lims:inforce-start-date="2014-11-28" lims:fid="807603" lims:id="807603" generate-in-text="no"><Text><DefinedTermEn>average annual daily railway movements</DefinedTermEn> means the number of movements of engines, or engines coupled with railway equipment, across a grade crossing in a year, divided by the number of days in that year. (<DefinedTermFr>moyenne annuelle de mouvements ferroviaires surface</DefinedTermEn> means the part of a road that lies between the ends of a railway tie and that has the width shown in Figure 5-1 of the Grade Crossings Standards. (<DefinedTermFr>surface de lims:id="1328626"><Text><DefinedTermEn>cross-product</DefinedTermEn> means the product of the average annual daily railway movements and the average annual daily traffic. (<DefinedTermFr>produit vehicle</DefinedTermEn> means one of the vehicles shown in Figures 1.2.4.1 to 1.2.4.11 of the <XRefExternal reference-type="standard">Geometric Design Guide for Canadian Roads</XRefExternal>, published by the Transportation Association of Canada and dated September 1999. (<DefinedTermFr>véhicule type</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="807607" lims:id="807607" generate-in-text="no"><Text><DefinedTermEn>Emergency Notification sign</DefinedTermEn> means the sign referred to in article 8.5 of the Grade Crossings Standards. (<DefinedTermFr>panneau Avis d’urgence</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="807608" lims:id="1328687" generate-in-text="no"><Text><DefinedTermEn>existing grade crossing</DefinedTermEn> means a grade crossing for which actual construction is started before November 28, 2014. (<DefinedTermFr>passage à niveau existant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="807609" lims:id="807609" generate-in-text="no"><Text><DefinedTermEn>grade crossing</DefinedTermEn> means a road crossing at grade, or two or more road crossings at grade where the lines of railway are not separated by more than 30 m. (<DefinedTermFr>passage à niveau</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-03-01" lims:enacted-date="2018-11-23" lims:fid="807610" lims:id="1116543"><Text><DefinedTermEn>Grade Crossings Standards</DefinedTermEn> means the Grade Crossings Standards published by the Department of Transport and dated January 1, 2019. <DefinedTermFr>(Normes sur les passages à niveau)</DefinedTermFr></Text></Definition><Definition lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328627" lims:id="1328627"><Text><DefinedTermEn>high-priority grade crossing</DefinedTermEn> means a public grade crossing with average annual daily railway movements of 10 or more and a railway design speed of 97 km/h (60 mph) or more. (<DefinedTermFr>passage à niveau de priorité élevée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" <XRefInternal>58</XRefInternal> and <XRefInternal>73</XRefInternal>, the sign referred to in article 4 of Part B of those Standards. (<DefinedTermFr>panneau Nombre de voies authority</DefinedTermEn> means a person, other than a road authority, who has a right with respect to a private grade crossing. (<DefinedTermFr>autorité lims:inforce-start-date="2014-11-28" lims:fid="807616" lims:id="807616" generate-in-text="no"><Text><DefinedTermEn>public grade crossing</DefinedTermEn> means a grade crossing whose road is opened or maintained by a road authority and is designed for public use. (<DefinedTermFr>passage à niveau public</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="807617" lims:id="807617" generate-in-text="no"><Text><DefinedTermEn>Railway Crossing Ahead sign</DefinedTermEn> means the sign referred to in article 8.2.1 of the Grade Crossings Standards. (<DefinedTermFr>panneau Signal avancé d’un passage à niveau</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="807618" lims:id="807618" generate-in-text="no"><Text><DefinedTermEn>Railway Crossing sign</DefinedTermEn> means the sign and post referred to in article 8.1.1 of the Grade Crossings Standards and, for the purposes of sections <XRefInternal>58</XRefInternal> and <XRefInternal>73</XRefInternal>, the sign referred to in article 4 of Part B of those Standards. (<DefinedTermFr>panneau Passage à niveau</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="807619" lims:id="807619" generate-in-text="no"><Text><DefinedTermEn>railway design speed</DefinedTermEn> means the railway equipment speed that corresponds to the current design of the grade crossing. (<DefinedTermFr>vitesse de référence sur la voie ferrée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="807620" lims:id="807620" generate-in-text="no"><Text><DefinedTermEn>road approach</DefinedTermEn> means the part of a road, other than the crossing surface, that lies between the point that marks the start of the stopping sight distance and the point that marks the front of a design vehicle when it is past the clearance point as shown in Figure 10-1 of the Grade Crossings Standards. (<DefinedTermFr>abord routier</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="807621" lims:id="807621" generate-in-text="no"><Text><DefinedTermEn>road crossing design speed</DefinedTermEn> means the motor vehicle speed that corresponds to the current design of the grade crossing. (<DefinedTermFr>vitesse de référence au franchissement routier</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="807622" lims:id="807622" generate-in-text="no"><Text><DefinedTermEn>sightlines</DefinedTermEn> means