lims:inforce-start-date="2018-03-01" lims:fid="353315" lims:id="353315">Definitions</MarginalNote><Label>2</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2018-03-01" lims:fid="353316" lims:id="353316"><Text><DefinedTermEn>company</DefinedTermEn> means a person</Text><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353317" lims:id="353317"><Label>(a)</Label><Text>who is engaged in the business of manufacturing vehicles or equipment in Canada,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353318" lims:id="353318"><Label>(b)</Label><Text>who is engaged in the business of selling to other persons, for the purpose of resale by those persons, vehicles or equipment obtained directly from a person described in paragraph (a) or the agent of such a person, or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353319" lims:id="353319"><Label>(c)</Label><Text>who imports a vehicle or article of equipment into Canada for the purpose of sale; (<DefinedTermFr>entreprise</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-03-01" lims:fid="353320" lims:id="353320"><Text><DefinedTermEn>equipment</DefinedTermEn> means any equipment set out in Schedule I that is designed for use in or on a vehicle; (<DefinedTermFr>équipement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-03-01" lims:fid="353321" lims:id="353321"><Text><DefinedTermEn>inspector</DefinedTermEn> means a person designated as an automotive inspector pursuant to section 14; (<DefinedTermFr>inspecteur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-03-01" lims:fid="353322" lims:id="353322"><Text><DefinedTermEn>manufacture</DefinedTermEn>, in relation to a vehicle, includes any process of assembling or altering the vehicle prior to its sale to the first retail purchaser; (<DefinedTermFr>fabrication</DefinedTermFr> ou <DefinedTermFr>construction</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-03-01" lims:fid="353323" lims:id="353323"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Transport; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2020-02-04" lims:enacted-date="2014-06-19" lims:fid="353324" lims:id="1226023"><Text><DefinedTermEn>national safety mark</DefinedTermEn> means a prescribed expression, symbol or abbreviation or any combination of them; (<DefinedTermFr>marque nationale de sécurité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-03-01" lims:fid="353325" lims:id="353325"><Text><DefinedTermEn>prescribed</DefinedTermEn> means prescribed by lims:id="353326"><Text><DefinedTermEn>sell</DefinedTermEn> includes to offer for sale or lease, have in possession for sale or lease or deliver for sale or lease; (<DefinedTermFr>vente</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2020-02-04" lims:enacted-date="2014-06-19" lims:fid="353327" lims:id="1226024"><Text><DefinedTermEn>standard</DefinedTermEn> means a standard that governs the design, manufacture, functioning or marking of vehicles or equipment for the purpose of reducing, directly or indirectly, the risk of death, injury or property damage from vehicle use, including a standard aimed at increasing the use of safety features by the public or facilitating the creation, recording or retrieval of information; (<DefinedTermFr>norme</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-03-01" lims:fid="353328" lims:id="353328"><Text><DefinedTermEn>Tribunal</DefinedTermEn> means the Transportation Appeal Tribunal of Canada established by subsection 2(1) of the <XRefExternal reference-type="act" link="T-18.5">Transportation Appeal Tribunal of Canada Act</XRefExternal>; (<DefinedTermFr>Tribunal</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2020-02-04" lims:enacted-date="2014-06-19" lims:fid="353329" lims:id="1226025"><Text><DefinedTermEn>vehicle</DefinedTermEn> means any vehicle that is designed to be, or is capable of being, driven or drawn on roads by any means other than muscular power exclusively, but does not include any vehicle that is designed to run exclusively on person</MarginalNote><Label>2.3</Label><Text>A company designated by the Minister that applies a national safety mark to any vehicle or equipment, sells any vehicle or equipment to which a national safety mark has been applied or imports into Canada any vehicle or equipment of a class for which standards are prescribed is required to provide the Minister, for a purpose related to verifying compliance with this Act, with the contact information for a person for the purpose of correspondence.