(<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-11-20" lims:fid="708436" lims:id="708436" generate-in-text="no"><Text><DefinedTermEn>assessment</DefinedTermEn> includes a reassessment and an additional assessment. (<DefinedTermFr>cotisation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-11-20" lims:fid="708437" lims:id="708437" generate-in-text="no"><Text><DefinedTermEn>counsel</DefinedTermEn> means every person who may practise as a barrister, advocate, attorney or solicitor in any of the provinces. (<DefinedTermFr>avocat</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-11-20" lims:fid="708438" lims:id="708438" generate-in-text="no"><Text><DefinedTermEn>electronic filing</DefinedTermEn> means the act of filing, by electronic means, through the Court’s website (<XRefExternal reference-type="other" link="http://www.tcc-cci.gc.ca" isURL="true">www.tcc-cci.gc.ca</XRefExternal>) or any other website referred to in a direction issued by the Court, any document listed on those sites. Rules apply to appeals brought under the <XRefExternal reference-type="act" link="E-14.1">Excise Act, 2001</XRefExternal>, other than appeals to which the <XRefExternal reference-type="regulation" link="SOR-90-688a">Tax Court of Canada Rules (General Procedure)</XRefExternal> apply.</Text></Section><Heading lims:inforce-start-date="2023-07-05" lims:enacted-date="2023-06-23" lims:fid="1418669" lims:id="1418669" level="1"><TitleText>Associate Judges</TitleText></Heading><Section lims:inforce-start-date="2023-07-05" lims:enacted-date="2023-06-23" lims:lastAmendedDate="2023-07-05" lims:fid="1418707" lims:id="1418707"><Label>3.1</Label><Subsection lims:inforce-start-date="2023-07-05" lims:enacted-date="2023-06-23" lims:fid="1418708" lims:id="1418708"><Label>(1)</Label><Text>An associate judge of the Court has all the powers of a judge of the Court under these Rules.</Text></Subsection><Subsection lims:inforce-start-date="2023-07-05" lims:enacted-date="2023-06-23" lims:fid="1418709" lims:id="1418709"><Label>(2)</Label><Text>Any associate judge may sit and act at any time and at any place in Canada for the transaction of the business of the Court, and, where the associate judge so sits or acts, that associate judge constitutes the Court.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2023-07-05" lims:lastAmendedDate="2008-11-20" lims:fid="708447" lims:id="708447"><Label>4</Label><Text>An appeal referred to in section 3 shall be instituted by filing a notice of appeal, which may be in the form set out in Schedule 4, using one of the following methods:</Text><Paragraph lims:inforce-start-date="2008-11-20" lims:fid="708448" lims:id="708448"><Label>(a)</Label><Text>depositing the notice with the Registry;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-11-20" lims:fid="708449" lims:id="708449"><Label>(b)</Label><Text>sending it by mail to the Registry; or</Text></Paragraph><Paragraph lims:inforce-start-date="2008-11-20" lims:fid="708450" lims:id="708450"><Label>(c)</Label><Text>sending it by fax or by electronic filing to the in these rules and unless otherwise directed by the Court, a document other than a notice of appeal may be filed using one of the following methods:</Text><Paragraph lims:id="708461"><Label>4.2</Label><Text>Except as otherwise provided in these rules and unless otherwise directed by the Court, the date of filing of a document is deemed to be</Text><Paragraph lims:inforce-start-date="2008-11-20" lims:fid="708462" lims:id="708462"><Label>(a)</Label><Text>in the case of a document filed with the Registry or sent by mail or by fax, the date shown by the date received stamp placed on the document by the Registry at the time it is received; or</Text></Paragraph><Paragraph lims:inforce-start-date="2008-11-20" lims:fid="708463" lims:id="708463"><Label>(b)</Label><Text>in the case of a document filed by electronic filing, the date shown on the acknowledgment of receipt issued by the lims:inforce-start-date="2008-11-20" lims:fid="708468" lims:id="708468"><Label>(1)</Label><Text>Except as otherwise provided in these rules and unless otherwise directed by the Court, when a document is filed by electronic filing, the copy of the document that is printed by the Registry and placed in the Court file is deemed to be the original version of the document.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="708469" lims:id="708469"><Label>(2)</Label><Text>A party who files a document by electronic filing shall, if required by these rules or at the request of a party or the Court, provide a paper copy of the document and file it with the Registry.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="708470" lims:id="708470"><Label>(3)</Label><Text>If the Registry has no record of the receipt of a document, it is deemed not to have been filed, unless Documents</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708474" lims:id="708474"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708475" lims:id="708475"><Label>(1)</Label><Text>The notice of appeal shall also include the appellant’s address for service of documents.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708476" lims:id="708476"><Label>(2)</Label><Text>The appellant’s address for service may be the address of the appellant or the appellant’s counsel or agent.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708477" lims:id="708477"><Label>(3)</Label><Text>A written notice of any change in the appellant’s address for service shall forthwith be provided to the Registry by the appellant or by the appellant’s counsel or agent, which address shall thereafter be that party’s address for service.