recommendation of the Minister of Citizenship and Immigration, pursuant to subsection 161(1) of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection information</DefinedTermEn> means a person’s name, postal address and telephone number and the person’s fax number and electronic mail address, if generate-in-text="no"><Text><DefinedTermEn>detention review</DefinedTermEn> means a forty-eight hour review, a seven-day review and a thirty-day review. (<DefinedTermFr>contrôle des motifs de generate-in-text="no"><Text><DefinedTermEn>Division</DefinedTermEn> means the Immigration Division. (<DefinedTermFr>Section</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="691329" lims:id="691329" generate-in-text="no"><Text><DefinedTermEn>forty-eight hour review</DefinedTermEn> means the review of the reasons for continued generate-in-text="no"><Text><DefinedTermEn>registry office</DefinedTermEn> means a business office of the Division. (<DefinedTermFr>greffe</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="691333" lims:id="691333" generate-in-text="no"><Text><DefinedTermEn>seven-day review</DefinedTermEn> means the review of the reasons for continued detention required to be held during the seven days following a forty-eight hour review, under subsection 57(2) of the Act. (<DefinedTermFr>contrôle des sept Division must be directed to the registry office specified by the Division.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="691338" lims:id="691338" level="1"><Label>PART 1</Label><TitleText>Rules Applicable to Admissibility Hearings</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="691339" lims:id="691339" level="2"><TitleText>Information</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="691340" lims:id="691340"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="691341" lims:id="691341">Information provided by the Minister</MarginalNote><Label>3</Label><Text>When the Minister requests the Division to hold an admissibility hearing, the Minister must provide to the Division and the permanent resident or foreign national, as the case may be, any relevant information or document that the Minister may have, including</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691342" lims:id="691342"><Label>(a)</Label><Text>the name and other contact information in Canada of the permanent resident or foreign national;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691343" lims:id="691343"><Label>(b)</Label><Text>the person’s date of birth, sex and citizenship;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691344" lims:id="691344"><Label>(c)</Label><Text>whether the person is single, married, separated or divorced or is a common-law partner;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691345" lims:id="691345"><Label>(d)</Label><Text>the inadmissibility report and the Minister’s referral;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691346" lims:id="691346"><Label>(e)</Label><Text>whether the person has made a claim for refugee protection;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691347" lims:id="691347"><Label>(f)</Label><Text>the name and address of the place of detention, if the person is detained;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691348" lims:id="691348"><Label>(g)</Label><Text>the language — English or French — chosen by the person for communicating with the Division;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691349" lims:id="691349"><Label>(h)</Label><Text>if an interpreter is required, the language or dialect to be interpreted;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691350" lims:id="691350"><Label>(i)</Label><Text>if the person has counsel, the counsel’s contact information;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691351" lims:id="691351"><Label>(j)</Label><Text>the client identification number given to the person by the Department of Citizenship and Immigration;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691352" lims:id="691352"><Label>(k)</Label><Text>the names, sex, date of birth, citizenship, and other contact information of any family member whose case has been referred to the Division, and the client identification number given to them by the Department of Citizenship and Immigration;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691353" lims:id="691353"><Label>(l)</Label><Text>the date on which the Minister makes the request;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691354" lims:id="691354"><Label>(m)</Label><Text>the name and title of the Minister’s counsel;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691355" lims:id="691355"><Label>(n)</Label><Text>whether the Minister has made an application for non-disclosure of information;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691356" lims:id="691356"><Label>(o)</Label><Text>whether the Minister believes that the person is less than 18 years of age or is unable to appreciate the nature of the proceedings; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691357" lims:id="691357"><Label>(p)</Label><Text>the evidence to be presented by the Minister.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="691358" lims:id="691358"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="691359" lims:id="691359">Change to contact information</MarginalNote><Label>4</Label><Text>If the contact information changes, the permanent resident or foreign national, unless detained, must without delay provide the changes in writing to the Division and the Minister.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="691360" lims:id="691360" level="2"><TitleText>Withdrawing a Request by the Minister for an Admissibility Hearing</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="691361" lims:id="691361"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="691362" lims:id="691362">Abuse of process</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="691363" lims:id="691363"><Label>(1)</Label><Text>Withdrawal of a request for an admissibility hearing is an abuse of process if withdrawal would likely have a negative effect on the integrity of the Division. If no substantive evidence has been accepted in the proceedings, withdrawal of a request is not an abuse of process.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="691364" lims:id="691364"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="691365" lims:id="691365">Withdrawal if no evidence has been accepted</MarginalNote><Label>(2)</Label><Text>If no substantive evidence has been accepted in the proceedings, the Minister may withdraw a request by notifying the Division orally at a proceeding or in writing. If the Minister notifies in writing, the Minister must provide a copy of the notice to the other party.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="691366" lims:id="691366"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="691367" lims:id="691367">Withdrawal if evidence has been accepted</MarginalNote><Label>(3)</Label><Text>If substantive evidence has been accepted in the proceedings, the Minister must make a written application to the Division in order to withdraw a request.