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-03-01" lims:fid="353346" lims:id="353346">2018, c. 2, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2018-03-01" lims:fid="353347" lims:id="353347" level="1"><TitleText>National Safety Marks</TitleText></Heading><Section lims:inforce-start-date="2014-06-19" lims:lastAmendedDate="2019-06-17" lims:fid="353348" lims:id="353348"><MarginalNote lims:inforce-start-date="2019-06-17" lims:enacted-date="2014-06-19" lims:fid="353349" lims:id="1145580">National trademarks</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2019-06-17" lims:enacted-date="2014-06-19" lims:fid="353350" lims:id="1145579"><Label>(1)</Label><Text>The national safety marks are hereby declared to be national trademarks and, except as provided in this Act, the exclusive property in and right to the use of those marks are vested in Her Majesty in right of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353351" lims:id="353351"><MarginalNote lims:inforce-start-date="2014-06-19" lims:fid="353352" lims:id="353352">Use of marks</MarginalNote><Label>(2)</Label><Text>A company authorized by the Minister, as provided for in the regulations, may apply a national safety mark to a vehicle or equipment, as provided for in the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353353" lims:id="353353"><MarginalNote lims:inforce-start-date="2014-06-19" lims:fid="353354" lims:id="353354">Provision of address</MarginalNote><Label>(2.1)</Label><Text>The company shall provide the Minister with the address of the premises at which the national safety mark is to be applied.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353355" lims:id="353355"><MarginalNote lims:inforce-start-date="2014-06-19" lims:fid="353356" lims:id="353356">Prohibition</MarginalNote><Label>(3)</Label><Text>No person shall use a national safety mark except as authorized by this Act.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353357" lims:id="353357"><MarginalNote lims:inforce-start-date="2014-06-19" lims:fid="353358" lims:id="353358">Confusing marks</MarginalNote><Label>(4)</Label><Text>No person shall use a mark other than a national safety mark in such a manner that it is likely to be mistaken for a national safety mark.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-06-17" lims:enacted-date="2014-06-19" lims:fid="1145582" lims:id="1145582" lims:enactId="1034903">1993, c. 16, s. 3; 2014, c. 20, ss. 214, 366(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="353361" lims:id="353361"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="353362" lims:id="353362">Interprovincial shipments</MarginalNote><Label>4</Label><Text>Except as otherwise provided by the regulations, no company shall ship from one province to another, or deliver to any person for the purpose of being so shipped, any vehicle or equipment of a prescribed class manufactured in Canada unless it has a national safety mark applied to it in accordance with section 3.</Text></Section><Heading lims:inforce-start-date="2018-03-01" lims:fid="353363" lims:id="353363" level="1"><TitleText>Vehicle and Equipment Requirements</TitleText></Heading><Section lims:inforce-start-date="2014-06-19" lims:lastAmendedDate="2014-06-19" lims:fid="353364" lims:id="353364"><MarginalNote lims:inforce-start-date="2014-06-19" lims:fid="353365" lims:id="353365">Compliance by companies</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353366" lims:id="353366"><Label>(1)</Label><Text>No company shall apply a national safety mark to any vehicle or equipment, sell any vehicle or equipment to which a national safety mark has been applied, or import into Canada any vehicle or equipment of a prescribed class unless</Text><Paragraph lims:inforce-start-date="2014-06-19" lims:fid="353367" lims:id="353367"><Label>(a)</Label><Text>the vehicle or equipment conforms to the standards prescribed for vehicles or equipment of its class at the time the main assembly of the vehicle was completed or the equipment was manufactured;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-19" lims:fid="353368" lims:id="353368"><Label>(b)</Label><Text>evidence of that conformity has been obtained and produced as provided for in the regulations or, if the regulations so provide, to the Minister’s satisfaction;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-19" lims:fid="353369" lims:id="353369"><Label>(c)</Label><Text><Repealed>[Repealed, 1999, c. 33, s. 351]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-19" lims:fid="353370" lims:id="353370"><Label>(d)</Label><Text>prescribed information is marked on the vehicle or equipment as provided for in the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-19" lims:fid="353371" lims:id="353371"><Label>(e)</Label><Text>prescribed documentation or prescribed accessories accompany the vehicle or equipment as provided for in the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-19" lims:fid="353372" lims:id="353372"><Label>(f)</Label><Text>prescribed information relating to the operation of the vehicle or equipment is disseminated as provided for in the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-19" lims:fid="353373" lims:id="353373"><Label>(g)</Label><Text>records are maintained and furnished, as