and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809627" lims:id="809627"><Label>(c)</Label><Text>have the required reliability status or security clearance.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809628" lims:id="809628"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809629" lims:id="809629">Prohibition against entry</MarginalNote><Label>(2)</Label><Text>A member who is subject to an order issued by a court or justice of the peace prohibiting or restricting entry into any place within the policing jurisdiction for which the member is responsible does not possess the basic requirements for the carrying out of their duties.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="809630" lims:id="809630" level="1"><Label>PART 1</Label><TitleText>Stoppage of Pay and Allowances</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809631" lims:id="809631"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809632" lims:id="809632">Definition of <DefinedTermEn>decision maker</DefinedTermEn></MarginalNote><Label>3</Label><Text>For the purpose of this Part, <DefinedTermEn>decision maker</DefinedTermEn> means a member to whom the Commissioner has delegated the power to direct that a member’s pay and allowances be stopped under paragraph 22(2)(a) or (c) of the Act.</Text></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809633" lims:id="809633"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809634" lims:id="809634">Notice to decision maker</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809635" lims:id="809635"><Label>(1)</Label><Text>If a member loses a basic requirement, is absent from duty without authorization or has left any assigned duty without authorization, the person in command of the member’s detachment must notify the decision maker for the member in writing as soon as feasible.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809636" lims:id="809636"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809637" lims:id="809637">Member recommended for discharge</MarginalNote><Label>(2)</Label><Text>If a member is recommended for discharge under paragraph 20.2(1)(d), (f) or (j) of the Act, the person making the recommendation must immediately notify the decision maker for the member in writing.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809638" lims:id="809638"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809639" lims:id="809639">Service of notice of intent</MarginalNote><Label>(3)</Label><Text>If, on receiving a notification under subsection (1) or (2), the decision maker intends to direct that the member’s pay and allowances be stopped, they must cause to be served on the member a notice to that effect.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809640" lims:id="809640"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809641" lims:id="809641">Contents of notice</MarginalNote><Label>(4)</Label><Text>The notice of intent must</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809642" lims:id="809642"><Label>(a)</Label><Text>set out the grounds on which the decision maker intends to make the decision; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809643" lims:id="809643"><Label>(b)</Label><Text>state that the member may, within 14 days after the day on which the notice is served,</Text><Subparagraph lims:inforce-start-date="2014-11-28" lims:fid="809644" lims:id="809644"><Label>(i)</Label><Text>provide a written response, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-11-28" lims:fid="809645" lims:id="809645"><Label>(ii)</Label><Text>request, in writing, an extension of time to provide a written response.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809646" lims:id="809646"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809647" lims:id="809647">Consideration of response</MarginalNote><Label>(5)</Label><Text>The decision maker must consider any written response before deciding whether to direct that the member’s pay and allowances be stopped.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809648" lims:id="809648"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809649" lims:id="809649">Service of direction</MarginalNote><Label>(6)</Label><Text>If the decision maker directs that a member’s pay and allowances be stopped, the decision maker must make the direction in writing and cause the member to be served with a copy of the direction and the reasons for it.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809650" lims:id="809650"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809651" lims:id="809651">Duration</MarginalNote><Label>(7)</Label><Text>The direction takes effect immediately and remains in effect until the member</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809652" lims:id="809652"><Label>(a)</Label><Text>possesses the basic requirements for the carrying out of their duties, is no longer absent from duty without authorization or has returned to the assigned duty; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809653" lims:id="809653"><Label>(b)</Label><Text>is no longer the subject of the recommendation for discharge referred to in subsection (2).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809654" lims:id="809654"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809655" lims:id="809655">Date of reinstatement of pay and allowances</MarginalNote><Label>(8)</Label><Text>The Commissioner may reinstate the pay and allowances of a member to the date of the stoppage of pay and allowances if the grounds for the stoppage no longer apply and if the circumstances leading to the stoppage were exceptional and beyond the member’s control.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="809656" lims:id="809656" level="1"><Label>PART 2</Label><TitleText>Discharge and Demotion</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809657" lims:id="809657"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809658" lims:id="809658">Definition of <DefinedTermEn>decision maker</DefinedTermEn></MarginalNote><Label>5</Label><Text>For the purpose of this Part, <DefinedTermEn>decision maker</DefinedTermEn> means a person to whom the Commissioner has delegated the power</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809659" lims:id="809659"><Label>(a)</Label><Text>to revoke a person’s appointment under section 9.2 of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809660" lims:id="809660"><Label>(b)</Label><Text>to recommend the discharge of a member under paragraph 20.2(1)(d), (f) or (j) of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809661" lims:id="809661"><Label>(c)</Label><Text>discharge the member under paragraph 20.2(1)(e), (g) or (k) of the Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809662" lims:id="809662"><Label>(d)</Label><Text>demote the member under paragraph 20.2(1)(e) or (g) of the Act.