the sightlines referred to in sections <XRefInternal>20</XRefInternal> and <XRefInternal>21</XRefInternal>, as applicable. (<DefinedTermFr>lignes de visibilité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="807623" lims:id="807623" generate-in-text="no"><Text><DefinedTermEn>Stop Ahead sign</DefinedTermEn> means the sign referred to in article 8.3.1 of the Grade Crossings Standards. (<DefinedTermFr>panneau Signal avancé d’arrêt</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="807624" lims:id="807624" generate-in-text="no"><Text><DefinedTermEn>Stop sign</DefinedTermEn> means the sign referred to in article 8.4.1 of the Grade Crossings Standards. (<DefinedTermFr>panneau Stop</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="807625" lims:id="807625" generate-in-text="no"><Text><DefinedTermEn>stopping sight distance</DefinedTermEn> means the distance calculated in accordance with article 7.2 of the Grade Crossings Standards. (<DefinedTermFr>distance de visibilité distance</DefinedTermEn> means, on a road that crosses a grade crossing, the shortest distance between the rail nearest the road approach of the grade crossing and the edge of the nearest intersecting road, measured along the centre line of the road, as represented by D in Figure 11-1 of the Grade Crossings Standards. (<DefinedTermFr>distance de lims:inforce-start-date="2014-11-28" lims:fid="807628" lims:id="807628"><Label>(b)</Label><Text>a Stop Ahead sign;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="807629" lims:id="807629"><Label>(c)</Label><Text>a Railway Crossing Ahead sign;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="807630" lims:id="807630"><Label>(d)</Label><Text>an Advisory Speed Tab sign;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="807631" lims:id="807631"><Label>(e)</Label><Text>a Prepare to Stop at Railway Crossing sign, including the interconnection with the warning system; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="807632" lims:id="807632"><Label>(f)</Label><Text>a traffic signal, including the interconnection with the warning system. (<DefinedTermFr>dispositif de contrôle de la circulation</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="807633" lims:id="807633" generate-in-text="no"><Text><DefinedTermEn>warning system</DefinedTermEn> means an automated system, other than an interconnected traffic signal, that indicates the approach or presence of railway equipment at a grade crossing and that is composed of any combination of light units, bells, gates, operating mechanisms and circuits. (<DefinedTermFr>système d’avertissement</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="807634" lims:id="807634"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="807635" lims:id="807635">Separate grade crossings</MarginalNote><Label>(2)</Label><Text>For the purposes of these Regulations, two adjacent and separate roads that are used by motor vehicles and that cross one or more lines of railway are considered to be separate grade lims:id="807639"><Label>(1)</Label><Text>These Regulations apply in respect of public grade crossings and private grade crossings.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="807640" lims:id="807640"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="807641" lims:id="807641">Railway company</MarginalNote><Label>(2)</Label><Text>Despite subsection (1), these Regulations do not apply in respect of a private grade crossing if the road is opened or maintained by a railway company that is the sole private authority at the grade crossing.</Text></Subsection><Subsection lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328630" lims:id="1328630"><MarginalNote lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328631" lims:id="1328631">Non-application</MarginalNote><Label>(3)</Label><Text>Despite subsection (1), sections 19 to 96 do not apply in respect of the following grade crossings:</Text><Paragraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328632" lims:id="1328632"><Label>(a)</Label><Text>a public grade crossing where</Text><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328633" lims:id="1328633"><Label>(i)</Label><Text>the average annual daily railway movements is less than three,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328634" lims:id="1328634"><Label>(ii)</Label><Text>the railway design speed is 17 km/h (10 mph) or less,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328635" lims:id="1328635"><Label>(iii)</Label><Text>it does not cross more than one track,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328636" lims:id="1328636"><Label>(iv)</Label><Text>the storage distance is 30 m or more, except if, at the road approach, access is for the exclusive use of pedestrians and non-motor vehicles,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328637" lims:id="1328637"><Label>(v)</Label><Text>whistling is required or permitted when railway equipment is approaching the grade crossing, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328638" lims:id="1328638"><Label>(vi)</Label><Text>the cross-product is less than 2 000;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328639" lims:id="1328639"><Label>(b)</Label><Text>a private grade crossing where</Text><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328640" lims:id="1328640"><Label>(i)</Label><Text>the