lims:id="425979"><Text><DefinedTermEn>administrative burden</DefinedTermEn> means anything that is necessary to demonstrate compliance with a regulation, including the collecting, processing, reporting and retaining of information and the completing of forms. (<DefinedTermFr>fardeau administratif</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-23" lims:fid="425980" lims:id="425980"><Text><DefinedTermEn>business</DefinedTermEn> means a person or entity that engages in commercial activities in Canada, other than for a public purpose.  (<DefinedTermFr>entreprise</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-23" lims:fid="425981" lims:id="425981"><Text><DefinedTermEn>regulation</DefinedTermEn> means an instrument that is registered as a regulation under section 6 of the <XRefExternal reference-type="act" link="S-22">Statutory lims:inforce-start-date="2015-04-23" lims:fid="425990" lims:id="425990">Control of administrative burden</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2015-04-23" lims:fid="425991" lims:id="425991"><Label>(1)</Label><Text>If a regulation is made that imposes a new administrative burden on a business, one or more regulations must be amended or repealed to offset the cost of that new burden against the cost of an existing administrative burden on a business.</Text></Subsection><Subsection lims:inforce-start-date="2015-04-23" lims:fid="425992" lims:id="425992"><MarginalNote lims:inforce-start-date="2015-04-23" lims:fid="425993" lims:id="425993">Repeal of regulation</MarginalNote><Label>(2)</Label><Text>If a regulation is made  —  other than one that only amends a regulation  —  that imposes a new administrative burden on a business, a regulation must be repealed, unless one has already been repealed in accordance with subsection (1).</Text></Subsection></Section><Section lims:inforce-start-date="2015-04-23" lims:lastAmendedDate="2015-04-23" lims:fid="425994" lims:id="425994"><MarginalNote lims:inforce-start-date="2015-04-23" lims:fid="425995" lims:id="425995">Policies and directives</MarginalNote><Label>6</Label><Text>The President of the Treasury Board may establish policies or issue directives respecting the manner in which section <XRefInternal>5</XRefInternal> is to be applied.</Text></Section><Section lims:inforce-start-date="2015-04-23" lims:lastAmendedDate="2015-04-23" lims:fid="425996" lims:id="425996"><MarginalNote lims:inforce-start-date="2015-04-23" lims:fid="425997" lims:id="425997">Regulations</MarginalNote><Label>7</Label><Text>The Governor in Council may, for the purpose of section <XRefInternal>5</XRefInternal>, make regulations respecting</Text><Paragraph lims:inforce-start-date="2015-04-23" lims:fid="425998" lims:id="425998"><Label>(a)</Label><Text>the manner of calculating the cost of an administrative burden;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-23" lims:fid="425999" lims:id="425999"><Label>(b)</Label><Text>the period within which measures must be taken to comply with that section;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-23" lims:fid="426000" lims:id="426000"><Label>(c)</Label><Text>the taking into account of regulations that are amended or repealed before a new administrative burden is imposed;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-23" lims:fid="426001" lims:id="426001"><Label>(d)</Label><Text>the application of that section to any regulation made, amended or repealed on or after April 1, 2012; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-23" lims:fid="426002" lims:id="426002"><Label>(e)</Label><Text>the regulations that the Treasury Board may exempt from the application of that section and the categories for which, and the circumstances in which, such an exemption may be granted.</Text></Paragraph></Section><Heading lims:inforce-start-date="2015-04-23" lims:fid="426003" lims:id="426003" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:lastAmendedDate="2026-03-26" lims:fid="426004" right of Canada for anything done or omitted to be done, or for anything purported to be done or omitted to be done, under this Part.</Text></Subsection><Subsection specified validity period of not more than three years and on any terms that the minister considers appropriate, exempt an entity from the application of</Text><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570755" lims:id="1570755"><Label>(a)</Label><Text>a provision of an Act of Parliament, except an excluded Act, if the minister is responsible for the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570756" lims:id="1570756"><Label>(b)</Label><Text>a provision of an instrument made under an Act of Parliament, except an instrument made under an excluded Act, if</Text><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570757" lims:id="1570757"><Label>(i)</Label><Text>the minister is responsible for the Act, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570758" lims:id="1570758"><Label>(ii)</Label><Text>the body that made the instrument is accountable, through the minister, to Parliament for the conduct of its affairs; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570759" lims:id="1570759"><Label>(c)</Label><Text>a provision of an Act of Parliament, except an excluded Act, or a provision of an instrument made under an excluded Act, if the minister administers or enforces the provision.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570760" lims:id="1570760"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570761" lims:id="1570761">Requests not required to be considered</MarginalNote><Label>(2)</Label><Text>Subject to section 12.1, a minister is not required to consider a request for an exemption.