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708478" lims:id="708478"><Label>(4)</Label><Text>Until notice of a change of the appellant’s address for service is received at the Registry, any service required to be made on the appellant of any documents pertaining to the appeal shall be made by mail to the address contained in the notice of appeal and shall constitute good and sufficient service on the appellant.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="708479" lims:id="708479" level="1"><TitleText>Reply to Notice of Appeal</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708480" lims:id="708480"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708481" lims:id="708481"><Label>(1)</Label><Text>Every reply to a notice of appeal shall contain a statement of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708482" lims:id="708482"><Label>(a)</Label><Text>the facts that are admitted;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708483" lims:id="708483"><Label>(b)</Label><Text>the facts that are denied;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708484" lims:id="708484"><Label>(c)</Label><Text>the facts of which the respondent has no knowledge and puts in issue;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708485" lims:id="708485"><Label>(d)</Label><Text>the findings or assumptions of fact made by the Minister when making the assessment;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708486" lims:id="708486"><Label>(e)</Label><Text>any other material facts;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708487" lims:id="708487"><Label>(f)</Label><Text>the issues to be decided;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708488" lims:id="708488"><Label>(g)</Label><Text>the statutory provisions relied on;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708489" lims:id="708489"><Label>(h)</Label><Text>the reasons the respondent intends to rely on; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708490" lims:id="708490"><Label>(i)</Label><Text>the relief sought.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708491" lims:id="708491"><Label>(2)</Label><Text>Within five days after a reply is filed, the Minister shall serve a copy of it by registered mail addressed to the appellant’s address for service of documents.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="708492" lims:id="708492" level="1"><TitleText>Expert Witnesses</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708493" lims:id="708493"><Label>7</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708494" lims:id="708494"><Label>(1)</Label><Text>A party who intends to call an expert witness at the hearing of an appeal shall, not less than 10 days before the commencement of the hearing, file at the Registry and serve on the other parties a report, signed by the expert, setting out the expert’s name, address and qualifications and the substance of the expert’s testimony.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708495" lims:id="708495"><Label>(2)</Label><Text>An expert witness may not testify, except with leave of the presiding judge, if subsection (1) has not been satisfied.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="708496" lims:id="708496" level="1"><TitleText>Discontinuance</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708497" lims:id="708497"><Label>8</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708498" lims:id="708498"><Label>(1)</Label><Text>A party who instituted an appeal in the Court may, at any time, discontinue that appeal by written notice.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708499" lims:id="708499"><Label>(2)</Label><Text>Such discontinuance may be in the form set out in Schedule 8.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="708500" lims:id="708500" level="1"><TitleText>Pronouncing and Entering of Judgments</TitleText></Heading><Section lims:inforce-start-date="2014-02-07" lims:lastAmendedDate="2014-02-07" lims:fid="708501" lims:id="708501"><Label>8.1</Label><Subsection lims:inforce-start-date="2014-02-07" lims:fid="708502" lims:id="708502"><Label>(1)</Label><Text>The Court shall dispose of an appeal or an interlocutory or other application that determines in whole or in part any substantive right in dispute between or among the parties by rendering a judgment and shall dispose of any other interlocutory or other application by issuing an order.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="708503" lims:id="708503"><Label>(2)</Label><Text>A judgment shall be dated on the day it is signed and that day is the date of the pronouncement of the judgment.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="708504" lims:id="708504"><Label>(3)</Label><Text>A judgment and the reasons relating to it, if any, shall be deposited with the Registry without delay.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-02-07" lims:fid="708506" level="1"><TitleText>Costs</TitleText></Heading><Section lims:inforce-start-date="2008-11-20" lims:lastAmendedDate="2008-11-20" lims:fid="708508" lims:id="708508"><Label>9</Label><Subsection lims:inforce-start-date="2008-11-20" lims:fid="708509" lims:id="708509"><Label>(1)</Label><Text>The Court may determine the amount of the costs of all parties involved in any proceeding, the allocation of those costs and the persons required to pay them.