railway design speed is 17 km/h (10 mph) or less,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328641" lims:id="1328641"><Label>(ii)</Label><Text>it does not cross more than two tracks, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328642" lims:id="1328642"><Label>(iii)</Label><Text>the cross-product is less than 100;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328643" lims:id="1328643"><Label>(c)</Label><Text>a private grade crossing where</Text><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328644" lims:id="1328644"><Label>(i)</Label><Text>the railway design speed for freight trains is 41 km/h (25 mph) or less,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328645" lims:id="1328645"><Label>(ii)</Label><Text>the railway design speed for passenger trains is 49 km/h (30 mph) or less,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328646" lims:id="1328646"><Label>(iii)</Label><Text>it does not cross more than one track,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328647" lims:id="1328647"><Label>(iv)</Label><Text>the storage distance is 30 m or more, except if, at the road approach, access is for the exclusive use of pedestrians and non-motor vehicles,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-26" lims:enacted-date="2021-11-26" lims:fid="1328648" lims:id="1328648"><Label>(v)</Label><Text>the cross-product is less over land in the vicinity of the grade crossing, including the removal of trees and brush that obstruct the sightlines.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="807689" lims:id="807689"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="807690" lims:id="807690">Exception</MarginalNote><Label>7</Label><Text>Despite sections <XRefInternal>5</XRefInternal> and <XRefInternal>6</XRefInternal>, a railway company may make a change referred to in those sections at any time if the road authority has advised the railway company that the requirements of these Regulations with which the road authority must comply with respect to the change are met.</Text></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="807691" lims:id="807691"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="807692" lims:id="807692">Average annual daily railway movements</MarginalNote><Label>8</Label><Text>A railway company must provide a road authority with the average annual daily railway movements when that value is three or more and the value increases by 50% or more relative to the previous value provided to the road authority.</Text></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="807693" lims:id="807693"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="807694" lims:id="807694">Whistling</MarginalNote><Label>9</Label><Text>If a railway company stops requiring the use of a whistle at a grade crossing, it must notify the road authority in writing of that change not later than 30 days after the day on which the change is made.</Text></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="807695" lims:id="807695"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="807696" lims:id="807696">Transfer of line of railway</MarginalNote><Label>10</Label><Text>If a line of railway at a public grade crossing is transferred from one railway company to another, the railway company to which the line of railway is transferred must, within seven days after the day on which the transfer takes effect, provide the road authority with the name, address, telephone number and email address of a contact person.</Text></Section><Section lims:inforce-start-date="2014-11-28" characteristics set out for rural roads in Table 10-3 of those Standards or the characteristics set out for urban roads in Table 10-4 of those Standards, as applicable;</Text></Paragraph><Paragraph article 6.5 of the Grade Crossings Standards;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="807713" lims:id="807713"><Label>(k)</Label><Text>the applicable departure time referred to in article 10.3 of the Grade Crossings Standards;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="807714" lims:id="807714"><Label>(l)</Label><Text>the equipment;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808036" lims:id="808036"><Label>(c)</Label><Text>the parameters for the operation of the components of the warning system;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808037" lims:id="808037"><Label>(d)</Label><Text>the type of light, including the lens deflection angles, if applicable, and the alignment coordinates of the light units; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808038" lims:id="808038"><Label>(e)</Label><Text>the details of any interconnection with a traffic control device.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808039" lims:id="808039"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808040" lims:id="808040">Maintenance of warning system</MarginalNote><Label>(2)</Label><Text>The warning system must conform to the design plan and must be maintained in accordance with article 17.1 of the Grade Crossings Standards.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808041" lims:id="808041"><MarginalNote lims:fid="808063" lims:id="808063"><Label>(1)</Label><Text>It is prohibited for railway equipment to be left standing in a manner that causes the activation of the warning system at a public grade crossing other than for the purpose of crossing that grade crossing.