)</Label><Text>Subject to subsection 25(4) of the Act, if within one year after the death of a contributor the person claiming to be the widow of a contributor cannot prove that she is his widow, in the manner prescribed by subsection (1) of this section, the contributor shall, for the purposes of the Act, be deemed to have died without leaving a widow.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:id="1455414"><Label>(1)</Label><Text>A participant may, for the purposes of Part II of the Act, name up to five beneficiaries.</Text></Subsection><Subsection lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455415" lims:id="1455415"><Label>(2)</Label><Text>For the purposes of Part II of the Act, a beneficiary may be any of the following:</Text><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455416" lims:id="1455416"><Label>(a)</Label><Text>the estate or succession of the participant;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455417" lims:id="1455417"><Label>(b)</Label><Text>an individual;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455418" lims:id="1455418"><Label>(c)</Label><Text>a <DefinitionRef>registered charity</DefinitionRef>, as defined in subsection 248(1) of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455419" lims:id="1455419"><Label>(3)</Label><Text>In order to name a beneficiary, the following information must be submitted in writing to the Minister and be accompanied by an attestation that is dated and signed by the participant and that confirms that the information is complete and accurate:</Text><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455420" lims:id="1455420"><Label>(a)</Label><Text>the full name of the participant, their date of birth and either their personal record identifier or their pension number;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455421" lims:id="1455421"><Label>(b)</Label><Text>if the participant is naming their estate or succession, a reference to that effect;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455422" lims:id="1455422"><Label>(c)</Label><Text>if the participant is naming an individual, the full name of the individual and their date of birth; and</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455423" lims:id="1455423"><Label>(d)</Label><Text>if the participant is naming a registered charity, its name and registration number with the Canada Revenue Agency.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455424" lims:id="1455424"><Label>(4)</Label><Text>The naming is effective on the day on which the participant signs the attestation if it is received by the Minister before the death of the participant.</Text></Subsection><Subsection lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455425" lims:id="1455425"><Label>(5)</Label><Text>In cases where the attestation is not received by the Minister before the death of the participant, the naming is effective on the day on which the participant signs the attestation if</Text><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455426" lims:id="1455426"><Label>(a)</Label><Text>the receipt of the attestation by the Minister was delayed for reasons beyond the control of the participant; and</Text></Paragraph><Paragraph lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455427" lims:id="1455427"><Label>(b)</Label><Text>the attestation is received before the payment of any benefit under Part II of the Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455428" lims:id="1455428"><Label>(6)</Label><Text>If a participant has named more than one beneficiary and the information submitted with respect to one of those beneficiaries is illegible or incomplete, or does not refer to the estate or succession of the participant, an individual or a <DefinitionRef>registered charity</DefinitionRef>, as defined in subsection 248(1) of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>, the validity of the naming with respect to the other beneficiaries will not be affected.</Text></Subsection><Subsection lims:inforce-start-date="2024-06-01" lims:enacted-date="2024-05-09" lims:fid="1455429"