</Text></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570762" lims:id="1570762"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570763" lims:id="1570763">Conditions</MarginalNote><Label>(3)</Label><Text>A minister may make an order under subsection (1) only if</Text><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570764" lims:id="1570764"><Label>(a)</Label><Text>the minister is of the opinion that</Text><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570765" lims:id="1570765"><Label>(i)</Label><Text>the exemption is in the public interest,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570766" lims:id="1570766"><Label>(ii)</Label><Text>the exemption would enable the testing of, among other things, a product, service, process, procedure or regulatory measure with the aim of facilitating the design, modification or administration of a regulatory regime to encourage innovation, competitiveness or economic growth in the clean technology or financial technology sector,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570767" lims:id="1570767"><Label>(iii)</Label><Text>the benefits associated with the exemption outweigh the risks,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570768" lims:id="1570768"><Label>(iv)</Label><Text>sufficient resources exist, and appropriate measures will be taken, to maintain oversight of the testing, manage any risks associated with the exemption and protect public health and safety and the environment, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570769" lims:id="1570769"><Label>(v)</Label><Text>a feasible implementation plan has been developed;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570770" lims:id="1570770"><Label>(b)</Label><Text>the minister has engaged in a public consultation process for at least 30 days with stakeholders, including experts and entities in the relevant sector; and</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570771" lims:id="1570771"><Label>(c)</Label><Text>the President of the Treasury Board has approved the exemption.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570772" lims:id="1570772"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570773" lims:id="1570773">Exemption continues in force</MarginalNote><Label>(4)</Label><Text>For greater certainty, an exemption granted under subsection (1) continues in force until the end of the validity period specified in the order even if the testing referred to in subparagraph (3)(a)(ii) is completed before the minister who has made an order under subsection (1) may, by order and on any terms the minister considers appropriate, amend it or extend the validity period of the exemption for a total period not maintain oversight of any continuing testing, manage any risks associated with the amended exemption or extension, and protect public health and safety and the environment; and</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1570779" lims:id="1570779"><Label>(d)</Label><Text>a feasible implementation plan has under subsection 12(1) with respect to the other entity referred to in paragraph (a), and the original order is subsequently amended or the validity period of the exemption granted by that order is extended by a minister or ministers, the minister or ministers must grant the same amendment or extension, by order under subsection 12(5), to that other entity if the minister or ministers are of the           — 2018, c. 12, s. 261</TitleText></Heading><Section type="amending"><Label>261</Label><Text>The Act is amended by adding the following after section 5:</Text><AmendedText include-in-TableOfProvisions="no"><Section><MarginalNote>Offset — regulatory cooperation</MarginalNote><Label>5.1</Label><Text>Despite subsection 5(1), the cost of all or a portion, as the case may be, of a new administrative burden imposed by a regulation on a business may, with the approval of the Treasury Board, be offset against the cost of all or a portion, as the case may be, of an existing administrative burden imposed by a regulatory instrument on a business if</Text><Paragraph><Label>(a)</Label><Text>the administrative burden imposed by the regulatory instrument is reduced or eliminated as a result of the making, amendment or repeal of the regulatory instrument; and</Text></Paragraph><Paragraph><Label>(b)</Label><Text>that making, amendment or repeal takes place after the coming into force of this section and is the result of an agreement — between the Government of Canada or any of its institutions and the other jurisdiction that made, amended or repealed the regulatory instrument — relating to the promotion of cooperation in the design, monitoring, enforcement or review of regulations and that other jurisdiction’s regulatory instruments.</Text></Paragraph></Section></AmendedText></Section></RelatedOrNotInForce><RelatedOrNotInForce><Heading level="5" style="nifrp"><TitleText>
          — 2018, c. 12, s. 262</TitleText></Heading><Section type="amending"><Label>262</Label><Text>Sections 6 and 7 of the Act are replaced by the following:</Text><AmendedText include-in-TableOfProvisions="no"><Section><MarginalNote>Policies and directives</MarginalNote><Label>6</Label><Text>The President of the Treasury Board may establish policies or issue directives respecting the manner in which sections 5 and 5.1 are to be applied.</Text></Section><Section><MarginalNote>Regulations</MarginalNote><Label>7</Label><Text>The Governor in Council may make regulations respecting</Text><Paragraph><Label>(a)</Label><Text>the manner of calculating, for the purpose of section 5 or 5.1, the cost of an administrative burden;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>the periods within which measures must be taken to comply with section 5;</Text></Paragraph><Paragraph><Label>(c)</Label><Text>the periods within which the cost of all or a portion of a new administrative burden imposed by a regulation may be offset under section 5.1;</Text></Paragraph><Paragraph><Label>(d)</Label><Text>the taking into account of regulations that are amended or repealed — or regulatory instruments that are made, amended or repealed — before a new administrative burden is imposed by a regulation;</Text></Paragraph><Paragraph><Label>(e)</Label><Text>the application of section 5 to any regulation made, amended or repealed on or after April 1, 2012;</Text></Paragraph><Paragraph><Label>(f)</Label><Text>the application of section 5.1 to any regulation made or amended before the day on which that section comes into force; and</Text></Paragraph><Paragraph><Label>(g)</Label><Text>the regulations that the Treasury Board may exempt from the application of section 5 and the categories for which, and the circumstances in which, such an exemption may be granted.</Text></Paragraph></Section></AmendedText></Section></RelatedOrNotInForce><RelatedOrNotInForce><Heading level="5" style="nifrp"><TitleText>
