H-4, s. 2; 1995, c. 11, s. 23; 2005, c. 2, s. 11</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="254793" lims:id="254793" level="1"><TitleText>Commemoration of Historic Sites</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="254794" lims:id="254794"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="254795" lims:id="254795">Powers of Minister</MarginalNote><Label>3</Label><Text>The Minister may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="254796" lims:id="254796"><Label>(a)</Label><Text>by means of plaques or other signs or in any other suitable manner mark or otherwise commemorate historic places;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="254797" lims:id="254797"><Label>(b)</Label><Text>make agreements with any persons for marking or commemorating historic places pursuant to this Act and for the care and preservation of any places so marked or commemorated;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="254798" lims:id="254798"><Label>(c)</Label><Text>with the approval of the Governor in Council, establish historic museums;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="254799" lims:id="254799"><Label>(d)</Label><Text>with the approval of the Treasury Board, acquire on behalf of Her Majesty in right of Canada any historic places, or lands for historic museums, or any interest therein, by purchase, lease or otherwise; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="254800" lims:id="254800"><Label>(e)</Label><Text>provide for the administration, preservation and maintenance of any historic places acquired or historic museums established pursuant to this Act.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="254802" lims:id="254802">R.S., c. H-6, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="254803" lims:id="254803" level="1"><TitleText>Historic Sites and Monuments Board of Canada</TitleText></Heading><Section lims:inforce-start-date="2013-12-12" lims:lastAmendedDate="2013-12-12" lims:fid="254804" lims:id="254804"><MarginalNote lims:inforce-start-date="2013-12-12" lims:fid="254805" lims:id="254805">Board established</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2013-12-12" lims:fid="254806" lims:id="254806"><Label>(1)</Label><Text>There is established a Board, to be called the Historic Sites and Monuments Board of Canada, consisting of 16 members as follows:</Text><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="254807" lims:id="254807"><Label>(a)</Label><Text>the Librarian and Archivist of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="254808" lims:id="254808"><Label>(b)</Label><Text>an officer of the Canadian Museum of History designated by the member of the Queen’s Privy Council for Canada who is designated by the Governor in Council under the <XRefExternal reference-type="act" link="M-13.4">Museums Act</XRefExternal> as the Minister responsible for that Museum;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="254809" lims:id="254809"><Label>(c)</Label><Text>an officer of the Parks Canada Agency designated by the Minister; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="254810" lims:id="254810"><Label>(d)</Label><Text>one representative for each province or territory, to be appointed by the Governor in Council.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="254811" lims:id="254811"><MarginalNote lims:inforce-start-date="2013-12-12" lims:fid="254812" lims:id="254812">Eligibility of appointed members</MarginalNote><Label>(2)</Label><Text>A person is not eligible to be appointed or to continue as a representative for a province or a territory, unless that person resides in that province or territory.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="254813" lims:id="254813"><MarginalNote lims:inforce-start-date="2013-12-12" lims:fid="254814" lims:id="254814">Tenure of office</MarginalNote><Label>(3)</Label><Text>A member appointed by the Governor in Council holds office during pleasure for such period not exceeding five years as may be fixed by the Governor in Council.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="254815" lims:id="254815"><MarginalNote lims:inforce-start-date="2013-12-12" lims:fid="254816" lims:id="254816">Re-appointment</MarginalNote><Label>(4)</Label><Text>A retiring member of the Board is eligible for re-appointment.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-12-12" lims:fid="254818" lims:id="254818">R.S., 1985, c. H-4, s. 5; 2010, c. 12, s. 1741</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="254830" lims:id="254830"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="254831" lims:id="254831">Secretary</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="254832" lims:id="254832"><Label>(1)</Label><Text>The Minister may designate an officer or employee of the Parks Canada Agency established under the <XRefExternal reference-type="act" link="P-0.4">Parks Canada Agency Act</XRefExternal> to be the Secretary of the Board, or appoint a Secretary of the Board at the remuneration and under the terms or conditions of employment that may be prescribed by the Governor in Council.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="254833" lims:id="254833"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="254834" lims:id="254834">Other staff</MarginalNote><Label>(2)</Label><Text>The Minister may, from among the persons employed in the Parks Canada Agency, provide the Board with any other employees or assistants that are necessary for the proper conduct of the business of the Board.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="254836" lims:id="254836">R.S., 1985, c. H-4, s. 6; 1995, c. 11, s. 25(E); 1998, c. 31, s. 51</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="254837" lims:id="254837"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="254838" lims:id="254838">Powers and duties of Board</MarginalNote><Label>7</Label><Text>The Board may receive and consider recommendations respecting the marking or commemoration of historic places, the establishment of historic museums and the administration, preservation and maintenance of historic places and historic museums, and shall advise the Minister in carrying out his powers under this Act.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="254840" lims:id="254840">R.S., c. H-6, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="254841" lims:id="254841"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="254842" lims:id="254842">Travel and living expenses</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="254843" lims:id="254843"><Label>(1)</Label><Text>Each member of the Board appointed by the Governor in Council may be paid</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="254844" lims:id="254844"><Label>(a)</Label><Text>for each day the member is necessarily absent from his ordinary place of residence for the purpose of attending at meetings or to other business of the Board, such remuneration as is fixed by the Governor in Council; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="254845" lims:id="254845"><Label>(b)</Label><Text>actual travel expenses necessarily incurred in connection with the business of the Board.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="254846" lims:id="254846"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="254847" lims:id="254847">Idem</MarginalNote><Label>(2)</Label><Text>Members of the Board other than those appointed by the Governor in Council are entitled to be paid actual travel and living expenses necessarily incurred in connection with the business of the Board.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="254848" lims:id="254848"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="254849" lims:id="254849">Clerical and stenographic assistance</MarginalNote><Label>(3)</Label><Text>There may be paid for clerical and stenographic assistance</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="254850" lims:id="254850"><Label>(a)</Label><Text>the sum of seventy-five dollars per year to the Chairman of the Board; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="254851" lims:id="254851"><Label>(b)</Label><Text>the sum of thirty dollars per year to the other members of the Board appointed by the Governor in Council.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="254853" lims:id="254853">R.S., c.
