lims:id="1508609"><Text><DefinedTermEn>acting appointment</DefinedTermEn> means an appointment for the temporary performance of the duties of another position by an employee, if the assignment to the employee of those duties constitutes a <DefinitionRef>promotion</DefinitionRef> within the meaning of section 3 of the <XRefExternal reference-type="regulation" link="SOR-2005-376">Definition of Promotion Regulations</XRefExternal>. (<DefinedTermFr>nomination intérimaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-07-01" lims:fid="720472" lims:id="720472" generate-in-text="no"><Text><DefinedTermEn>bilingual position</DefinedTermEn> means a position identified by the deputy head as one for which the work to be performed requires proficiency in both official languages. (<DefinedTermFr>poste bilingue</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-07-01" lims:fid="720473" lims:id="720473" generate-in-text="no"><Text><DefinedTermEn>common-law partner</DefinedTermEn>, in relation to an individual, means a person who is cohabiting with the individual in a conjugal relationship, having so appointment process within the Research and University Teaching Groups, if there is a career progression framework established by the deputy head in consultation with the authorized bargaining agents that includes an independent recourse mechanism, is an incumbent-based process.</Text></Section><Heading lims:inforce-start-date="2015-07-01" lims:fid="720483" lims:id="720483" level="1"><TitleText>Priorities</TitleText></Heading><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="720484" lims:id="720484"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="720485" lims:id="720485">Exclusion from statutory priority rights</MarginalNote><Label>3</Label><Text>A member of a designated group, within the meaning of section 3 of the <XRefExternal reference-type="act" link="E-5.401">Employment Equity Act</XRefExternal>, may be appointed, in accordance with an employment equity program, without regard to any entitlement to appointment in priority established under sections 39.1 and 40 and subsections 41(1) and (4) of the Act, unless the person who is entitled to appointment in priority in accordance with those provisions is also a member of a designated group, within the meaning of section 3 of the <XRefExternal reference-type="act" link="E-5.401">Employment Equity Act</XRefExternal>, to which the Veterans Affairs determines are attributable to service are entitled to the priority for appointment provided under section 39.1 of the Act:</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="720499" lims:id="720499"><Label>(a)</Label><Text>a member of the regular force;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="720500" lims:id="720500"><Label>(b)</Label><Text>a member of the reserve force; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="720501" lims:id="720501"><Label>(c)</Label><Text>a member of the special force.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="720502" lims:id="720502"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="720503" lims:id="720503">Conditions</MarginalNote><Label>(2)</Label><Text>Subject to subsection (3), the priority applies if</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="720504" lims:id="720504"><Label>(a)</Label><Text>the person requests the priority within five years after the day on which the person is released, regardless of whether the determination referred to in subsection (1) is still pending on the day on which the request is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="720505" lims:id="720505"><Label>(b)</Label><Text>the person is not employed in the public service for an indeterminate period at the time the request is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="720506" lims:id="720506"><Label>(c)</Label><Text>within five years after the day on which the person is released, the person is certified by a competent authority to be ready to return to work on the day specified by the authority; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="720507" lims:id="720507"><Label>(d)</Label><Text>the day specified is within five years after the day on which the person is released.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="720508" lims:id="720508"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="720509" lims:id="720509">Alternative condition</MarginalNote><Label>(3)</Label><Text>The priority applies if, on the day on which the Minister of Veterans Affairs determines that the person was released for medical reasons that are attributable to service, the person had an entitlement to a priority for appointment under section 8.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="720510" lims:id="720510"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="720511" lims:id="720511">Beginning of entitlement period</MarginalNote><Label>(4)</Label><Text>The entitlement period begins on</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="720512" lims:id="720512"><Label>(a)</Label><Text>if the priority is applicable under subsection (2), the later of the day on which the person is ready to return to work, as certified by a competent authority, and the day on which the Minister of Veterans Affairs determines that the person was released for medical reasons that are attributable to service; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="720513" lims:id="720513"><Label>(b)</Label><Text>if the priority is applicable under subsection (3), the day on which the Minister of Veterans Affairs determines that the person was released for medical reasons that are attributable to service.