lims:fid="704091" lims:id="704091" generate-in-text="no"><Text><DefinedTermEn>appellant</DefinedTermEn> means a person who brings an appeal under section 15 of the lims:id="704102">Procedural matters not provided for</MarginalNote><Label>2</Label><Text>If any question of procedure arises during a proceeding that is not covered, or not fully covered, in these Rules, the Assessor must decide the question in a manner that is consistent with these Rules and with the principles of procedural fairness and natural justice.</Text></Section><Section lims:id="704104">Unfairness</MarginalNote><Label>3</Label><Text>If the application of any Rule would cause unfairness to a party, the Assessor may waive compliance with the lims:fid="704106" lims:id="704106">Technical defects</MarginalNote><Label>4</Label><Text>A defect in form or a technical irregularity may be overlooked by the lims:inforce-start-date="2006-03-22" lims:fid="704115" lims:id="704115"><Label>(1)</Label><Text>Subject to subsection (2), in calculating time limits under these Rules, all days must be counted, except that if a time limit ends on a Saturday or a Sunday or other holiday, the time limit must be extended until the next business day.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="704116" lims:id="704116"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704117" lims:id="704117">Five-day time limits</MarginalNote><Label>(2)</Label><Text>If a time limit is five days, a Saturday or a Sunday or other holiday must not be included in the calculation of the time limit.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="704118" lims:id="704118"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704119" lims:id="704119">Extension of time limits</MarginalNote><Label>7</Label><Text>If adhering to a time limit fixed by these Rules would cause unfairness to a party, the Assessor may extend the time limit either before or after the end of the time limit.</Text></Section><Section lims:inforce-start-date="2007-05-17" lims:lastAmendedDate="2007-05-17" lims:fid="704120" lims:id="704120"><MarginalNote lims:inforce-start-date="2007-05-17" lims:fid="704121" lims:id="704121">Production of documents</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2007-05-17" lims:fid="704122" lims:id="704122"><Label>(1)</Label><Text>Any party to an appeal may give a notice in writing to any other party to the appeal</Text><Paragraph lims:inforce-start-date="2007-05-17" lims:fid="704123" lims:id="704123"><Label>(a)</Label><Text>to provide to the party giving notice, or make available for inspection by the party giving notice, any document in the possession of the other party, or to which the other party has access, that is intended to be used in evidence by the other party at the hearing; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-17" lims:fid="704124" lims:id="704124"><Label>(b)</Label><Text>to permit the party giving notice to make photocopies of any documents referred to in paragraph (a).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-05-17" lims:fid="704125" lims:id="704125"><MarginalNote lims:inforce-start-date="2007-05-17" lims:fid="704126" lims:id="704126">Time limits for notice</MarginalNote><Label>(2)</Label><Text>The notice must be given at least 21 days before the date fixed for the hearing and the documents must be provided or made available for inspection within 10 days after the receipt of the notice.</Text></Subsection><Subsection lims:inforce-start-date="2007-05-17" lims:fid="704127" lims:id="704127"><MarginalNote lims:inforce-start-date="2007-05-17" lims:fid="704128" lims:id="704128">Copy for the Registrar</MarginalNote><Label>(3)</Label><Text>The party giving the notice must at the same time send a copy of the notice to the Registrar.</Text></Subsection><Subsection lims:inforce-start-date="2007-05-17" lims:fid="704129" lims:id="704129"><MarginalNote lims:inforce-start-date="2007-05-17" lims:fid="704130" lims:id="704130">Varying time limits</MarginalNote><Label>(4)</Label><Text>The periods of time referred to in subsection (2) may be varied by agreement between the parties or by order of the Assessor.</Text></Subsection><Subsection lims:inforce-start-date="2007-05-17" lims:fid="704131" lims:id="704131"><MarginalNote lims:inforce-start-date="2007-05-17" lims:fid="704132" lims:id="704132">Order to provide or make available</MarginalNote><Label>(5)</Label><Text>If the party to whom the notice is given fails to comply with the notice, the party giving the notice may apply to the Assessor for an order directing the party to whom notice was given to provide the requested documents or make them available for lims:fid="704137" lims:id="704137"><Label>(1)</Label><Text>A document filed with the Assessor by a party to an appeal is a public document unless the party requests that the document be treated as confidential.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="704138" lims:id="704138"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704139" lims:id="704139">Request for confidential treatment</MarginalNote><Label>(2)</Label><Text>A request that a document be treated as confidential must provide reasons for the request, including details of the nature and extent of the harm that disclosure of the document would cause to the party making the request.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="704140" lims:id="704140"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704141" lims:id="704141">Decision to grant request</MarginalNote><Label>(3)</Label><Text>The Assessor must grant a party’s request for confidential treatment if the Assessor considers that disclosure of the document would cause harm to the party.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" must be sent in duplicate.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="704145" lims:id="704145"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704146" lims:id="704146">Submitting documents to the Registrar or Assessor</MarginalNote><Label>(2)</Label><Text>Documents may be submitted to the Registrar or the Assessor by hand or by registered mail, number</MarginalNote><Label>13</Label><Text>A party to an appeal must notify the Registrar without delay of a change of address or facsimile number.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="704157" lims:id="704157" level="1"><TitleText>Appeals</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="704158" lims:id="704158"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704159" lims:id="704159">Request for appeal hearing</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="704160" lims:id="704160"><Label>(1)</Label><Text>A person who wishes to appeal to the Assessor must provide the Registrar with a notice of appeal. The notice must state the reasons for the appeal and must indicate the language in which the appellant wishes the appeal to be heard.