lims:id="831884"><MarginalNote lims:inforce-start-date="2016-06-22" lims:fid="831885" lims:id="831885">Definitions</MarginalNote><Label>1</Label><Text>The following definitions apply in these Regulations.</Text><Definition lims:inforce-start-date="2016-06-22" lims:fid="831886" lims:id="831886" generate-in-text="no"><Text><DefinedTermEn>burr</DefinedTermEn> means, in relation to the surface finish of an expansion gate or an expandable enclosure, any non-functional protrusion that changes the roughness-height index by more than 100 μm. (<DefinedTermFr>bavure</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-22" lims:fid="831887" lims:id="831887" generate-in-text="no"><Text><DefinedTermEn>expandable enclosure</DefinedTermEn> means a self-supporting barrier, for indoor or outdoor use, that is intended to be used for children from the age of 6 months to 24 months and to surround completely an area within which such children may be confined. (<DefinedTermFr>enceinte extensible</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-22" lims:fid="831888" lims:id="831888" generate-in-text="no"><Text><DefinedTermEn>expansion gate</DefinedTermEn> means a barrier that is intended to be used for children from the age of 6 months to 24 months and to be erected in a doorway or similar opening in order to prevent the passage of such children, but that can be removed by older persons who are able to operate the locking mechanism. (<DefinedTermFr>barrière extensible</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2022-12-19" lims:enacted-date="2022-06-03" lims:fid="1387445" lims:id="1387445"><Text><DefinedTermEn>good laboratory practices</DefinedTermEn> means practices that are in accordance with the principles set out in the Organisation for Economic Co-operation and Development document entitled <XRefExternal reference-type="other">OECD Principles of Good Laboratory Practice</XRefExternal>, Number 1 of the <XRefExternal reference-type="other">OECD Series on Principles of Good Laboratory Practice and Compliance Monitoring</XRefExternal>, ENV/MC/CHEM(98)17, the English version of which is dated January 21, 1998 and the French version of which is dated March 6, 1998. (<DefinedTermFr>bonnes pratiques de laboratoire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-22" lims:fid="831889" lims:id="831889" generate-in-text="no"><Text><DefinedTermEn>indelibly printed</DefinedTermEn> means, in relation to the labelling of an expansion gate, an expandable enclosure or its packaging, marked by means of paint-stencilling, die-stamping, moulding or stamping directly on the expansion gate, the expandable enclosure or its packaging or by any other means, in such a manner that the markings do not fade and are not subject to being erased when tested in accordance with section 1 of Schedule 1. (<DefinedTermFr>inscription indélébile</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-22" lims:fid="831890" lims:id="831890" generate-in-text="no"><Text><DefinedTermEn>permanently affixed</DefinedTermEn> means, in relation to the labelling of an expansion gate, an expandable enclosure or its packaging, durably applied by means of a label that is fastened to the expansion gate, the expandable enclosure or its packaging with an adhesive or other suitable bonding agent or by any other means, and in such a manner that the label is not readily removable when tested in accordance with section 2 of Schedule 1. It does not include affixed by means of a hang tag, or a label affixed to a stuffed or padded part of the expansion gate or expandable enclosure. (<DefinedTermFr>étiquette permanente</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-22" lims:fid="831891" lims:id="831891" generate-in-text="no"><Text><DefinedTermEn>rough</DefinedTermEn> means, in relation to the surface finish of an expansion gate or an expandable enclosure, that the roughness-height index is greater than 50 μm. (<DefinedTermFr>rugueux</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-22" lims:fid="831892" lims:id="831892" generate-in-text="no"><Text><DefinedTermEn>roughness-height index</DefinedTermEn> means, in relation to the surface finish of an expansion gate or an expandable enclosure, the mean deviation, expressed in micrometres, of the surface irregularities from a hypothetical perfect surface. (<DefinedTermFr>indice de rugosité-hauteur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-22" lims:fid="831893" lims:id="831893" generate-in-text="no"><Text><DefinedTermEn>safety standard</DefinedTermEn> means American Society for Testing and Materials (ASTM) standard F 1004-86, entitled <XRefExternal reference-type="standard">Standard Consumer Safety Specification for First-Generation Standard Expansion Gates and Expandable Enclosures</XRefExternal>, approved on December 26, 1986 and published in April 1987. (<DefinedTermFr>norme de sécurité</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2022-12-19" lims:enacted-date="2022-06-03" lims:fid="1387447" lims:id="1387447" lims:enactId="1353975">SOR/2022-122, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="831894" lims:id="831894" level="1"><TitleText>Specifications</TitleText></Heading><Section lims:inforce-start-date="2022-12-19" lims:enacted-date="2022-06-03" lims:lastAmendedDate="2022-12-19" lims:fid="831895" lims:id="1387448"><MarginalNote