(<DefinedTermFr>aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="864166" lims:id="864166" generate-in-text="no"><Text><DefinedTermEn>airport reference point</DefinedTermEn> means the point determined in the manner set out in Part I of the schedule; (<DefinedTermFr>point de repère de l’aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="864167" lims:id="864167" generate-in-text="no"><Text><DefinedTermEn>approach surface</DefinedTermEn> means an imaginary inclined plane extending upward and outward from each end of a strip along and at right angles to the projected centre line thereof, which approach surface is more particularly described in Part III of the schedule; (<DefinedTermFr>surface d’approche</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="864168" lims:id="864168" generate-in-text="no"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Transport; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="864169" lims:id="864169" generate-in-text="no"><Text><DefinedTermEn>outer surface</DefinedTermEn> means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part IV of the schedule; (<DefinedTermFr>surface extérieure</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="864170" lims:id="864170" generate-in-text="no"><Text><DefinedTermEn>strip</DefinedTermEn> means the rectangular portion of the landing area of the airport including the runway prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part V of the schedule; (<DefinedTermFr>bande</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="864171" lims:id="864171" generate-in-text="no"><Text><DefinedTermEn>transitional surface</DefinedTermEn> means an imaginary inclined plane extending upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part VI of the schedule. (<DefinedTermFr>surface de transition</DefinedTermFr>)</Text></Definition></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="864172" lims:id="864172"><Label>3</Label><Text>For the purposes of these Regulations, the airport reference point is deemed to be 114 feet above sea level.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="864173" lims:id="864173" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="864174" lims:id="864174"><Label>4</Label><Text>These Regulations apply to all lands and lands under water, including public road allowances adjacent to or in the vicinity of the airport, the outer limits of which lands are described in Part II of the schedule, other than such lands as from time to time form part of the airport.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="864175" lims:id="864175" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="864176" lims:id="864176"><Label>5</Label><Text>No person shall erect or construct on any land, or land under water, to which these Regulations apply, any building, structure or object, or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point any of the surfaces hereinafter set out that project immediately over and above the surface of the land at that location, namely,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="864177" lims:id="864177"><Label>(a)</Label><Text>the approach surfaces;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="864178" lims:id="864178"><Label>(b)</Label><Text>the outer surface; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="864179" lims:id="864179"><Label>(c)</Label><Text>the transitional surfaces.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="864180" lims:id="864180" level="1"><TitleText>Natural Growth</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="864181" lims:id="864181"><Label>6</Label><Text>Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces set out in paragraphs 5(a) to (c), the Minister may make a direction that the owner or occupier of the land on which that object is growing remove the Waste</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="864185" lims:id="864185"><Label>7</Label><Text>No owner or occupier of any land or land under water to which these Regulations apply shall permit such land or any part thereof to be used for the disposal or accumulation thereon of any waste, material or substance edible by or 4)</OriginatingRef></ScheduleFormHeading><Heading lims:inforce-start-date="2006-03-22" lims:fid="864190" lims:id="864190" level="1"><Label>PART I</Label><TitleText>Description of Airport Reference Point Charlo Airport, County of Restigouche, New Brunswick</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="864191" lims:id="864191" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Being a point measured five hundred (500) feet perpendicular and northerly from a centreline point three thousand (3,000) feet westerly from the easterly end of the runway and having co-ordinate values of N. 1,544,317.27 feet and E. 1,041,507.02 feet, with reference to the New Brunswick Horizontal Control System.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="864192" lims:id="864192" level="1"><Label>PART II</Label><TitleText>Description of the Outer Limits of Lands</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="864193" lims:id="864193" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>A circular area having a radius of thirteen thousand (13,000) feet from the airport reference point as shown on Department of Transport Plans S-424B, C, D and E, dated September 2, 1977.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="864194" lims:id="864194" level="1"><Label>PART III</Label><TitleText>Description of the Approach Surface</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="864195" lims:id="864195" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Being an imaginary surface abutting each end of the strip consisting of an inclined plane having a ratio of one and sixty-six hundredths (1.66) feet measured vertically to one hundred (100) feet measured horizontally rising to an imaginary horizontal line drawn parallel to and ten thousand (10,000) feet measured horizontally from, each end of the strip, thence the approach surface shall rise at a ratio of two (2) feet measured vertically to one hundred (100) feet measured horizontally to an imaginary horizontal line drawn parallel to, and fifty thousand (50,000) feet measured horizontally from, each end of the strip and located at a height of nine hundred and sixty-six (966) feet above the elevation at each end of the strip, the outer ends of each surface being eight thousand (8,000) feet on each side of the projected centreline as shown on Department of Transport Plans S-424A, B, C, D, E and F dated September 2, 1977.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="864196" lims:id="864196" level="1"><Label>PART IV</Label><TitleText>Description of the Outer Surface</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="864197" lims:id="864197" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Being an imaginary surface consisting of</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="864198" lims:id="864198" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>a common plane established at a constant elevation of one hundred and fifty (150) feet above the assigned elevation of the airport reference point, and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="864199" lims:id="864199" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>where the common plane described in paragraph (a) is less than thirty (30) feet above the surface of the ground, an imaginary surface located thirty (30) feet above the surface of the ground,</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="864200" lims:id="864200" format-ref="indent-0-0" language-align="no" list-item="no"><Text>which outer surface is shown on Department of Transport Plans S-424B, C, D and E, dated September 2, 1977.</Text></Provision></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="864201" lims:id="864201" level="1"><Label>PART V</Label><TitleText>Description of the Strip</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="864202" lims:id="864202" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The strip is one thousand (1,000) feet in width, five hundred (500) feet being on each side of the centreline of the runway, and six thousand four hundred (6,400) feet in length as shown on Department of Transport Plan S-424C dated September 2, 1977.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="864203" lims:id="864203" level="1"><Label>PART VI</Label><TitleText>Description of Each Transitional Surface</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="864204" lims:id="864204" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Being an imaginary surface consisting of an inclined plane rising at a ratio of one (1) foot measured vertically to seven (7) feet measured horizontally at right angles to the centre line and centre line produced of the strip, and extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface as shown on Department of Transport Plan S-424C dated September 2, 1977.</Text></Provision></Schedule></Regulation>