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="708510" lims:id="708510"><Label>(2)</Label><Text>The Court may award costs not exceeding the amounts listed in section 10 to the respondent only if the actions of the appellant have unduly delayed the prompt and effective resolution of the appeal.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="708511" lims:id="708511"><Label>(3)</Label><Text>The Court may direct the payment of costs in a fixed sum, in lieu of any taxed costs.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2008-11-20" lims:fid="708513" lims:id="708513">SOR/2008-301, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708514" lims:id="708514"><Label>10</Label><Text>On the taxation of party and party costs, the following fees may be allowed for the services of counsel:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708515" lims:id="708515"><Label>(a)</Label><Text>for the preparation of a notice of appeal or for advice relating to the appeal, $185;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708516" lims:id="708516"><Label>(b)</Label><Text>for preparing for a hearing, $250;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708517" lims:id="708517"><Label>(c)</Label><Text>for the conduct of a hearing, $375 for each half day or part of a half day; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708518" lims:id="708518"><Label>(d)</Label><Text>for taxation of costs, $60.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708519" lims:id="708519"><Label>11</Label><Text>Unless otherwise directed by the Court, where an appellant is represented or assisted by an adviser other than counsel, disbursements in respect of services referred to in section 10 may be allowed on the taxation of party and party costs in an amount not to exceed one half of the amounts listed in section 10.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708520" lims:id="708520"><Label>12</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708521" lims:id="708521"><Label>(1)</Label><Text>Such other disbursements may be allowed as were essential for the conduct of the appeal if it is established that the disbursements were made or that the party is liable for them.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708522" lims:id="708522"><Label>(2)</Label><Text>There may be allowed all services, sales, use or consumption taxes and other like taxes paid or payable on any counsel fees and disbursements allowed if it is established that such taxes have been paid or are payable and are not otherwise reimbursed or reimbursable in any manner whatever, including, without restriction, by means of claims for input tax credits in respect of such taxes.</Text></Subsection></Section><Section lims:inforce-start-date="2007-06-14" lims:lastAmendedDate="2007-06-14" lims:fid="708523" lims:id="708523"><Label>13</Label><Subsection lims:inforce-start-date="2007-06-14" lims:fid="708524" lims:id="708524"><Label>(1)</Label><Text>A witness, other than a witness who appears to give evidence as an expert, is entitled to be paid by the party who arranged for his or her attendance $75 per day, plus reasonable and proper transportation and living expenses.</Text></Subsection><Subsection lims:inforce-start-date="2007-06-14" lims:fid="708525" lims:id="708525"><Label>(2)</Label><Text>An amount is not payable under subsection (1) in respect of an appellant unless the appellant is called on to testify by counsel for the respondent.</Text></Subsection><Subsection lims:inforce-start-date="2007-06-14" lims:fid="708526" lims:id="708526"><Label>(3)</Label><Text>There may be paid to a witness who appears to give evidence as an expert a reasonable payment, not to exceed $300 per day unless the Court otherwise directs, for the services performed by the witness in preparing to give evidence and giving evidence.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2007-06-14" lims:fid="708528" lims:id="708528">SOR/2007-147, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2008-11-20" lims:lastAmendedDate="2008-11-20" lims:fid="708529" lims:id="708529"><Label>14</Label><Subsection lims:inforce-start-date="2008-11-20" lims:fid="708530" lims:id="708530"><Label>(1)</Label><Text>Subject to subsection 9(3), costs shall be taxed by the Registrar or any other person that may be designated by the Chief Justice as a taxing officer.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="708531" lims:id="708531"><Label>(2)</Label><Text>An appellant whose costs are to be taxed shall file with the Registrar a bill of costs, which may be in the form set out in Schedule 14.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="708532" lims:id="708532"><Label>(3)</Label><Text>The Registrar shall forthwith send a true copy of the bill of costs to counsel for the respondent.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="708533" lims:id="708533"><Label>(4)</Label><Text>Immediately following the taxation, the Registrar shall send to each of the parties a certificate of taxation.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2008-11-20" lims:fid="708535" lims:id="708535">SOR/2008-301, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708536" lims:id="708536"><Label>15</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708537" lims:id="708537"><Label>(1)</Label><Text>Any party may appeal to a judge of the Court from the taxation by notice in writing sent to the Registrar within 20 days of the date of mailing of the certificate of taxation.