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="691368" lims:id="691368" level="2"><TitleText>Reinstating a Request by the Minister for an Admissibility Hearing</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="691369" lims:id="691369"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="691370" lims:id="691370">Application for reinstatement of withdrawn request</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="691371" lims:id="691371"><Label>(1)</Label><Text>The Minister may make a written application to the Division to reinstate a request for an admissibility hearing that was withdrawn.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="691372" lims:id="691372"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="691373" lims:id="691373">Factors</MarginalNote><Label>(2)</Label><Text>The Division must allow the application if it is established that there was a failure to observe a principle of natural justice or if it is otherwise in the interests of justice to allow the application.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="691374" lims:id="691374" level="2"><TitleText>Decision</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="691375" lims:id="691375"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="691376" lims:id="691376">Favourable decision</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="691377" lims:id="691377"><Label>(1)</Label><Text>If the decision at the conclusion of an admissibility hearing is in favour of the permanent resident or foreign national, the member making the decision must date and sign a notice of decision and provide a copy to the parties.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="691378" lims:id="691378"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="691379" lims:id="691379">Unfavourable decision</MarginalNote><Label>(2)</Label><Text>If the decision is not in favour of the permanent resident or foreign national, the member must date and sign an order indicating the applicable provisions of the Act and provide a copy to the parties. The member must also notify the permanent resident or foreign national of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691380" lims:id="691380"><Label>(a)</Label><Text>their right to appeal to the Immigration Appeal Division; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691381" lims:id="691381"><Label>(b)</Label><Text>if they do not have the right to appeal, their right to file an application for judicial review in the Federal Court.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="691382" lims:id="691382"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="691383" lims:id="691383">When decision takes effect</MarginalNote><Label>(3)</Label><Text>A decision made orally at a hearing takes effect when a Division member states the decision. A decision made in writing takes effect when the member signs and dates it.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="691384" lims:id="691384"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="691385" lims:id="691385">Request for written reasons</MarginalNote><Label>(4)</Label><Text>A request made by a party for written reasons for a decision may be made orally at the end of an admissibility hearing or in writing. A request in writing must be received by the Division no later than 10 days after the decision takes effect.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="691386" lims:id="691386" level="1"><Label>PART 2</Label><TitleText>Rules Applicable to Detention Reviews</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="691387" lims:id="691387" level="2"><TitleText>Information</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="691388" lims:id="691388"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="691389" lims:id="691389">Information provided by the Minister</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="691390" lims:id="691390"><Label>(1)</Label><Text>If a foreign national or a permanent resident is subject to a detention review, the Minister must provide the Division and the person detained with the following information:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691391" lims:id="691391"><Label>(a)</Label><Text>the person’s name, sex, date of birth and citizenship;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691392" lims:id="691392"><Label>(b)</Label><Text>whether the person is single, married, separated or divorced or is a common-law partner;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691393" lims:id="691393"><Label>(c)</Label><Text>whether the person has made a claim for refugee protection;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691394" lims:id="691394"><Label>(d)</Label><Text>the language — English or French — chosen by the person for communicating with the Division;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691395" lims:id="691395"><Label>(e)</Label><Text>if an interpreter is required, the language or dialect to be interpreted;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691396" lims:id="691396"><Label>(f)</Label><Text>if the person has counsel, the counsel’s contact information;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691397" lims:id="691397"><Label>(g)</Label><Text>the date and time that the person was first placed in detention;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691398" lims:id="691398"><Label>(h)</Label><Text>the name and address of the place where the person is being detained;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691399" lims:id="691399"><Label>(i)</Label><Text>whether the Minister is seeking a detention review after the first forty-eight hour detention or after a seven-day or thirty-day review;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691400" lims:id="691400"><Label>(j)</Label><Text>the identification number given to the person by the Department of Citizenship and Immigration;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691401" lims:id="691401"><Label>(k)</Label><Text>the provision of the Act under which the review of the reasons for continued detention is required;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691402" lims:id="691402"><Label>(l)</Label><Text>whether an application for non-disclosure of information has been made; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691403" lims:id="691403"><Label>(m)</Label><Text>whether the Minister believes that the person is less than 18 years of age or is unable to appreciate the nature of the proceedings.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="691404" lims:id="691404"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="691405" lims:id="691405">Time limit</MarginalNote><Label>(2)</Label><Text>The information must be received by the Division and the person detained</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="691406" lims:id="691406"><Label>(a)</Label><Text>in the case of a forty-eight hour review, as soon as possible;