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808064" lims:id="808064"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808065" lims:id="808065">Obstruction of public grade crossing</MarginalNote><Label>(2)</Label><Text>It is prohibited for railway equipment to be left standing on a crossing surface, or for switching operations to be conducted, in a manner that obstructs a public grade crossing — including by the activation of the gate of a warning system — for more than five minutes when vehicular or pedestrian traffic is waiting to cross it.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="808066" lims:id="808066" level="3"><TitleText>Safety Concern</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808067" lims:id="808067"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808068" lims:id="808068">Collaboration</MarginalNote><Label>98</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808069" lims:id="808069"><Label>(1)</Label><Text>If railway equipment is operated in a manner that regularly causes the obstruction of a public grade crossing, including by the activation of a warning system, and the municipality where the grade crossing is located declares in a resolution that obstruction of the grade crossing creates a safety concern, the railway company and the road authority must collaborate to resolve the safety concern.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808070" lims:id="808070"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808071" lims:id="808071">Notice</MarginalNote><Label>(2)</Label><Text>The road authority must notify the Minister and the railway company in writing that the resolution has been passed and must provide them with the information used in support of the resolution, including</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808072" lims:id="808072"><Label>(a)</Label><Text>a detailed description of the safety concern;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808073" lims:id="808073"><Label>(b)</Label><Text>the details of specific occurrences involving the obstruction of the grade crossing, including the date and time of the obstruction; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808074" lims:id="808074"><Label>(c)</Label><Text>the details of the traffic congestion that resulted from each specific occurrence referred to in paragraph (b).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808075" lims:id="808075"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808076" lims:id="808076">Timeline and mediation</MarginalNote><Label>(3)</Label><Text>The railway company and the road authority must attempt to resolve the safety concern — including through the use of mediation — within 90 days after the day on which the road authority notifies the railway company under subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808077" activity</MarginalNote><Label>(2)</Label><Text>Within a reasonable period of time before the activity begins, whichever of the two — the railway company or the road authority — undertakes the activity must provide the other with sufficient details about the activity to determine the necessary protection measures to be put in place.</Text></Subsection></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808099" lims:id="808099"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808100" lims:id="808100">Malfunction, failure or condition</MarginalNote><Label>103</Label><Text>When a railway company or a road authority is advised or becomes aware that a warning system, or a traffic control device that is interconnected with a warning system, has malfunctioned or failed, or that a condition exists that may cause a malfunction or failure, the railway company or the road authority, as the case may be, must</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808101" lims:id="808101"><Label>(a)</Label><Text>notify the other of the malfunction, failure or condition, even if the existence of the malfunction, failure or condition is not confirmed;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808102" lims:id="808102"><Label>(b)</Label><Text>immediately put in place the necessary protection measures to address any threat to, or interference with, the safety of railway operations;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808103" lims:id="808103"><Label>(c)</Label><Text>immediately after putting in place the protection measures, notify the other of those measures; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808104" lims:id="808104"><Label>(d)</Label><Text>within a reasonable period of time, take the necessary measures to restore the use of the grade crossing or remedy the malfunction, failure or condition.