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708538" lims:id="708538"><Label>(2)</Label><Text>The time referred to in subsection (1) may be extended by a judge of the Court.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="708539" lims:id="708539" level="1"><TitleText>Costs in Vexatious Proceedings</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708540" lims:id="708540"><Label>16</Label><Text>Where a judge has made an order under section 19.1 of the Act, costs may be awarded against the person in respect of whom the order has been made.</Text></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="708541" lims:id="708541" level="1"><TitleText>Removal of an Appeal from the Informal Procedure to the General Procedure or from the General Procedure to the Informal Procedure</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708542" lims:id="708542"><Label>17</Label><Text>An application by the Attorney General of Canada to remove an appeal from the informal procedure to the general procedure shall be by motion, and the Court may give such directions as are necessary for the subsequent conduct of the appeal. There shall be no additional filing fee for proceeding in the general procedure unless the Court so directs.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708543" lims:id="708543"><Label>18</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708544" lims:id="708544"><Label>(1)</Label><Text>Where a person who has appealed under the <XRefExternal reference-type="act" link="E-14.1">Excise Act, 2001</XRefExternal> has not elected in the notice of appeal that sections 18.3001 and 18.3003 to 18.302 (<Emphasis style="italic">Informal Procedure</Emphasis>) of the Act shall apply, that person may, within 90 days from the date on which the reply is served or within such additional time as the Court may, on motion for special reasons, allow, make such an election.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708545" lims:id="708545"><Label>(2)</Label><Text>An election under subsection (1) may be in the form set out in Schedule 18.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="708546" lims:id="708546" level="1"><TitleText>Application for Extension of Time</TitleText></Heading><Section lims:inforce-start-date="2014-02-07" lims:lastAmendedDate="2014-02-07" lims:fid="708547" lims:id="708547"><Label>19</Label><Subsection lims:inforce-start-date="2014-02-07" lims:fid="708548" lims:id="708548"><Label>(1)</Label><Text>A person who has made an application to the Minister to extend the time for the filing of a notice of objection may apply to the Court to have the application granted after either</Text><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="708549" lims:id="708549"><Label>(a)</Label><Text>the Minister has refused the application, or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="708550" lims:id="708550"><Label>(b)</Label><Text>90 days have elapsed after service of the application, and the Minister has not notified the person of the Minister’s decision,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2014-02-07" lims:fid="708551" lims:id="708551"><Text>but no application under this section may be made after the expiration of 30 days after the day on which notification of the Minister’s decision was mailed to the person.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="708552" lims:id="708552"><Label>(2)</Label><Text>An application made under subsection (1) may be in the form set out in Schedule 19.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="708553" lims:id="708553"><Label>(3)</Label><Text>An application under subsection (1) shall be made by filing with the Registrar, in the manner provided in section 4.1, three copies of the application made to the Minister accompanied by three copies of the notice of objection and three copies of the Minister’s decision, if any.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="708554" lims:id="708554"><Label>(4)</Label><Text>The Court may dispose of an application made under subsection (1) by</Text><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="708555" lims:id="708555"><Label>(a)</Label><Text>dismissing it, or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="708556" lims:id="708556"><Label>(b)</Label><Text>granting it,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2014-02-07" lims:fid="708557" lims:id="708557"><Text>and, in granting it, may impose such terms as it deems just or order that the notice of objection be deemed to be a valid objection as of the date of the order.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="708558" lims:id="708558"><Label>(5)</Label><Text>No application shall be granted under this section to a person unless</Text><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="708559" lims:id="708559"><Label>(a)</Label><Text>the application is made within one year after the expiration of the time specified by the <XRefExternal reference-type="act" link="E-14.1">Excise Act, 2001</XRefExternal> for filing a notice of objection*; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="708560" lims:id="708560"><Label>(b)</Label><Text>the person demonstrates that</Text><Subparagraph lims:inforce-start-date="2014-02-07" lims:fid="708561" lims:id="708561"><Label>(i)</Label><Text>within the applicable time specified in paragraph (a), the person</Text><Clause lims:inforce-start-date="2014-02-07" lims:fid="708562" lims:id="708562"><Label>(A)</Label><Text>was unable to act or to give a mandate to act in the person’s name, or</Text></Clause><Clause lims:inforce-start-date="2014-02-07" lims:fid="708563" lims:id="708563"><Label>(B)</Label><Text>had a <Language xml:lang="la">bona fide</Language> intention to object to the assessment,</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2014-02-07" lims:fid="708564" lims:id="708564"><Label>(ii)</Label><Text>given the reasons set out in the application and the circumstances of the case, it would be just and equitable to grant the application, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-02-07" lims:fid="708565" lims:id="708565"><Label>(iii)</Label><Text>the application to extend time was made to the Minister as soon as circumstances permitted it to be made.