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="720514" lims:id="720514"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="720515" lims:id="720515">End of entitlement period</MarginalNote><Label>(5)</Label><Text>The entitlement period ends on the earliest of</Text><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="720516" lims:id="1527381"><Label>(a)</Label><Text>the fifth anniversary of the day on which the entitlement period begins under subsection (4);</Text></Paragraph><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="720517" lims:id="1527382"><Label>(b)</Label><Text>the day on which the person is appointed to a position in the public service for an indeterminate period;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="720518" lims:id="1527383"><Label>(c)</Label><Text>the day on which the person declines an appointment to a position in the public service for an indeterminate period without good and sufficient reason; and</Text></Paragraph><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527378" lims:id="1527378"><Label>(d)</Label><Text>if the person is employed in the public service for a specified term,</Text><Subparagraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527379" lims:id="1527379"><Label>(i)</Label><Text>the day on which their period of employment is converted to indeterminate in their substantive position under subsection 59(1) of the Act, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527380" lims:id="1527380"><Label>(ii)</Label><Text>the day on which they request of the deputy head, without good and sufficient reason, that their period of employment continue to be for a specified term despite subsection 59(1) of the appointment in priority to all persons, other than those referred to in sections 39.1 and 40 and subsections 41(1) and (4) of the Act, to any position in the public service for which the Commission is satisfied that the employee meets the essential qualifications referred to in paragraph 30(2)(a) of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="720524" duties</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2015-07-01" lims:fid="720534" lims:id="720534"><Label>(1)</Label><Text lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1505535" lims:id="1527393">An employee referred to in subsection (4) who, as a result of a disability, is no longer able to carry out the duties of their position is entitled to appointment in priority to all persons, other than those referred to in sections 39.1 and 40 and subsections 41(1) and (4) of the Act, to any position in the public service for which the Commission is satisfied that the employee meets the essential qualifications referred to in paragraph 30(2)(a) of the Act if</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="720535" lims:id="720535"><Label>(a)</Label><Text>within five years after the day on which the employee became disabled, the employee is certified by a competent authority to be ready to return to work on the day specified by the authority; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="720536" lims:id="720536"><Label>(b)</Label><Text>the day specified is within five years after the day on which the employee became disabled.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="720537" lims:id="720537"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="720538" lims:id="720538">Entitlement period</MarginalNote><Label>(2)</Label><Text>The entitlement period begins on the day on which the employee is ready to return to work, as certified by a competent authority, and ends on the earliest of</Text><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="720539" lims:id="1527397"><Label>(a)</Label><Text>the fifth anniversary of the day on which the entitlement period begins;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="720540" lims:id="1527398"><Label>(b)</Label><Text>the day on which the employee is appointed or deployed to a position in the public service for an indeterminate period;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="720541" lims:id="1527399"><Label>(c)</Label><Text>the day on which the employee declines an appointment or deployment to a position in the public service for an indeterminate period without good and sufficient reason; and</Text></Paragraph><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527394" lims:id="1527394"><Label>(d)</Label><Text>if the employee is employed in the public service for a specified term,</Text><Subparagraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527395" lims:id="1527395"><Label>(i)</Label><Text>the day on which their period of employment is converted to indeterminate in their substantive position under subsection 59(1) of the Act, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527396" lims:id="1527396"><Label>(ii)</Label><Text>the day on which they request of the deputy head, without good and sufficient reason, that their period of employment continue to be for a specified term despite subsection 59(1) of the Act.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="720542" lims:id="720542"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="720543" lims:id="720543">Entitlement continues</MarginalNote><Label>(3)</Label><Text>The entitlement under subsection (1) continues even if, as a result of the person’s disability, they cease to be an employee.