</Text></Paragraph></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="808105" lims:id="808105" level="1"><TitleText>Audible Warning</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808106" lims:id="808106"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808107" lims:id="808107">Prescribed requirements</MarginalNote><Label>104</Label><Text>For the purposes of section 23.1 of the <XRefExternal reference-type="act" link="R-4.2">Railway Safety Act</XRefExternal>, the following requirements are prescribed:</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808108" lims:id="808108"><Label>(a)</Label><Text>the area must be located</Text><Subparagraph lims:inforce-start-date="2014-11-28" lims:fid="808109" lims:id="808109"><Label>(i)</Label><Text>within a railway right-of-way, on each side of a public grade crossing, and within 0.4 km from the outer edge of the crossing surface, as shown in Figure D-1 of the Grade Crossings Standards, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-11-28" lims:fid="808110" lims:id="808110"><Label>(ii)</Label><Text>within the road approach;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808111" lims:id="808111"><Label>(b)</Label><Text>the area must have a public grade crossing that has the applicable protection referred to in sections <XRefInternal>105</XRefInternal> to <XRefInternal>107</XRefInternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808112" lims:id="808112"><Label>(c)</Label><Text>the area must not have repeated incidents of unauthorized access to the line of railway; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808113" lims:id="808113"><Label>(d)</Label><Text>the area must not require whistling for a grade crossing located outside the area.</Text></Paragraph></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808114" lims:id="808114"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808115" lims:id="808115">Public grade crossing — motor vehicles</MarginalNote><Label>105</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808116" lims:id="808116"><Label>(1)</Label><Text>A public grade crossing set out in column A of Table D-1 of the Grade Crossings Standards and located in an area referred to in section <XRefInternal>104</XRefInternal> must be equipped with the warning system set out in Table D-1 of the those Standards that corresponds to the number of tracks and the railway design speed set out in that Table, and the warning system must meet the applicable standards set out in articles 12 to 16 of those Standards.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808117" lims:id="808117"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808118" lims:id="808118">Gate</MarginalNote><Label>(2)</Label><Text>If a gate is not indicated as being required in Table D-1 of the Grade Crossings Standards, it is nonetheless required if the grade crossing corresponds to the applicable specifications set out in article 9.2 of those Standards.</Text></Subsection></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808119" lims:id="808119"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808120" lims:id="808120">Public grade crossing — sidewalk, path or trail</MarginalNote><Label>106</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808121" lims:id="808121"><Label>(1)</Label><Text>A public grade crossing set out in column B of Table D-1 of the Grade Crossings Standards and located in an area referred to in section <XRefInternal>104</XRefInternal> must be equipped with the warning system that corresponds to the number of tracks and the railway design speed set out in that Table, and the warning system must meet the applicable standards set out in articles 12 to 16 of those Standards.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808122" lims:id="808122"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808123" lims:id="808123">Gate</MarginalNote><Label>(2)</Label><Text>If a gate is not indicated as being required in Table D-1 of the Grade Crossings Standards, it is nonetheless required if the grade crossing corresponds to the applicable specifications set out in article 9.6 of those Standards.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808124" lims:id="808124"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808125" lims:id="808125">Guide fencing</MarginalNote><Label>(3)</Label><Text>If a warning system without a gate is indicated as being required in Table D-1 of the Grade Crossings Standards, guide fencing must be installed to deter persons from crossing the line of railway other than at the grade crossing.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808126" lims:id="808126"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808127" lims:id="808127">Guide fencing and barriers</MarginalNote><Label>(4)</Label><Text>If a warning system is not indicated as being required in column 5 of Table D-1 of the Grade Crossings Standards, guide fencing must be installed, as well as a barrier that is intended to slow a person’s approach to the grade crossing and to encourage a person to look both ways before crossing the grade crossing.</Text></Subsection></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808128" lims:id="808128"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808129" lims:id="808129">Stop and proceed</MarginalNote><Label>107</Label><Text>Despite sections <XRefInternal>105</XRefInternal> and <XRefInternal>106</XRefInternal>, if railway equipment must stop before proceeding across a public grade crossing that is located in an area referred to in section <XRefInternal>104</XRefInternal> and that is used by motor vehicles,</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808130" lims:id="808130"><Label>(a)</Label><Text>a warning system with flashing lights and bells must be installed at the grade crossing and must meet the applicable standards set out in articles 12 to 16 of the Grade Crossings Standards; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808131" lims:id="808131"><Label>(b)</Label><Text>the railway company must manually protect the grade crossing.