</Text></Paragraph></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809663" lims:id="809663"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809664" lims:id="809664">Reasons other than contravention of Code of Conduct</MarginalNote><Label>6</Label><Text>For the purpose of paragraphs 20.2(1)(f) and (g) of the Act, reasons other than a contravention of any provision of the Code of Conduct include</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809665" lims:id="809665"><Label>(a)</Label><Text>having a disability, as defined in the <XRefExternal reference-type="act" link="H-6">Canadian Human Rights Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809666" lims:id="809666"><Label>(b)</Label><Text>being absent from duty without authorization or having left an assigned duty without authorization;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809667" lims:id="809667"><Label>(c)</Label><Text>being absent from duty as the result of being detained in custody or serving a period of imprisonment;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809668" lims:id="809668"><Label>(d)</Label><Text>being in a conflict of interest other than one set out in the Code of Conduct;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809669" lims:id="809669"><Label>(e)</Label><Text>no longer possessing a basic requirement for the carrying out of a member’s duties; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809670" lims:id="809670"><Label>(f)</Label><Text>being convicted of an offence that is punishable by indictment or that would be punishable by indictment if it occurred in Canada.</Text></Paragraph></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809671" lims:id="809671"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809672" lims:id="809672">Designation of officer or person</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809673" lims:id="809673"><Label>(1)</Label><Text>The Commissioner may designate an officer or a person who holds an equivalent managerial position to be responsible for making a recommendation to a decision maker in respect of</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809674" lims:id="809674"><Label>(a)</Label><Text>a recommendation to discharge a member under paragraph 20.2(1)(d) or (f) of the Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809675" lims:id="809675"><Label>(b)</Label><Text>the discharge or demotion of a member under paragraph 20.2(1)(e) or (g) of the Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809676" lims:id="809676"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809677" lims:id="809677">Recommendation</MarginalNote><Label>(2)</Label><Text>If there is cause to make the recommendation, the designated officer or person must immediately make the recommendation in writing.</Text></Subsection></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809678" lims:id="809678"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809679" lims:id="809679">Notice of intent</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809680" lims:id="809680"><Label>(1)</Label><Text>A decision maker must cause a notice to be served on a member if the decision maker intends</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809681" lims:id="809681"><Label>(a)</Label><Text>to recommend the discharge of the member under paragraph 20.2(1)(d) or (f) of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809682" lims:id="809682"><Label>(b)</Label><Text>to discharge or demote the member under paragraph 20.2(1)(e) or (g) of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809683" lims:id="809683"><Label>(c)</Label><Text>to recommend the discharge of the member under paragraph 20.2(1)(j) of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809684" lims:id="809684"><Label>(d)</Label><Text>to discharge the member under paragraph 20.2(1)(k) of the Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809685" lims:id="809685"><Label>(e)</Label><Text>to take corrective action in respect of an error, an omission or improper conduct that affected the Commissioner’s selection of the member for appointment under subsection 6(4) or 7(1) of the Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809686" lims:id="809686"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809687" lims:id="809687">Request for recusal</MarginalNote><Label>(2)</Label><Text>The member may, within 14 days after the day on which the notice of intent is served, request that the decision maker recuse themselves. The request must be in writing and include reasons.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809688" lims:id="809688"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809689" lims:id="809689">Decision on request for recusal</MarginalNote><Label>(3)</Label><Text>The decision maker must render a decision on the request for recusal as soon as feasible and cause a copy of the decision, including reasons for it, to be served on the member. If the decision maker allows the request, they must ask the Commissioner to select another decision maker.</Text></Subsection></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809690" lims:id="809690"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809691" lims:id="809691">Contents of notice</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809692" lims:id="809692"><Label>(1)</Label><Text>The notice of intent must set out</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809693" lims:id="809693"><Label>(a)</Label><Text>the action referred to in subsection <XRefInternal>8</XRefInternal>(1) that the decision maker intends to take;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809694" lims:id="809694"><Label>(b)</Label><Text>the grounds on which the decision maker intends to make the decision; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809695" lims:id="809695"><Label>(c)</Label><Text>the member’s rights under subsection (2).