(<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="713188" lims:id="713188" generate-in-text="no"><Text><DefinedTermEn>specially imported firearm</DefinedTermEn> means a firearm imported on a temporary basis by a business that holds a firearms licence, as a good under tariff item No. 9993.00.00 of the List of Tariff Provisions set out in the schedule to the <XRefExternal reference-type="act" link="C-54.011">Customs Tariff</XRefExternal>. (<DefinedTermFr>arme à feu d’importation spéciale</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="713189" lims:id="713189"><Label>(2)</Label><Text>In these Regulations, <DefinitionRef>agency firearm</DefinitionRef>, <DefinitionRef>protected firearm</DefinitionRef>, <DefinitionRef>public agent</DefinitionRef> and <DefinitionRef>public service agency</DefinitionRef> have the same meaning as in section 1 of the <XRefExternal reference-type="regulation" link="SOR-98-203">Public Agents Firearms Regulations</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="713190" lims:id="713190"><Label>(3)</Label><Text>For greater certainty, in these Regulations, <DefinitionRef>transfer</DefinitionRef> means transfer as defined in subsection 84(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="713191" lims:id="713191" level="1"><TitleText>Marking of Manufactured Firearms</TitleText></Heading><Section in-force="no" lims:enacted-date="2006-03-22" lims:fid="713192" lims:id="713192"><Label>2</Label><Text>Every individual or business that manufactures a firearm shall ensure that the firearm is marked, at the time of manufacture, in accordance with section 4.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="713193" lims:id="713193" level="1"><TitleText>Marking of Imported Firearms</TitleText></Heading><Section in-force="no" lims:enacted-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="713194" lims:id="713194"><Label>3</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="713195" lims:id="713195"><Label>(1)</Label><Text>Every individual, business or public service agency that imports a firearm shall ensure that the firearm is marked in accordance with section 4 before the 60th day after its release as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal> or before transferring the firearm, whichever occurs first.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="713196" lims:id="713196"><Label>(2)</Label><Text>Subsection (1) does not apply to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713197" lims:id="713197"><Label>(a)</Label><Text>a firearm imported by an individual under section 35 or 35.1 of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713198" lims:id="713198"><Label>(b)</Label><Text>a specially imported firearm;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713199" lims:id="713199"><Label>(c)</Label><Text>a protected firearm;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713200" lims:id="713200"><Label>(d)</Label><Text>a firearm that was initially exported from Canada by an individual or business if the individual or business retained ownership of the firearm while the firearm was outside Canada; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713201" lims:id="713201"><Label>(e)</Label><Text>a firearm that was initially exported from Canada by a public service agency and that was retained by that agency as an agency firearm while the firearm was outside Canada.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="713202" lims:id="713202" level="1"><TitleText>Manner of Marking</TitleText></Heading><Section in-force="no" lims:enacted-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="713203" lims:id="713203"><Label>4</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="713204" lims:id="713204"><Label>(1)</Label><Text>The firearm shall be marked by permanently stamping or engraving on the firearms’s frame or receiver the word “Canada” or the letters “CA” and</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713205" lims:id="713205"><Label>(a)</Label><Text>in the case of a manufactured firearm, the name of the manufacturer and the firearm’s serial number; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713206" lims:id="713206"><Label>(b)</Label><Text>in the case of an imported firearm, the last two digits of the year of the importation.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="713207" lims:id="713207"><Label>(2)</Label><Text>The markings shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713208" lims:id="713208"><Label>(a)</Label><Text>be legible;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713209" lims:id="713209"><Label>(b)</Label><Text>have a depth of at least 0.076 mm and a height of at least 1.58 mm; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713210" lims:id="713210"><Label>(c)</Label><Text>subject to subsection (3), be visible without the need to disassemble the firearm.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="713211" lims:id="713211"><Label>(3)</Label><Text>In the case of an imported firearm, the Registrar, on application by the individual, business or public service agency that is importing it, shall grant the applicant an exemption from the requirement set out in paragraph (2)(c) if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713212" lims:id="713212"><Label>(a)</Label><Text>marking the firearm in a place that is visible only by disassembling the firearm is consistent with the current practices of the manufacturer of that model of firearm;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713213" lims:id="713213"><Label>(b)</Label><Text>the firearm does not provide a visible space suitable to stamp or engrave the markings;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713214" lims:id="713214"><Label>(c)</Label><Text>the firearm is rare;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713215" lims:id="713215"><Label>(d)</Label><Text>the firearm is of a value that is unusually high for that type of firearm and that value would be significantly reduced if the markings were visible without disassembly; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="713216" lims:id="713216"><Label>(e)</Label><Text>the firearm is imported by a business that holds a licence for the purpose of using the firearm in respect of motion picture, television, video or theatrical productions or in publishing activities.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="713217" lims:id="713217" level="1"><TitleText>Tampering with Markings</TitleText></Heading><Section in-force="no" lims:enacted-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="713218" lims:id="713218"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="713219" lims:id="713219"><Label>(1)</Label><Text>No person shall knowingly remove, alter, obliterate or deface a marking on a firearm.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="713220" lims:id="713220"><Label>(2)</Label><Text>Subsection (1) does not apply to a public agent acting in the course of their duties or for the purposes of their employment.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="713221" lims:id="713221" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2025-11-06" lims:enacted-date="2025-11-06" lims:lastAmendedDate="2025-11-06" lims:fid="713222" lims:id="1544939"><Label>6</Label><Text>These Regulations come into force on December 1, 2027.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-11-09" lims:fid="713224" lims:id="713224">SOR/2005-242, s. 1;
