lims:id="238801">Preamble</MarginalNote><Text>WHEREAS all Canadians are entitled to access to federal legislation in keeping with the common law and civil law traditions;</Text></Provision><Provision lims:inforce-start-date="2012-12-14" lims:fid="238802" lims:id="238802" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS the civil law tradition of the Province of Quebec, which finds its principal expression in the <XRefExternal reference-type="other">Civil Code of Québec</XRefExternal>, reflects the unique character of Quebec society;</Text></Provision><Provision lims:inforce-start-date="2012-12-14" lims:fid="238803" lims:id="238803" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS the harmonious interaction of federal legislation and provincial legislation is essential and lies in an interpretation of federal legislation that is compatible with the common law or civil law traditions, as the case may be;</Text></Provision><Provision lims:inforce-start-date="2012-12-14" lims:fid="238804" lims:id="238804" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS the full development of our two major legal traditions gives Canadians enhanced opportunities worldwide and facilitates exchanges with the vast majority of other countries;</Text></Provision><Provision lims:inforce-start-date="2012-12-14" lims:fid="238805" lims:id="238805" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS the provincial law, in relation to property and civil rights, is the law that completes federal legislation when applied in a province, unless otherwise provided by law;</Text></Provision><Provision lims:inforce-start-date="2012-12-14" lims:fid="238806" lims:id="238806" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS the objective of the Government of Canada is to facilitate access to federal legislation that takes into account the common law and civil law traditions, in its English and French versions;</Text></Provision><Provision lims:inforce-start-date="2012-12-14" lims:fid="238807" lims:id="238807" format-ref="indent-0-0" language-align="no" list-item="no"><Text>AND WHEREAS the Government of Canada has established a harmonization program of federal legislation with the civil law of the Province of Quebec to ensure that each language version takes into account the common law and civil law traditions;</Text></Provision></Preamble><Enacts lims:inforce-start-date="2012-12-14" lims:fid="238808" lims:id="238808"><Provision lims:inforce-start-date="2012-12-14" lims:fid="238809" lims:id="238809" language-align="no" format-ref="indent-0-0" list-item="no"><Text>NOW, THEREFORE, Her Majesty, by and <XRefExternal reference-type="act">Civil Code of Lower Canada</XRefExternal>, adopted by chapter 41 of the Acts of 1865 of the legislature of the Province of Canada, entitled <XRefExternal reference-type="act">An Act respecting the Civil Code of Lower Canada</XRefExternal>, are repealed in so far as they relate to subjects that fall within the legislative competence of Parliament and