</Text></Paragraph></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="808132" lims:id="808132" level="1"><TitleText>Records</TitleText></Heading><Heading lims:inforce-start-date="2014-11-28" lims:fid="808133" lims:id="808133" level="2"><TitleText>Information Sharing</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808134" lims:id="808134"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808135" lims:id="808135">Railway company</MarginalNote><Label>108</Label><Text>A railway company must keep the most recent information provided to a road authority under sections <XRefInternal>4</XRefInternal> to <XRefInternal>11</XRefInternal> and the most recent information received from a road authority under sections <XRefInternal>12</XRefInternal> to which a railway company inspects, tests or maintains a warning system, it must record the following information:</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808140" lims:id="808140"><Label>(a)</Label><Text>the identity of the person who conducts the inspection, testing or maintenance;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808141" lims:id="808141"><Label>(b)</Label><Text>the date of the inspection, testing or maintenance;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808142" lims:id="808142"><Label>(c)</Label><Text>the precise location of the warning system;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808143" lims:id="808143"><Label>(d)</Label><Text>the reason for the inspection, testing or maintenance;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808144" lims:id="808144"><Label>(e)</Label><Text>a description of the inspection, testing or maintenance that is conducted;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808145" lims:id="808145"><Label>(f)</Label><Text>an indication of any malfunction or failure of a component of the warning system; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808146" lims:id="808146"><Label>(g)</Label><Text>an indication of any deviation from the Grade Crossings Standards and the action taken to remedy it.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808147" lims:id="808147"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808148" lims:id="808148">Integrity of record</MarginalNote><Label>(2)</Label><Text>The record must not be changed once it has been created.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808149" lims:id="808149"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808150" lims:id="808150">Duration</MarginalNote><Label>(3)</Label><Text>The record must be kept for two years after the day on which it is created. However, if the Grade Crossings Standards specify an interval of two or more years between each inspection, each test or each maintenance activity, the record of the two latest inspections, tests or maintenance activities must be kept.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="808151" lims:id="808151" level="2"><TitleText>Temporary Protection Measures</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808152" lims:id="808152"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808153" lims:id="808153">Malfunction, failure or condition</MarginalNote><Label>110</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808154" lims:id="808154"><Label>(1)</Label><Text>A railway company must keep a record of any warning system malfunction or failure, or any condition that exists that may cause a malfunction or failure, of which it has been advised or has become aware under section <XRefInternal>103</XRefInternal> — even if the existence of the malfunction, failure or condition is not confirmed — and the record must contain the following information:</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808155" lims:id="808155"><Label>(a)</Label><Text>the nature of the malfunction, failure or condition;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808156" lims:id="808156"><Label>(b)</Label><Text>the precise location of the grade crossing;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808157" lims:id="808157"><Label>(c)</Label><Text>the date and time that the railway company was advised or became aware of the malfunction, failure or condition;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808158" lims:id="808158"><Label>(d)</Label><Text>all of the measures taken by the railway company to address any threat to, or interference with, the safety of railway operations;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808159" lims:id="808159"><Label>(e)</Label><Text>the date and time that a representative of the railway company arrived at the grade crossing to</Text><Subparagraph lims:inforce-start-date="2014-11-28" lims:fid="808160" lims:id="808160"><Label>(i)</Label><Text>take the measures referred to in paragraph (d), and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-11-28" lims:fid="808161" lims:id="808161"><Label>(ii)</Label><Text>remedy the malfunction, failure or condition;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808162" lims:id="808162"><Label>(f)</Label><Text>all the measures taken by the railway company to restore the grade crossing to use or to remedy the malfunction, failure or condition, or the reason why no remedial action was taken, if applicable;