provided for in the regulations, in relation to the design, manufacture, testing and field performance of the vehicle or equipment, for the purpose of</Text><Subparagraph lims:inforce-start-date="2014-06-19" lims:fid="353374" lims:id="353374"><Label>(i)</Label><Text>enabling an inspector to determine whether the vehicle or equipment conforms to all requirements applicable to it, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-06-19" lims:fid="353375" lims:id="353375"><Label>(ii)</Label><Text>facilitating the identification and analysis of defects referred to in subsection 10(1); and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-06-19" lims:fid="353376" lims:id="353376"><Label>(h)</Label><Text>in the case of equipment, the company maintains, as provided for in the regulations, a registration system by which any person who has purchased equipment manufactured, imported or sold by the company and who wishes to be identified may be so identified.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353377" lims:id="353377"><Label>(2)</Label><Text><Repealed>[Repealed, 2014, c. 20, s. 216]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353378" lims:id="353378"><MarginalNote lims:inforce-start-date="2014-06-19" lims:fid="353379" lims:id="353379">Time of compliance</MarginalNote><Label>(3)</Label><Text>Unless otherwise provided by the regulations, a company may apply a national safety mark to, or import into Canada, a vehicle that does not satisfy a requirement of subsection (1) if that requirement is satisfied before the vehicle leaves the possession or control of the company and before the vehicle is presented for registration under the laws of a province.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353380" lims:id="353380"><MarginalNote lims:inforce-start-date="2014-06-19" lims:fid="353381" lims:id="353381">Certification by foreign agency</MarginalNote><Label>(4)</Label><Text>Where the regulations so provide in relation to a prescribed standard that corresponds to a prescribed enactment of a foreign government, a vehicle shall be deemed to conform to the standard if a prescribed agency of that government has certified that the vehicle conforms to the enactment as applied by the agency, unless the Minister determines that the vehicle does not conform to that enactment as so applied.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-06-19" lims:fid="353383" lims:id="353383">1993, c. 16, s. 5; 1999, c. 33, s. 351; 2014, c. 20, s. 216</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="353384" lims:id="353384"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="353385" lims:id="353385">Compliance by all persons importing vehicles</MarginalNote><Label>6</Label><Text>No person shall import into Canada a vehicle of a prescribed class unless the requirements of paragraphs 5(1)(a), (b), (d) and (e) are satisfied in respect of the vehicle.</Text></Section><Section lims:inforce-start-date="2014-06-19" lims:lastAmendedDate="2020-02-04" lims:fid="353386" lims:id="353386"><MarginalNote lims:inforce-start-date="2014-06-19" lims:fid="353387" lims:id="353387">Exceptions for certain importations</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353388" lims:id="353388"><Label>(1)</Label><Text>Sections 5 and 6 do not apply in respect of the importation of a vehicle or equipment if</Text><Paragraph lims:inforce-start-date="2020-02-04" lims:enacted-date="2014-06-19" lims:fid="353389" lims:id="1226031"><Label>(a)</Label><Text>before the importation, the person importing the vehicle or equipment makes a declaration, as provided for in the regulations, that the vehicle or equipment</Text><Subparagraph lims:inforce-start-date="2020-02-04" lims:enacted-date="2014-06-19" lims:fid="1226032" lims:id="1226032"><Label>(i)</Label><Text>will be used in Canada solely for a prescribed purpose,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2020-02-04" lims:enacted-date="2014-06-19" lims:fid="1226033" lims:id="1226033"><Label>(ii)</Label><Text>will remain in Canada for a period of not more than one year or any other period that is specified by the Minister, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2020-02-04" lims:enacted-date="2014-06-19" lims:fid="1226034" lims:id="1226034"><Label>(iii)</Label><Text>meets or will meet any other prescribed requirement; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-06-19" lims:fid="353390" lims:id="353390"><Label>(b)</Label><Text>the vehicle or equipment is passing through Canada to another country or is exclusively for use by a visitor to Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2020-02-04" lims:enacted-date="2014-06-19" lims:fid="1226027" lims:id="1226027"><MarginalNote lims:inforce-start-date="2020-02-04" lims:enacted-date="2014-06-19" lims:fid="1226028" lims:id="1226028">Export or destruction</MarginalNote><Label>(1.01)</Label><Text>A person who imports a vehicle or equipment under paragraph (1)(a) shall, as provided for in the regulations, export or destroy the vehicle or equipment before the end of the period referred to in subparagraph (1)(a)(ii).