lims:inforce-start-date="2022-12-19" lims:enacted-date="2022-06-03" lims:fid="1387449" lims:id="1387449">Stickers, films and surface coating materials</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2022-12-19" lims:enacted-date="2022-06-03" lims:fid="1387450" lims:id="1387450"><Label>(1)</Label><Text>A sticker, film or other similar material that can be removed, or a surface coating material, that is applied to an accessible part of an expansion gate or an expandable enclosure must not contain, when it is tested in accordance with a method that conforms to good laboratory practices,</Text><Paragraph lims:inforce-start-date="2022-12-19" lims:enacted-date="2022-06-03" lims:fid="1387451" lims:id="1387451"><Label>(a)</Label><Text>more than 90 mg/kg total lead;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-12-19" lims:enacted-date="2022-06-03" lims:fid="1387452" lims:id="1387452"><Label>(b)</Label><Text>any compound of antimony, arsenic, cadmium, selenium or barium if more than 1 000 mg/kg of the compound migrates from the material; or</Text></Paragraph><Paragraph lims:inforce-start-date="2022-12-19" lims:enacted-date="2022-06-03" lims:fid="1387453" lims:id="1387453"><Label>(c)</Label><Text>more than 10 mg/kg total mercury.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2022-12-19" lims:enacted-date="2022-06-03" lims:fid="1387454" lims:id="1387454"><MarginalNote lims:inforce-start-date="2022-12-19" lims:enacted-date="2022-06-03" lims:fid="1387455" lims:id="1387455">Definition of <DefinitionRef>accessible part</DefinitionRef> and <DefinitionRef>surface coating material</DefinitionRef></MarginalNote><Label>(2)</Label><Text>For the purposes of subsection (1), <DefinedTermEn>accessible part</DefinedTermEn> and <DefinedTermEn>surface coating material</DefinedTermEn> have the same meanings as in section 1 of the <XRefExternal reference-type="regulation" link="SOR-2016-193">Surface Coating Materials Regulations</XRefExternal>.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2022-12-19" lims:enacted-date="2022-06-03" lims:fid="1387457" lims:id="1387457" lims:enactId="1353977">SOR/2022-122, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="831899" lims:id="831899"><MarginalNote lims:inforce-start-date="2016-06-22" lims:fid="831900" lims:id="831900">Flammability</MarginalNote><Label>3</Label><Text>Any part of an expansion gate or an expandable enclosure that is made of a textile fibre must have a flame spread time greater than seven seconds, when tested in accordance with the Canadian General Standards Board standard CAN/CGSB-4.2 No. 27.5, entitled <XRefExternal reference-type="standard">Textile Test Methods: Flame Resistance — 45° Angle Test — One-Second Flame Impingement</XRefExternal>, as amended from time to time, in either of the following circumstances:</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="831901" lims:id="831901"><Label>(a)</Label><Text>it does not have a raised fibre surface; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="831902" lims:id="831902"><Label>(b)</Label><Text>it has a raised fibre surface and when tested exhibits ignition or fusion of its base fibres.</Text></Paragraph></Section><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="831903" lims:id="831903"><MarginalNote lims:inforce-start-date="2016-06-22" lims:fid="831904" lims:id="831904">Parts — wood, plastic or similar hard material</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2016-06-22" lims:fid="831905" lims:id="831905"><Label>(1)</Label><Text>Every part of an expansion gate or an expandable enclosure that is made of wood, plastic or a similar hard material must be free from cracks and other defects and be smoothly finished to eliminate rough or sharp edges.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="831906" lims:id="831906"><MarginalNote lims:inforce-start-date="2016-06-22" lims:fid="831907" lims:id="831907">Parts — metal</MarginalNote><Label>(2)</Label><Text>Every part of an expansion gate or an expandable enclosure that is made of metal must be free from burrs, projections and sharp edges, corners or points.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="831908" lims:id="831908"><MarginalNote lims:inforce-start-date="2016-06-22" lims:fid="831909" lims:id="831909">Metal tubing</MarginalNote><Label>(3)</Label><Text>Every cut edge of any metal tubing of an expansion gate or an expandable enclosure must meet one of the following requirements:</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="831910" lims:id="831910"><Label>(a)</Label><Text>it must be smoothly finished to eliminate rough or sharp edges, corners or points; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="831911" lims:id="831911"><Label>(b)</Label><Text>it must be protected by a cap that remains in place when subjected to a force of 90 N applied in any direction.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="831912" lims:id="831912"><MarginalNote lims:inforce-start-date="2016-06-22" lims:fid="831913" lims:id="831913">Bolts</MarginalNote><Label>(4)</Label><Text>The threaded end of every bolt of an expansion gate or an expandable enclosure must, if the end is accessible to the child or user, be covered by an acorn nut or a device that offers equivalent protection.