</Text></Subsection><Subsection lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527389" lims:id="1527389"><MarginalNote lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527390" lims:id="1527390">Additional entitlement period</MarginalNote><Label>(3.1)</Label><Text>A person whose entitlement under subsection (1) ended within the period beginning on April 1, 2022 and ending on March 31, 2025 as a result of the operation of paragraph (2)(a), as that provision read on March 31, 2025, is entitled to an additional entitlement period that begins on April 1, 2025 and ends on the earliest of</Text><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527391" lims:id="1527391"><Label>(a)</Label><Text>April 1, 2028, and</Text></Paragraph><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527392" lims:id="1527392"><Label>(b)</Label><Text>the earliest day on which any of the events referred to in paragraphs (2)(b) to (d) occurs, with the word “employee” in those paragraphs being read as and</Text></Paragraph><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527364" lims:id="1527364"><Label>(b)</Label><Text>an employee referred to in subsection 7(1) or 9(1) who holds a substantive position that is at a lower level than the position they held immediately before they became entitled to priority under one of those provisions, if their period of employment in that position has been converted to indeterminate under subsection 59(1) of the Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527354" lims:id="1527354"><MarginalNote lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527355" lims:id="1527355">Eligible positions</MarginalNote><Label>(1.1)</Label><Text>The position must be at a level that is</Text><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-12-30" lims:fid="1527356" lims:id="1527356"><Label>(a)</Label><Text>higher than the employee’s current position; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="720709" lims:id="720709"><Label>(d)</Label><Text>encourage the adoption or continuance of proper employment practices.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="720710" lims:id="720710"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="720711" lims:id="720711">Privacy interests</MarginalNote><Label>(2)</Label><Text>Prior to a disclosure under subsection (1) that could infringe privacy interests, the Commission shall consider whether the public interest in disclosure outweighs those privacy interests.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2025-01-29" lims:fid="720712" lims:id="720712"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="720713" lims:id="720713">Disclosure of standardized test</MarginalNote><Label>20</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="720714" lims:id="720714"><Label>(1)</Label><Text>The Commission shall not disclose a standardized test, or information concerning a standardized test, owned by an organization or the Commission or that is commercially available, if obtained in the course of an investigation under the Act, unless it can be disclosed, with or without conditions set by the Commission, in a manner that will not affect the validity or continued use of the standardized test or will not affect the results of such a test by giving an unfair advantage to any person.</Text></Subsection><Subsection lims:inforce-start-date="2025-01-29" lims:enacted-date="2024-12-30" lims:fid="720715" lims:id="1508617"><MarginalNote lims:inforce-start-date="2025-01-29" lims:enacted-date="2024-12-30" lims:fid="1508618" lims:id="1508618">Standardized test</MarginalNote><Label>(2)</Label><Text>For the purpose of subsection (1), a standardized test is a systematic procedure for sampling an individual’s behaviour in order to assess job-relevant characteristics. The procedure is systematic in five areas: development, content, administration, scoring and communication of results. The content of the test is equivalent for all test-takers. and</Text></Paragraph><Paragraph lims:inforce-start-date="2025-01-29" lims:enacted-date="2024-12-30" lims:fid="1508646" lims:id="1508646"><Label>(c)</Label><Text>the opportunity to request accommodation measures and the process for doing so.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2025-01-29" lims:enacted-date="2024-12-30" lims:fid="1508647" lims:id="1508647"><MarginalNote lims:inforce-start-date="2025-01-29" lims:enacted-date="2024-12-30" lims:fid="1508648" lims:id="1508648">Assessment methods</MarginalNote><Label>(4)</Label><Text>The deputy head may, subject to subsections (5) and (6), use any assessment method that they consider appropriate, such as a review of past performance and accomplishments, interviews and examinations, to assess the employees.</Text></Subsection><Subsection lims:inforce-start-date="2025-01-29" lims:enacted-date="2024-12-30" lims:fid="1508649" lims:id="1508649"><MarginalNote lims:inforce-start-date="2025-01-29" lims:enacted-date="2024-12-30" lims:fid="1508650" lims:id="1508650">Identification of biases and barriers</MarginalNote><Label>(5)</Label><Text>Before using an assessment method, the deputy head must conduct an evaluation to identify whether the assessment method and the manner in which it will be applied includes or creates biases or barriers that disadvantage persons belonging to any equity-seeking group and, if a bias or barrier is identified, make reasonable efforts to remove it or to mitigate its impact on those persons.</Text></Subsection><Subsection lims:inforce-start-date="2025-01-29" lims:enacted-date="2024-12-30" lims:fid="1508651" lims:id="1508651"><MarginalNote lims:inforce-start-date="2025-01-29" lims:enacted-date="2024-12-30" lims:fid="1508652" lims:id="1508652">Second language assessment</MarginalNote><Label>(6)</Label><Text>Any assessment of an employee’s proficiency in their second official language must be conducted using the same methods as apply to appointments to or from within the public service.</Text></Subsection><Subsection lims:inforce-start-date="2025-01-29" lims:enacted-date="2024-12-30" lims:fid="1508653" lims:id="1508653"><MarginalNote lims:inforce-start-date="2025-01-29" lims:enacted-date="2024-12-30" lims:fid="1508654" lims:id="1508654">Language of examination or interview</MarginalNote><Label>(7)</Label><Text>Any examination or interview must</Text><Paragraph lims:inforce-start-date="2025-01-29" lims:enacted-date="2024-12-30" lims:fid="1508655" lims:id="1508655"><Label>(a)</Label><Text>except in the case referred to in paragraph (b), be conducted in English or French or both at the option of the employee;