</Text></Subsection><Subsection lims:inforce-start-date="2020-02-04" lims:enacted-date="2014-06-19" lims:fid="1226029" lims:id="1226029"><MarginalNote lims:inforce-start-date="2020-02-04" lims:enacted-date="2014-06-19" lims:fid="1226030" lims:id="1226030">Exception — donation</MarginalNote><Label>(1.02)</Label><Text>Despite subsection (1.01), a person who imports a vehicle under paragraph (1)(a) may, with the Minister’s approval, donate it as provided for in the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353391" lims:id="353391"><MarginalNote lims:inforce-start-date="2014-06-19" lims:fid="353392" lims:id="353392">Exception — temporary importation</MarginalNote><Label>(1.1)</Label><Text>Sections 5 and 6 do not apply to a resident of Canada who imports a vehicle that is licensed in the United States if the vehicle is rented in the United States from a vehicle rental business and is being imported into Canada for non-commercial purposes.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353393" lims:id="353393"><MarginalNote lims:inforce-start-date="2014-06-19" lims:fid="353394" lims:id="353394">Importer to remove vehicle from Canada</MarginalNote><Label>(1.2)</Label><Text>A resident of Canada who imports a vehicle under subsection (1.1) shall remove the vehicle from Canada within a period of 30 days, or any other prescribed period, beginning on the day on which the vehicle is imported.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353395" lims:id="353395"><MarginalNote lims:inforce-start-date="2014-06-19" lims:fid="353396" lims:id="353396">Rental business to remove vehicle from Canada</MarginalNote><Label>(1.3)</Label><Text>If, within the period referred to in subsection (1.2), the resident of Canada delivers the vehicle to a vehicle rental business in Canada with the consent of the business, then the vehicle rental business shall remove the vehicle from Canada before the end of that period.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353397" lims:id="353397"><MarginalNote lims:inforce-start-date="2014-06-19" lims:fid="353398" lims:id="353398">Subsection (1.2) does not apply</MarginalNote><Label>(1.4)</Label><Text>For greater certainty, if a vehicle rental business is required under subsection (1.3) to remove the vehicle from Canada, subsection (1.2) does not apply to the resident of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353399" 6 do not apply to the importation of a vehicle that has been sold at the retail level in the United States or that is a prescribed vehicle from Mexico if</Text><Paragraph lims:inforce-start-date="2020-02-04" lims:enacted-date="2014-06-19" lims:fid="1226037" lims:id="1226037"><Label>(a)</Label><Text>the vehicle meets any prescribed requirements; a declaration, as provided for in the regulations, that the vehicle will be, before being presented for registration by a province and within the prescribed period,</Text><Subparagraph and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2020-02-04" lims:enacted-date="2014-06-19" lims:fid="1226040" lims:id="1226040"><Label>(ii)</Label><Text>certified, as provided for in the regulations, as compliant with the requirements referred to in subparagraph (i) by the person designated in the regulations.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:fid="1226042" lims:id="1226042">Importation for components</MarginalNote><Label>(2.1)</Label><Text>Sections 5 and 6 do not apply to the importation of a vehicle that has been sold at the retail level in the United States or that is a prescribed vehicle from Mexico if the person importing the vehicle makes a declaration, as provided for in the regulations, that the vehicle</Text><Paragraph not conform to a standard prescribed for vehicles of its class at the time of its main assembly may be imported notwithstanding section 5 or 6 if, at the time of its importation, the standard is no application by a company as provided for in the regulations, the Minister may, by order, grant an exemption for a specified period, in accordance with any conditions specified in the order, for any model of vehicle manufactured or imported by the company from conformity with any prescribed standard if the exemption from that standard would, in the opinion of the Minister, promote the development of</Text><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353434" lims:id="353434"><Label>(a)</Label><Text>new safety features that are equivalent to or superior to those that conform to prescribed standards; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353435" lims:id="353435"><Label>(b)</Label><Text>new kinds of vehicles, technologies, vehicle systems or components.