</Text></Subparagraph></Paragraph><Provision lims:inforce-start-date="2014-02-07" lims:fid="708566" lims:id="708566" format-ref="indent-0-0" language-align="no" list-item="no"><Label>*</Label><Text>Subsection 195(1) of the <XRefExternal reference-type="act" link="E-14.1">Excise Act, 2001</XRefExternal> provides:</Text><Provision lims:inforce-start-date="2014-02-07" lims:fid="708567" lims:id="708567" format-ref="indent-0-0" language-align="no" list-item="no"><Label>“195. (1)</Label><Text>Any person who has been assessed and who objects to the assessment may, within 90 days after the date of the notice of the assessment, file with the Minister a notice of objection in the prescribed form and manner setting out the reasons for the objection and all relevant facts.”</Text></Provision></Provision></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="708568" lims:id="708568"><Label>(6)</Label><Text>The application pursuant to subsection (1) is deemed to have been filed on the date of its receipt by the Registry, even if the application is not accompanied by the documents listed in subsection (3), provided that those documents are filed within 30 days after that date or within any reasonable time that the Court establishes.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-02-07" lims:fid="708570" lims:id="708570">SOR/2007-147, s. 5; SOR/2014-26, s. 53</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2014-02-07" lims:lastAmendedDate="2014-02-07" lims:fid="708571" lims:id="708571"><Label>20</Label><Subsection lims:inforce-start-date="2014-02-07" lims:fid="708572" lims:id="708572"><Label>(1)</Label><Text>An application for an order extending the time within which an appeal may be instituted may be in the form set out in Schedule 20.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="708573" lims:id="708573"><Label>(2)</Label><Text>An application under subsection (1) shall be made by filing with the Registrar, in the manner provided in section 4.1, three copies of the application accompanied by three copies of the notice of appeal.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="708574" lims:id="708574"><Label>(3)</Label><Text>No application shall be granted under this section to a person unless</Text><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="708575" lims:id="708575"><Label>(a)</Label><Text>the application is made within one year after the expiration of 90 days after the day on which the notice was sent to the person informing the person that the Minister has confirmed the assessment or has reassessed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="708576" lims:id="708576"><Label>(b)</Label><Text>the person demonstrates that</Text><Subparagraph lims:inforce-start-date="2014-02-07" lims:fid="708577" lims:id="708577"><Label>(i)</Label><Text>within the 90-day period specified in paragraph (a), the person</Text><Clause lims:inforce-start-date="2014-02-07" lims:fid="708578" lims:id="708578"><Label>(A)</Label><Text>was unable to act or to give a mandate to act in the person’s name, or</Text></Clause><Clause lims:inforce-start-date="2014-02-07" lims:fid="708579" lims:id="708579"><Label>(B)</Label><Text>had a <Language xml:lang="la">bona fide</Language> intention to appeal,</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2014-02-07" lims:fid="708580" lims:id="708580"><Label>(ii)</Label><Text>given the reasons set out in the application and the circumstances of the case, it would be just and equitable to grant the application,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-02-07" lims:fid="708581" lims:id="708581"><Label>(iii)</Label><Text>the application was made as soon as circumstances permitted it to be made, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-02-07" lims:fid="708582" lims:id="708582"><Label>(iv)</Label><Text>there are reasonable grounds for appealing from the assessment.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="708583" lims:id="708583"><Label>(4)</Label><Text>The application pursuant to subsection (1) is deemed to have been filed on the date of its receipt by the Registry, even if the application is not accompanied by the notice of appeal referred to in subsection (2), provided that the notice of appeal is filed within 30 days after that date or within any reasonable time that the Court establishes.