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="704161" lims:id="704161"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704162" lims:id="704162">Notice to be signed</MarginalNote><Label>(2)</Label><Text>The notice of appeal must be signed by the appellant or the appellant’s counsel or representative. If a representative signs the notice, a copy of the appellant’s written authorization of the representative must be filed with the notice.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="704163" lims:id="704163"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704164" lims:id="704164">Copy to be sent to Minister</MarginalNote><Label>15</Label><Text>The Registrar must send a copy of the notice of appeal to the Minister within five days after receiving it.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="704165" lims:id="704165"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704166" lims:id="704166">Minister to send information</MarginalNote><Label>16</Label><Text>Within 30 days after the day on which the Minister receives a copy of the notice of appeal, the Minister must send to the Registrar the following documents:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="704167" lims:id="704167"><Label>(a)</Label><Text>the decision or award of compensation being appealed;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="704168" lims:id="704168"><Label>(b)</Label><Text>the evidence on which the Minister relied to reach the decision or award of compensation being appealed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="704169" lims:id="704169"><Label>(c)</Label><Text>the Minister’s reply to the notice of appeal, admitting or denying any facts alleged in the notice of appeal and containing a statement of any facts on which he or she intends to rely.</Text></Paragraph></Section><Section lims:inforce-start-date="2007-05-17" lims:lastAmendedDate="2007-05-17" lims:fid="704170" lims:id="704170"><MarginalNote lims:inforce-start-date="2007-05-17" lims:fid="704171" lims:id="704171">Minister’s documents to be sent to other parties</MarginalNote><Label>17</Label><Subsection lims:inforce-start-date="2007-05-17" lims:fid="704172" lims:id="704172"><Label>(1)</Label><Text>On receipt of the documents required by section 16, the Registrar must, without delay,</Text><Paragraph lims:inforce-start-date="2007-05-17" lims:fid="704173" lims:id="704173"><Label>(a)</Label><Text>forward a copy of each of them to the appellant; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-17" lims:fid="704174" lims:id="704174"><Label>(b)</Label><Text>give notice in writing to the parties other than the Minister that they have 30 days after the date of the notice to submit any additional information or representations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-05-17" lims:fid="704175" lims:id="704175"><MarginalNote lims:inforce-start-date="2007-05-17" lims:fid="704176" lims:id="704176">Information or representations received from other parties to be sent to Minister</MarginalNote><Label>(2)</Label><Text>On receipt of any additional information or representations from the other parties, the Registrar must forward a copy of the information or representations to the Minister without delay.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:id="704180">Consolidation</MarginalNote><Label>18</Label><Text>If there is a common question of fact in two or more appeals for which Notices of Appeal have been filed in accordance with these Rules, the Assessor may, on his or her own motion or on application by a party, order</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="704181" lims:id="704181"><Label>(a)</Label><Text>that the appeals be consolidated on such terms as the Assessor may direct;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="704182" lims:id="704182"><Label>(b)</Label><Text>that the appeals be heard at the same time;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="704183" lims:id="704183"><Label>(c)</Label><Text>that the appeals be heard consecutively; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="704184" lims:id="704184"><Label>(d)</Label><Text>that any of the appeals be stayed until the determination of any of the other appeals.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="704185" lims:id="704185"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704186" lims:id="704186">Withdrawal of appeal</MarginalNote><Label>19</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="704187" lims:id="704187"><Label>(1)</Label><Text>An appellant may withdraw a notice of appeal at any time by notifying the Registrar in writing to that effect.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="704188" lims:id="704188"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704189" lims:id="704189">Notification of parties</MarginalNote><Label>(2)</Label><Text>On receipt of the notice of withdrawal, the Registrar must without delay notify all other parties to the appeal.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="704190" lims:id="704190"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704191" lims:id="704191">Time and place for hearing</MarginalNote><Label>20</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="704192" lims:id="704192"><Label>(1)</Label><Text>The Assessor must fix the time and place for the hearing of the appeal, which must not be earlier than 30 days, and not later than 60 days, after the period referred to in subsection 17(1).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="704193" lims:id="704193"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704194" lims:id="704194">Notification of parties</MarginalNote><Label>(2)</Label><Text>The Registrar must notify the parties to the appeal of the time and place for the hearing of the appeal at least 25 days before the date of the hearing.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="704195" lims:id="704195" level="1"><TitleText>Conduct of an Appeal</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="704196" lims:id="704196"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704197" lims:id="704197">Representation of parties</MarginalNote><Label>21</Label><Text>A party to an appeal may be represented by counsel or by another representative authorized in writing.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="704198"