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-03-01" lims:fid="353436" lims:id="353436"><MarginalNote lims:inforce-start-date="2018-03-01" lims:fid="353437" lims:id="353437">Conditions for granting exemption</MarginalNote><Label>(2)</Label><Text>An exemption must only be granted for a model if the exemption would not substantially provided for in the regulations, give notice of any defect in the design, manufacture or functioning of the vehicle or equipment that affects or is likely to affect the safety of any person to</Text><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="353449" lims:id="353449"><Label>(a)</Label><Text>the Minister, on becoming aware of the defect; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="353450" lims:id="353450"><Label>(b)</Label><Text>the current owner and any other prescribed person, within the period provided for in the regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-05-15" lims:fid="353451" lims:id="353451"><MarginalNote lims:inforce-start-date="2015-05-15" lims:fid="353452" lims:id="353452">Notice already given</MarginalNote><Label>(2)</Label><Text>A company is not required to give notice of a defect</Text><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="353453" lims:id="353453"><Label>(a)</Label><Text>for which notice has already been given by another company that manufactured, sold or imported the vehicle or equipment; or</Text></Paragraph><Paragraph lims:id="353456">Subsequent notice</MarginalNote><Label>(2.1)</Label><Text>If the Minister determines that a defect has not been corrected in an adequate number of vehicles or equipment for which notice was given under subsection (1), the Minister may, by order, require the company to provide, in accordance with any conditions specified in the order, a subsequent notice to those persons who have not had the defect corrected. In making this determination, the Minister shall take into consideration, among other things,</Text><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="353457" lims:id="353457"><Label>(a)</Label><Text>the nature of the defect;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="353458" lims:id="353458"><Label>(b)</Label><Text>the safety risk arising from it; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="353459" lims:id="353459"><Label>(c)</Label><Text>the total number of vehicles or equipment affected.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-05-15" lims:fid="353460" lims:id="353460"><MarginalNote lims:inforce-start-date="2015-05-15" lims:fid="353461" lims:id="353461">Unknown owner</MarginalNote><Label>(3)</Label><Text>If the Minister is satisfied that the current owner of a vehicle or equipment cannot reasonably be determined by a company,</Text><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="353462" lims:id="353462"><Label>(a)</Label><Text>the company shall give notice in any other manner that is acceptable to the Minister; lims:inforce-start-date="2018-03-01" lims:fid="353561" lims:id="353561"><Label>(b)</Label><Text>notify the company of the preliminary determination, including the rationale on which it is based, and lims:id="353562"><Label>(c)</Label><Text>publish a notice of preliminary determination and invite any person to make comments in writing, within the time that the Minister specifies.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-03-01" lims:fid="353563" lims:id="353563"><MarginalNote lims:inforce-start-date="2018-03-01" lims:fid="353564" lims:id="353564">Final decision</MarginalNote><Label>(2)</Label><Text>The Minister shall not make a final decision that an order is necessary unless the Minister has taken into account information or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353636" lims:id="353636"><Label>(c)</Label><Text>any record referred to in paragraph 5(1)(g).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-03-01" lims:fid="353637" lims:id="353637"><MarginalNote lims:inforce-start-date="2018-03-01" lims:fid="353638" lims:id="353638">Entry by inspector</MarginalNote><Label>(2)</Label><Text>In carrying out their duties, an inspector and any person accompanying the inspector may enter on and pass through or over private property, other than a dwelling-house, without being liable for doing so and without any person having the right to object to that use of the property.</Text></Subsection><Subsection lims:inforce-start-date="2018-03-01" lims:fid="353639" lims:id="353639"><MarginalNote lims:inforce-start-date="2018-03-01" lims:fid="353640" lims:id="353640">Power to require attendance of persons</MarginalNote><Label>(3)</Label><Text>An inspector who enters a place may require the attendance of persons whom the inspector considers relevant to the carrying out of the inspector’s functions.