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809696" lims:id="809696"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809697" lims:id="809697">Member’s rights</MarginalNote><Label>(2)</Label><Text>The member may, within 14 days after the day on which the notice of intent is served,</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809698" lims:id="809698"><Label>(a)</Label><Text>provide a written response and, if one is provided, make a written request, with reasons, for a meeting with the decision maker for the purpose of making oral submissions;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809699" lims:id="809699"><Label>(b)</Label><Text>provide a written response and request, in writing, an extension of time to make the request referred to in paragraph (a); or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809700" lims:id="809700"><Label>(c)</Label><Text>request, in writing, an extension of time to provide the response and make the request referred to in paragraph (a).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809701" lims:id="809701"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809702" lims:id="809702">New information</MarginalNote><Label>(3)</Label><Text>If, after the notice of intent is served but before the decision maker makes a decision under subsection <XRefInternal>12</XRefInternal>(1), new information that may be relevant comes to the attention of the decision maker, the decision maker must cause the member to be served with a copy of that information. The member may, within seven days after the day on which the copy is served,</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809703" lims:id="809703"><Label>(a)</Label><Text>provide a written response and, if one is provided, make a written request, with reasons, for a meeting with the decision maker for the purpose of making oral submissions;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809704" lims:id="809704"><Label>(b)</Label><Text>provide a written response and request, in writing, an extension of time to make the request referred to in paragraph (a); A recommendation to discharge a Deputy Commissioner must be forwarded to the Governor in Council immediately after the expiry of the time referred to in section 36.1 of the Act.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="809737" lims:id="809737" level="1"><Label>PART 3</Label><TitleText>Members on Probation</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809738" lims:id="809738"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809739" lims:id="809739">Definition of <DefinedTermEn>decision maker</DefinedTermEn></MarginalNote><Label>13</Label><Text>For the purpose of this Part, <DefinedTermEn>decision maker</DefinedTermEn> means a member to whom the Commissioner has delegated the power to discharge a member who is on probation.</Text></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809740" lims:id="809740"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809741" lims:id="809741">Probationary period</MarginalNote><Label>14</Label><Text>A member’s probationary period is two years, calculated without including any of the following:</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809742" lims:id="809742"><Label>(a)</Label><Text>a period of leave without pay;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809743" lims:id="809743"><Label>(b)</Label><Text>any hours of leave with pay in excess of a total of 360 hours;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809744" lims:id="809744"><Label>(c)</Label><Text>a period of full-time language training;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809745" lims:id="809745"><Label>(d)</Label><Text>a period of suspension under section 12 of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809746" lims:id="809746"><Label>(e)</Label><Text>a period during which the member is at work but is unable to perform the duties required of a member on probation;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809747" lims:id="809747"><Label>(f)</Label><Text>a period during which the member is relieved from duty.</Text></Paragraph></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809748" lims:id="809748"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809749" lims:id="809749">Notice of discharge</MarginalNote><Label>15</Label><Text>The notice period for the purpose of subsection 9.4(1) of the Act is 14 days.</Text></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809750" lims:id="809750"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809751" lims:id="809751">Designation of officer or person</MarginalNote><Label>16</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809752" lims:id="809752"><Label>(1)</Label><Text>The Commissioner may designate an officer or a person who holds an equivalent managerial position to be responsible for recommending the discharge of a member on probation.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809753" lims:id="809753"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809754" lims:id="809754">Recommendation</MarginalNote><Label>(2)</Label><Text>If a member on probation has failed to demonstrate their suitability to continue to serve as a member, the designated officer or person must immediately recommend to the decision maker, in writing, that the member be discharged.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809755" lims:id="809755"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809756" lims:id="809756">Notice of intent</MarginalNote><Label>(3)</Label><Text>The decision maker must cause a notice of intent to be served on a member on probation if they intend to discharge the member under subsection 9.4(1) of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809757" lims:id="809757"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809758" lims:id="809758">Contents of notice</MarginalNote><Label>(4)</Label><Text>The notice of intent must set out</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809759" lims:id="809759"><Label>(a)</Label><Text>the grounds on which the decision maker intends to discharge the member; The member may, within seven days after the day on which the copy is served,</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809767" lims:id="809767"><Label>(a)</Label><Text>provide a written response;
