﻿<?xml version="1.0" encoding="utf-8"?><Regulation lims:pit-date="2009-02-05" hasPreviousVersion="true" lims:lastAmendedDate="2009-02-05" lims:current-date="2019-06-21" lims:inforce-start-date="2008-02-28" lims:fid="747625" lims:id="747625" gazette-part="II" regulation-type="SOR" xml:lang="en" xmlns:lims="http://justice.gc.ca/lims"><Identification lims:inforce-start-date="2008-02-28" lims:fid="747626" lims:id="747626"><InstrumentNumber>SOR/2008-45</InstrumentNumber><RegistrationDate><Date><YYYY>2008</YYYY><MM>2</MM><DD>28</DD></Date></RegistrationDate><ConsolidationDate lims:inforce-start-date="2008-02-28"><Date><YYYY>2019</YYYY><MM>6</MM><DD>22</DD></Date></ConsolidationDate><EnablingAuthority lims:inforce-start-date="2008-02-28" lims:fid="747628" lims:id="747628"><XRefExternal reference-type="act" link="E-19">EXPORT AND IMPORT PERMITS ACT</XRefExternal></EnablingAuthority><LongTitle lims:inforce-start-date="2008-02-28" lims:fid="747629" lims:id="747629">Exemption Regulations (Persons)</LongTitle><RegulationMakerOrder><RegulationMaker>P.C.</RegulationMaker><OrderNumber>2008-403</OrderNumber><Date><YYYY>2008</YYYY><MM>2</MM><DD>28</DD></Date></RegulationMakerOrder></Identification><Order lims:inforce-start-date="2008-02-28" lims:fid="747630" lims:id="747630"><Provision lims:inforce-start-date="2008-02-28" lims:fid="747631" lims:id="747631" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Her Excellency the Governor General in Council, on the recommendation of the Minister of Foreign Affairs, pursuant to paragraph 12(e)<FootnoteRef idref="fna_e">a</FootnoteRef> of the <XRefExternal reference-type="act" link="E-19">Export and Import Permits Act</XRefExternal>, hereby makes the annexed <XRefExternal reference-type="act">Exemption Regulations (Persons)</XRefExternal>.</Text><Footnote id="fna_e" placement="page"><Label>a</Label><Text>S.C. 2004, c. 15, s. 58</Text></Footnote></Provision></Order><Body lims:inforce-start-date="2008-02-28" lims:fid="747632" lims:id="747632"><Heading lims:inforce-start-date="2008-02-28" lims:fid="747633" lims:id="747633" level="1"><TitleText>Exemption</TitleText></Heading><Section lims:inforce-start-date="2009-02-05" lims:lastAmendedDate="2009-02-05" lims:fid="747634" lims:id="747634"><Label>1</Label><Text>The following persons are exempt from the provisions of the <XRefExternal reference-type="act" link="E-19">Export and Import Permits Act</XRefExternal> while acting in the course of their employment:</Text><Paragraph lims:inforce-start-date="2009-02-05" lims:fid="747635" lims:id="747635"><Label>(a)</Label><Text>employees of a foreign state who, for the purpose of ensuring public safety or security, carry goods in the course of their employment when entering or exiting Canada for which permits are required under the <XRefExternal reference-type="act" link="E-19">Export and Import Permits Act</XRefExternal> and whose duties and functions are described in an arrangement or commitment between the foreign state and the Government of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-02-05" lims:fid="747636" lims:id="747636"><Label>(b)</Label><Text>members of the Correctional Service of Canada who are designated as peace officers under section 10 of the <XRefExternal reference-type="act" link="C-44.6">Corrections and Conditional Release Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-02-05" lims:fid="747637" lims:id="747637"><Label>(c)</Label><Text>police officers or police constables who are members of a police force in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-02-05" lims:fid="747638" lims:id="747638"><Label>(d)</Label><Text>persons designated as fishery officers under the <XRefExternal reference-type="act" link="F-14">Fisheries Act</XRefExternal> when performing any duties or functions under that Act or the <XRefExternal reference-type="act" link="C-33">Coastal Fisheries Protection Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-02-05" lims:fid="747639" lims:id="747639"><Label>(e)</Label><Text>employees of the Canadian Coast Guard;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-02-05" lims:fid="747640" lims:id="747640"><Label>(f)</Label><Text>persons designated under section 6 of the <XRefExternal reference-type="act" link="M-7.01">Migratory Birds Convention Act, 1994</XRefExternal>, section 11 of the <XRefExternal reference-type="act" link="W-9">Canada Wildlife Act</XRefExternal>, section 12 of the <XRefExternal reference-type="act" link="W-8.5">Wild Animal and Plant Protection and Regulation of International and Interprovincial Trade Act</XRefExternal> or section 85 of the <XRefExternal reference-type="act" link="S-15.3">Species at Risk Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2009-02-05" lims:fid="747641" lims:id="747641"><Label>(g)</Label><Text>persons referred to in paragraph (d) or (d.1) of the definition <DefinedTermEn>peace officer</DefinedTermEn> in section 2 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> and persons referred to in paragraph (b) or (f) of the definition <DefinedTermEn>public officer</DefinedTermEn> in subsection 117.07(2) of that Act.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2009-02-05" lims:fid="747643" lims:id="747643">SOR/2009-29, s. 1(F)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2008-02-28" lims:fid="747644" lims:id="747644" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2008-02-28" lims:lastAmendedDate="2008-02-28" lims:fid="747645" lims:id="747645"><Label>2</Label><Text>These Regulations come into force on the day on which they are registered.</Text></Section></Body></Regulation>