</Text></Subsection><Subsection lims:inforce-start-date="2018-03-01" lims:fid="353641" lims:id="353641"><MarginalNote lims:inforce-start-date="2018-03-01" lims:fid="353642" lims:id="353642">Powers</MarginalNote><Label>(4)</Label><Text>The inspector may, for the purpose referred to in subsection (1),</Text><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353643" lims:id="353643"><Label>(a)</Label><Text>examine any vehicle, equipment or component that is in the place;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353644" lims:id="353644"><Label>(b)</Label><Text>open and examine any package or receptacle that the inspector believes contains any equipment or component referred to in that subsection;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353645" lims:id="353645"><Label>(c)</Label><Text>examine any document that is in the place, make copies of it or take extracts from it;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353646" lims:id="353646"><Label>(d)</Label><Text>disassemble and remove any constituent components;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353647" lims:id="353647"><Label>(e)</Label><Text>order the owner or person having possession, care or control of any vehicle or equipment to which this Act applies that is in the place to move it or, for any time that may be necessary, not to move it or to restrict its movement;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353648" lims:id="353648"><Label>(f)</Label><Text>use or cause to be used a computer or other device that is in the place to examine data that is contained in or available to a computer system or reproduce it or cause it to be reproduced in the form of a printout or other intelligible output and remove the output for examination or copying;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353649" lims:id="353649"><Label>(g)</Label><Text>use or cause to be used copying equipment that is in the place and remove the copies for examination;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353650" lims:id="353650"><Label>(h)</Label><Text>take photographs or make recordings or sketches; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353651" lims:id="353651"><Label>(i)</Label><Text>remove any vehicle, equipment or component from the place for the purpose of examination or conducting tests.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-03-01" lims:fid="353652" lims:id="353652"><MarginalNote lims:inforce-start-date="2018-03-01" lims:fid="353653" lims:id="353653">Assistance to inspector</MarginalNote><Label>(5)</Label><Text>Any person who owns or has charge of a place entered by an inspector under subsection (1) and every person present there shall answer all of the inspector’s reasonable questions related to the inspection, provide access to all electronic data that the inspector may reasonably require, provide all reasonable assistance in their power to enable the inspector to carry out his or her duties and furnish any information that the inspector reasonably requires for the purposes of the administration of this Act.</Text></Subsection><Subsection lims:inforce-start-date="2018-03-01" lims:fid="353654" lims:id="353654"><MarginalNote lims:inforce-start-date="2018-03-01" lims:fid="353655" lims:id="353655">Seizure of property</MarginalNote><Label>(6)</Label><Text>An inspector may seize and, subject to sections 489.1 to 491.2 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, detain any vehicle, equipment or component described in subsection (1)</Text><Paragraph lims:inforce-start-date="2018-03-01" lims:fid="353656" lims:id="353656"><Label>(a)</Label><Text>by means of which or in relation to which the inspector believes on reasonable grounds that this Act has been contravened; The consent agreement is deemed to be an order of the court and is enforceable in the same manner.</Text></Subsection><Subsection lims:inforce-start-date="2018-03-01" lims:fid="353678" lims:id="353678"><MarginalNote lims:inforce-start-date="2018-03-01" lims:fid="353679" lims:id="353679">Effect of registration</MarginalNote><Label>(4)</Label><Text>On registration of a consent agreement, any proceedings commenced in relation to a contravention that gave rise to the agreement are terminated and no further proceedings under this Act shall be taken against the corporation, company or individual with respect to the contravention.</Text></Subsection><Subsection lims:inforce-start-date="2018-03-01" lims:fid="353680" lims:id="353680"><MarginalNote lims:inforce-start-date="2018-03-01" lims:fid="353681" lims:id="353681">Amendment</MarginalNote><Label>(5)</Label><Text>The Minister and any party to the consent agreement may modify its terms at the request of either at any time and the amended agreement replaces the original agreement and must be filed and registered accordingly.