1978-79, c. 13, s. 13</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="177840" lims:id="177840"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="177841" lims:id="177841">Deputy head</MarginalNote><Label>3</Label><Text>The Governor in Council may appoint an officer called the Deputy Minister of the Environment to hold office during pleasure and to be the deputy head of the Department.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="177843" lims:id="177843">R.S., c. 14(2nd Supp.), s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="177844" lims:id="177844" level="1"><TitleText>Powers, Duties and Functions of the Minister</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="177845" lims:id="177845"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="177846" lims:id="177846">Powers, duties and functions of Minister</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="177847" lims:id="177847"><Label>(1)</Label><Text>The powers, duties and functions of the Minister extend to and include all matters over which Parliament has jurisdiction, not by law assigned to any other department, board or agency of the Government of Canada, relating to</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="177848" lims:id="177848"><Label>(a)</Label><Text>the preservation and enhancement of the quality of the natural environment, including water, air and soil quality;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="177849" lims:id="177849"><Label>(b)</Label><Text>renewable resources, including migratory birds and other non-domestic flora and fauna;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="177850" lims:id="177850"><Label>(c)</Label><Text>water;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="177851" lims:id="177851"><Label>(d)</Label><Text>meteorology;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="177852" lims:id="177852"><Label>(e)</Label><Text>notwithstanding paragraph 4(2)(g) of the <XRefExternal reference-type="act" link="H-3.2">Department of Health Act</XRefExternal>, the enforcement of any rules or regulations made by the International Joint Commission, promulgated pursuant to the treaty between the United States of America and His Majesty, King Edward VII, relating to boundary waters and questions arising between the United States and Canada, in so far as they relate to the preservation and enhancement of the quality of the natural environment; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="177853" lims:id="177853"><Label>(f)</Label><Text>the coordination of the policies and programs of the Government of Canada respecting the preservation and enhancement of the quality of the natural environment.</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="177854" lims:id="177854"><Label>(g) and (h)</Label><Text><Repealed>[Repealed, 1995, c. 11, s. 18]</Repealed></Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="177855" lims:id="177855"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="177856" lims:id="177856">Idem</MarginalNote><Label>(2)</Label><Text>The powers, duties and functions of the Minister also extend to and include such other matters, relating to the environment and over which Parliament has jurisdiction, as are by law assigned to the Minister.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="177858" lims:id="177858">R.S., 1985, c. E-10, s. 4; 1995, c. 11, s. 18; 1996, c. 8, s. 19</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="177859" lims:id="177859"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="177860" lims:id="177860">Idem re preservation and enhancement of environmental quality</MarginalNote><Label>5</Label><Text>The Minister, in exercising his powers and carrying out his duties and functions under section 4, shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="177861" lims:id="177861"><Label>(a)</Label><Text>initiate, recommend and undertake programs, and coordinate programs of the Government of Canada that are designed</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="177862" lims:id="177862"><Label>(i)</Label><Text>to promote the establishment or adoption of objectives or standards relating to environmental quality, or to control pollution,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="177863" lims:id="177863"><Label>(ii)</Label><Text>to ensure that new federal projects, programs and activities are assessed early in the planning process for potential adverse effects on the quality of the natural environment and that a further review is carried out of those projects, programs, and activities that are found to have probable significant adverse effects, and the results thereof taken into account, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="177864" lims:id="177864"><Label>(iii)</Label><Text>to provide to Canadians environmental information in the public interest;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="177865" lims:id="177865"><Label>(b)</Label><Text>promote and encourage the institution of practices and conduct leading to the better preservation and enhancement of environmental quality, and cooperate with provincial governments or agencies thereof, or any bodies, organizations or persons, in any programs having similar objects; 1978-79, c. 13, s. 14</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="177869" lims:id="177869" level="1"><TitleText>Guidelines by Order</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="177870" lims:id="177870"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="177871" lims:id="177871">Guidelines related to environmental quality</MarginalNote><Label>6</Label><Text>For the purposes of carrying out his duties and functions related to environmental quality, the Minister may, by order, with the approval of the Governor in Council, establish guidelines for use by departments, boards and agencies of the Government of Canada and, where appropriate, by corporations named in Schedule III to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal> and regulatory bodies in the exercise of their powers and the carrying out of their duties and functions.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="177873" lims:id="177873">R.S., c. 14(2nd Supp.), s. 6;
