Whereas, pursuant to subsection 16.1(1)a of the Motor Vehicle Transport Actb, the Minister of Transport has consulted with each province affected by the proposed Conditions of Carriage Regulations;Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to subsection 16.1(1)a of the Motor Vehicle Transport Actb, hereby makes the annexed Conditions of Carriage Regulations.S.C. 2001, c. 13, s. 6R.S., c. 29 (3rd Supp.); S.C. 2001, c. 13, s. 1Conditions of Carriage and Limitations of LiabilitySubject to subsection (2), the conditions of carriage and limitations of liability that apply to transport by an extra-provincial truck undertaking are those set out in the laws of the province in which the transport originates, as amended from time to time, that are applicable to transport by a motor carrier undertaking within that province.For greater certainty, in the absence of a provincial enactment dealing specifically with conditions of carriage and limitations of liability, the conditions of carriage and limitations of liability that apply to transport by an extra-provincial truck undertaking are those agreed to by the undertaking.Coming into ForceThese Regulations come into force on the day on which An Act to amend the Motor Vehicle Transport Act, 1987 and to make consequential amendments to other Acts, chapter 13 of the Statutes of Canada, 2001, comes into force.[Note: Regulations in force January 1, 2006, see SI/2005-58.]