</Text></Subsection></Section><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="831914" lims:id="831914"><MarginalNote lims:inforce-start-date="2016-06-22" lims:fid="831915" lims:id="831915">Small parts</MarginalNote><Label>5</Label><Text>Every part of an expansion gate or an expandable enclosure that is small enough to be totally enclosed in the small parts cylinder illustrated in Schedule 2 must be affixed to the expansion gate or the expandable enclosure in such a way that it does not become detached when subjected to a force of 90 N applied in any direction.</Text></Section><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="831916" lims:id="831916"><MarginalNote lims:inforce-start-date="2016-06-22" lims:fid="831917" lims:id="831917">Performance</MarginalNote><Label>6</Label><Text>Every expansion gate and expandable enclosure must comply with the performance requirements set out in sections 4.1 to 4.1.5 of the safety standard.</Text></Section><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="831918" lims:id="831918"><MarginalNote lims:inforce-start-date="2016-06-22" lims:fid="831919" lims:id="831919">Testing</MarginalNote><Label>7</Label><Text>Every expansion gate and expandable enclosure must be tested in accordance with the methods set out in sections 5.1 to 5.3.1 and 5.3.2.1 to 5.3.4 of the safety standard.</Text></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="831920" lims:id="831920" level="1"><TitleText>Information</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="831921" lims:id="831921"><MarginalNote lims:inforce-start-date="2016-06-22" lims:fid="831922" lims:id="831922">Reference to <XRefExternal reference-type="act" link="C-1.68">Canada Consumer Product Safety Act</XRefExternal> or Regulations</MarginalNote><Label>8</Label><Text>Information that appears on an expansion gate or an expandable enclosure, that accompanies one or that is in any advertisement for one, must not make any direct or indirect reference to the <XRefExternal reference-type="act" link="C-1.68">Canada Consumer Product Safety Act</XRefExternal> or these Regulations.</Text></Section><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="831923" lims:id="831923"><MarginalNote lims:inforce-start-date="2016-06-22" lims:fid="831924" lims:id="831924">Information — general</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2016-06-22" lims:fid="831925" lims:id="831925"><Label>(1)</Label><Text>Every expansion gate and expandable enclosure must have indelibly printed on it or permanently affixed to it, in English or in French, the following information, clearly and prominently displayed in numerals and block letters at least 2.5 mm in height that contrast sharply with the background by their colour, projection or indentation:</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="831926" lims:id="831926"><Label>(a)</Label><Text>the name and principal place of business in Canada of the manufacturer, importer or distributor;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="831927" lims:id="831927"><Label>(b)</Label><Text>its model name or model number; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="831928" lims:id="831928"><Label>(c)</Label><Text>the year and month of its manufacture, or a code or other identification that identifies that year and month.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="831929" lims:id="831929"><MarginalNote lims:inforce-start-date="2016-06-22" lims:fid="831930" lims:id="831930">Warning — general</MarginalNote><Label>(2)</Label><Text>Every expansion gate and expandable enclosure must have indelibly printed on it or permanently affixed to it, either the following warning in English and in French, clearly and prominently displayed in numerals and letters that contrast sharply with the background by their colour, projection or indentation, or visual images, clearly and prominently displayed, that concisely and readily convey the same meaning as the text of the warning:</Text><Provision lims:inforce-start-date="2016-06-22" lims:fid="831931" lims:id="831931" format-ref="centered" hyphenation="no" language-align="yes" pointsize="8" list-item="no"><Text>WARNING</Text><Provision lims:inforce-start-date="2016-06-22" lims:fid="831932" lims:id="831932" format-ref="centered" hyphenation="no" language-align="yes" pointsize="8" list-item="no"><Text>Install according to manufacturer’s instructions.</Text></Provision><Provision lims:inforce-start-date="2016-06-22" lims:fid="831933" lims:id="831933" format-ref="centered" hyphenation="no" language-align="yes" pointsize="8" list-item="no"><Text>Intended for use with children from 6 months through 24 months.</Text></Provision><Provision lims:inforce-start-date="2016-06-22" lims:fid="831934" lims:id="831934" format-ref="centered" hyphenation="no" language-align="yes" pointsize="8" list-item="no"><Text>Install with locking mechanism on side away from child (applies to pressure-mounted gates only).</Text></Provision><Provision lims:inforce-start-date="2016-06-22" lims:fid="831935" lims:id="831935" format-ref="centered" hyphenation="no" language-align="yes" pointsize="8" list-item="no"><Text>This product will not necessarily prevent all accidents.