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-02-07" lims:fid="708585" lims:id="708585">SOR/2007-147, s. 6; SOR/2014-26, s. 54</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="708586" lims:id="708586" level="1"><TitleText>Judgments on Admissions or Certain Documentary Evidence</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708587" lims:id="708587"><Label>21</Label><Text>A party may, at any stage of a proceeding, apply for judgment in respect of any matter</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708588" lims:id="708588"><Label>(a)</Label><Text>on any admission in the pleadings or other documents filed in the Court, or in the examination of another party, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708589" lims:id="708589"><Label>(b)</Label><Text>in respect of which the only evidence consists of documents and such affidavits as are necessary to prove the execution or identity of such documents,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="708590" lims:id="708590"><Text>without waiting for the determination of any other question between the parties.</Text></ContinuedSectionSubsection></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="708591" lims:id="708591" level="1"><TitleText>Subpoena</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708592" lims:id="708592"><Label>22</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708593" lims:id="708593"><Label>(1)</Label><Text>A party who requires the attendance of a person as a witness at a hearing may serve the person with a subpoena requiring the person to attend the hearing at the time and place stated in the subpoena, and the subpoena may also require the person to produce at the hearing the documents or other things in the person’s possession, control or power relating to the matters in question in the appeal that are specified in the subpoena.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708594" lims:id="708594"><Label>(2)</Label><Text>On the request of a party or of counsel, the Registrar or some other person authorized by the Chief Justice, shall sign, seal and issue a blank subpoena, and the party or counsel may complete the subpoena and insert the names of any number of witnesses.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708595" lims:id="708595"><Label>(3)</Label><Text>A subpoena shall be served on a witness personally and, at the same time, witness fees and expenses in accordance with section 13 shall be paid or tendered to the witness.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="708596" lims:id="708596" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708597" lims:id="708597"><Label>23</Label><Text>Subject to any order that the Court, in special circumstances, may make restricting access to a particular file by persons other than the parties to a matter before the Court, any person may, subject to appropriate supervision, and when the facilities of the Court permit without interfering with the ordinary work of the Court,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708598" lims:id="708598"><Label>(a)</Label><Text>inspect any Court file relating to a matter before the Court; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708599" lims:id="708599"><Label>(b)</Label><Text>on payment of $0.40 per page, obtain a photocopy of any document on a Court file.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708600" lims:id="708600"><Label>24</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708601" lims:id="708601"><Label>(1)</Label><Text>Failure to comply with these Rules shall not render any proceedings void unless the Court so directs, but such proceedings may be set aside either in whole or in part as irregular and may be amended or otherwise dealt with in such manner and upon such terms as, in the opinion of the Court, the circumstances of the case require.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708602" lims:id="708602"><Label>(2)</Label><Text>Where a person makes an application to set aside a proceeding for irregularity, the objections intended to be put forward shall be stated clearly in the application.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708603" lims:id="708603"><Label>(3)</Label><Text>The Court may, where and as necessary in the interests of justice, dispense with compliance with any rule at any time.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708604" lims:id="708604"><Label>(4)</Label><Text>Where matters are not provided for in these rules, the practice shall be determined by the Court, either on a motion for directions or after the event if no such motion has been made.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="708605" lims:id="708605" level="1"><TitleText>Contempt of Court</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="708606" lims:id="708606"><Label>25</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="708607" lims:id="708607"><Label>(1)</Label><Text>A person is guilty of contempt of court who</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708608" lims:id="708608"><Label>(a)</Label><Text>at a hearing of the Court fails to maintain a respectful attitude, remain silent or refrain from showing approval or disapproval of the proceeding;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708609" lims:id="708609"><Label>(b)</Label><Text>wilfully disobeys a process or order of the Court;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708610" lims:id="708610"><Label>(c)</Label><Text>acts in such a way as to interfere with the orderly administration of justice or to impair the authority or dignity of the Court;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708611" lims:id="708611"><Label>(d)</Label><Text>is an officer of the Court and fails to perform his or her duties;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="708612" lims:id="708612"><Label>(e)</Label><Text>is a sheriff or bailiff and does not execute a writ forthwith or does not make a return thereof;
