﻿<?xml version="1.0" encoding="utf-8"?><Regulation lims:pit-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:current-date="2019-06-21" lims:inforce-start-date="2006-03-22" lims:fid="536675" lims:id="536675" regulation-type="SOR" xml:lang="en" xmlns:lims="http://justice.gc.ca/lims"><Identification lims:inforce-start-date="2006-03-22" lims:fid="536676" lims:id="536676"><InstrumentNumber>C.R.C., c. 212</InstrumentNumber><ConsolidationDate lims:inforce-start-date="2006-03-22"><Date><YYYY>2019</YYYY><MM>6</MM><DD>22</DD></Date></ConsolidationDate><EnablingAuthority lims:inforce-start-date="2006-03-22" lims:fid="536678" lims:id="536678"><XRefExternal reference-type="act" link="A-6">AGRICULTURAL PRODUCTS MARKETING ACT</XRefExternal></EnablingAuthority><ShortTitle lims:inforce-start-date="2006-03-22" lims:fid="536679" lims:id="536679">Ontario Greenhouse Vegetable Handling (Interprovincial and Export) Regulations</ShortTitle><LongTitle lims:inforce-start-date="2006-03-22" lims:fid="536680" lims:id="536680">Regulations Respecting the Handling and Shipping in Interprovincial and Export Trade of Greenhouse Vegetables Produced in Ontario</LongTitle></Identification><Body lims:inforce-start-date="2006-03-22" lims:fid="536681" lims:id="536681"><Heading lims:inforce-start-date="2006-03-22" lims:fid="536682" lims:id="536682" level="1"><TitleText>Short Title</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="536683" lims:id="536683"><Label>1</Label><Text>These Regulations may be cited as the <XRefExternal reference-type="regulation">Ontario Greenhouse Vegetable Handling (Interprovincial and Export) Regulations.</XRefExternal></Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="536684" lims:id="536684" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="536685" lims:id="536685"><Label>2</Label><Text>In these Regulations,</Text><Definition lims:inforce-start-date="2006-03-22" lims:fid="536686" lims:id="536686" generate-in-text="no"><Text><DefinedTermEn>Commodity Board</DefinedTermEn> means The Ontario Greenhouse Vegetable Producers’ Marketing Board; (<DefinedTermFr>Office de commercialisation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="536687" lims:id="536687" generate-in-text="no"><Text><DefinedTermEn>greenhouse vegetables</DefinedTermEn> means tomatoes, cucumbers and lettuce produced in the Province of Ontario in a greenhouse or any other enclosure under glass, plastic or other material used for the purpose of controlling temperature and providing protection for growing plants; (<DefinedTermFr>légumes de serre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="536688" lims:id="536688" generate-in-text="no"><Text><DefinedTermEn>producer</DefinedTermEn> means a person engaged in the production of greenhouse vegetables; (<DefinedTermFr>producteur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="536689" lims:id="536689" generate-in-text="no"><Text><DefinedTermEn>product</DefinedTermEn> means any quantity of greenhouse vegetables; (<DefinedTermFr>produit</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="536690" lims:id="536690" generate-in-text="no"><Text><DefinedTermEn>shipper</DefinedTermEn> means any person who offers for sale, sells, receives, assembles, packs, ships for sale or transports a product but does not include</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="536691" lims:id="536691"><Label>(a)</Label><Text>a servant employed by and driving a vehicle owned by a producer or a shipper,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="536692" lims:id="536692"><Label>(b)</Label><Text>a railway company, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="536693" lims:id="536693"><Label>(c)</Label><Text>a person who transports the product by motor vehicle as agent of the producer. (<DefinedTermFr>expéditeur</DefinedTermFr>)</Text></Paragraph></Definition></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="536694" lims:id="536694" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="536695" lims:id="536695"><Label>3</Label><Text>These Regulations apply only to the marketing of a product in interprovincial and export trade and to persons and property situated in the Province of Ontario.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="536696" lims:id="536696" level="1"><TitleText>Handling</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="536697" lims:id="536697"><Label>4</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="536698" lims:id="536698"><Label>(1)</Label><Text>No producer shall deliver to a shipper a product that does not comply with the grades established by the <XRefExternal reference-type="act">Canada Agricultural Products Standards Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="536699" lims:id="536699"><Label>(2)</Label><Text>No shipper shall accept delivery of a product that does not comply with the grades established by the <XRefExternal reference-type="act">Canada Agricultural Products Standards Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="536700" lims:id="536700"><Label>(3)</Label><Text>Every person packing a product shall mark all containers as required by the <XRefExternal reference-type="act">Farm Products Grades and Sales Act</XRefExternal> of Ontario and the regulations made thereunder.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="536701" lims:id="536701"><Label>5</Label><Text>Every shipper shall be responsible for making an inspection of a product received by him to insure that the product complies with the provisions of section 4.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="536702" lims:id="536702" level="1"><TitleText>Cooling</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="536703" lims:id="536703"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="536704" lims:id="536704"><Label>(1)</Label><Text>Every shipper shall cool a product received by him and not shipped on the day of receipt to a temperature between 13 and 18 degrees Celsius within 12 hours of receipt of the product.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="536705" lims:id="536705"><Label>(2)</Label><Text>Every shipper shipping a product in a railway car shall load the product in accordance with the loading and refrigeration instructions recommended by the railway company and required for the safe arrival of the product at its destination.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="536706" lims:id="536706"><Label>(3)</Label><Text>Every shipper transporting or shipping a product by means of a motor vehicle to a destination beyond a radius of 100 miles shall keep such product at a temperature between 13 and 18 degrees Celsius until the safe arrival of the product at its destination.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="536707" lims:id="536707" level="1"><TitleText>Shipping</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="536708" lims:id="536708"><Label>7</Label><Text>Every shipper shall ship each variety of a product received by him in the order in which the variety is received.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="536709" lims:id="536709" level="1"><TitleText>Delivery</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="536710" lims:id="536710"><Label>8</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="536711" lims:id="536711"><Label>(1)</Label><Text>Every shipper shall, upon the written direction of the Commodity Board, deliver to any other shipper designated in that direction such quantity of the product in his possession at the time he receives the direction as is specified in the direction.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="536712" lims:id="536712"><Label>(2)</Label><Text>Where a product is delivered by a shipper to another shipper pursuant to the direction set out in subsection (1), the shipper’s remuneration shall be divided between the shipper who delivered the product and the shipper who received the product as determined by the Commodity Board.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="536713" lims:id="536713" level="1"><TitleText>Inspection</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="536714" lims:id="536714"><Label>9</Label><Text>The platform and storage facilities of every shipper and the records of every shipment of a product shall be available for inspection by authorized representatives of the Commodity Board during normal business hours.</Text></Section></Body></Regulation>