</Text></Subsection><Subsection lims:id="353697">Continuing offence</MarginalNote><Label>(2.1)</Label><Text>An offence that is committed or continued on more than one day constitutes a separate offence for each day on which it is committed or continued.</Text></Subsection><Subsection lims:inforce-start-date="2018-03-01" lims:fid="353698" lims:id="353698"><MarginalNote lims:inforce-start-date="2018-03-01" lims:fid="353699" lims:id="353699">Defence where more than one manufacturer</MarginalNote><Label>(3)</Label><Text>In a prosecution for a contravention of section 4 or subsection 5(1) by a company engaged in the business of assembling or altering vehicles, it is a defence for the company to establish that the contravention occurred as a result of work previously done on a vehicle by another person engaged in the manufacture of the vehicle.</Text></Subsection><Subsection lims:inforce-start-date="2018-03-01" lims:fid="353700" lims:id="353700"><MarginalNote lims:inforce-start-date="2018-03-01" lims:fid="353701" lims:id="353701">Due diligence defence</MarginalNote><Label>(4)</Label><Text>In a prosecution for a contravention of section 16, a person is not to be found guilty of an offence lims:id="353706"><Label>(1)</Label><Text>In a prosecution under this Act, it is sufficient proof of an offence to establish that it was committed by an employee or agent of the accused whether or not the employee or agent is identified or has been prosecuted for the offence, unless the accused establishes that the offence was committed without the knowledge or consent of the accused and that the accused exercised all due diligence to prevent its commission.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="353707" lims:id="353707"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="353708" lims:id="353708">Time limit</MarginalNote><Label>(2)</Label><Text>A prosecution by way of summary conviction under this Act may not be instituted later than two years after the time when the subject-matter of the prosecution arose.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="353709" lims:id="353709"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="353710" lims:id="353710">Venue</MarginalNote><Label>(3)</Label><Text>A prosecution under this Act may be instituted, tried and determined by a court in any territorial jurisdiction in which the accused carries on business, regardless of where the subject-matter of the prosecution lims:id="353713"><Label>(1)</Label><Text>In a prosecution under this Act, evidence that a vehicle or equipment bore a name or mark purporting to be the name or mark of a company engaged in the business of manufacturing, importing or selling vehicles or equipment is, in the absence of evidence to the contrary, proof that the vehicle or equipment was manufactured, imported or sold, as the case may be, by that company.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="353714" lims:id="353714"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="353715" lims:id="353715">Idem</MarginalNote><Label>(2)</Label><Text>In a prosecution under this Act, evidence that a vehicle or equipment bearing a national safety mark was manufactured by a lims:id="353733"><Label>(b)</Label><Text>undertake research and development programs for the study of the impact of vehicles, drivers of vehicles, and streets and highways on road safety, energy conservation and the environment and for the promotion of measures to control that impact;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-19" lims:fid="353734" lims:id="353734"><Label>(c)</Label><Text>establish and operate facilities for the testing of vehicles, equipment and components, and acquire test equipment for that purpose;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-19" lims:fid="353735" lims:id="353735"><Label>(d)</Label><Text>make the facilities referred to in paragraph (c) and all related materials, parts and services available to any person;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-19" lims:fid="353736" lims:id="353736"><Label>(e)</Label><Text>collect any information related to vehicles or equipment that the Minister considers to be in the public interest; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-19" lims:fid="353737" lims:id="353737"><Label>(f)</Label><Text>publish or otherwise disseminate any information, other than personal information, relating to the activities of the Minister under this section.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-06-19" lims:fid="353738" lims:id="353738"><MarginalNote lims:inforce-start-date="2014-06-19" lims:fid="353739" lims:id="353739">Personal information</MarginalNote><Label>(1.1)</Label><Text>For the purposes of paragraphs (1)(a), (b) and (e), the Minister may collect personal information, as defined in section 3 of the <XRefExternal reference-type="act" link="P-21">Privacy Act</XRefExternal>, including personal information from third parties.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-19"
