(<DefinedTermFr>aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="886270" lims:id="886270" generate-in-text="no"><Text><DefinedTermEn>airport reference point</DefinedTermEn> means the point described in Part I of the schedule; (<DefinedTermFr>point de repère de l’aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="886271" lims:id="886271" generate-in-text="no"><Text><DefinedTermEn>approach surface</DefinedTermEn> means the imaginary inclined plane more particularly described in Part II of the schedule that extends upward and outward from each end of each strip associated with runways designated 12-30 and 04-22 of the airport; (<DefinedTermFr>surface d’approche</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="886272" lims:id="886272" generate-in-text="no"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Transport; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="886273" lims:id="886273" generate-in-text="no"><Text><DefinedTermEn>outer surface</DefinedTermEn> means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (<DefinedTermFr>surface extérieure</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="886274" lims:id="886274" generate-in-text="no"><Text><DefinedTermEn>strip</DefinedTermEn> means the rectangular portion of the landing area of the airport including the runway prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (<DefinedTermFr>bande</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="886275" lims:id="886275" generate-in-text="no"><Text><DefinedTermEn>transitional surface</DefinedTermEn> means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (<DefinedTermFr>surface de transition</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="886276" lims:id="886276"><Label>(2)</Label><Text>For the purposes of these Regulations, the assigned elevation of the airport reference point is 135 m above sea level.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="886277" lims:id="886277" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="886278" lims:id="886278"><Label>3</Label><Text>These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described in Part VI of the schedule.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="886279" lims:id="886279" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="886280" lims:id="886280"><Label>4</Label><Text>No person shall erect or construct, on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886281" lims:id="886281"><Label>(a)</Label><Text>the approach surface of any strip;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886282" lims:id="886282"><Label>(b)</Label><Text>the outer surface; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886283" lims:id="886283"><Label>(c)</Label><Text>the transitional surface.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="886284" lims:id="886284" level="1"><TitleText>Natural Growth</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="886285" lims:id="886285"><Label>5</Label><Text>Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may make a direction that the owner or occupier of the land on which that object is growing remove the excessive growth.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="886286" lims:id="886286" level="1"><TitleText>Disposal of Waste</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="886287" lims:id="886287"><Label>6</Label><Text>No owner or occupier of any land to which these Regulations apply shall permit that land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds.</Text></Section></Body><Schedule lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="886288" lims:id="886288" bilingual="no" spanlanguages="no"><ScheduleFormHeading lims:inforce-start-date="2006-03-22" lims:fid="886289" lims:id="886289"><Label>SCHEDULE</Label><OriginatingRef>(s. 2 and 3)</OriginatingRef></ScheduleFormHeading><Heading lims:inforce-start-date="2006-03-22" lims:fid="886290" lims:id="886290" level="1"><Label>PART I</Label><TitleText>Description of the Airport Reference Point</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="886291" lims:id="886291" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The airport reference point, shown on Oshawa Airport Zoning Plan No. 18-013-80-58, Sheet 5, dated June 28, 1984, is a point distant 49.13 m measured southerly at right angles to the centre line of runway 12-30 from a point distant 518.62 m measured westerly along the said centre line from the easterly end of said runway.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="886292" lims:id="886292" level="1"><Label>PART II</Label><TitleText>Description of the Approach Surfaces</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="886293" lims:id="886293" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The approach surfaces, shown on Oshawa Airport Zoning Plan No. 18-013-80-58, Sheets 1 to 13, dated June 28, 1984, are surfaces abutting each end of the strips associated with the runways designated 12-30 and 04-22 and are described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="886294" lims:id="886294" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>a surface abutting the end of the strip associated with runway approach 12 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m measured vertically above the elevation at the end of the strip;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="886295" lims:id="886295" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>a surface abutting the end of the strip associated with runway approach 30 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m measured vertically above the elevation at the end of the strip;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="886296" lims:id="886296" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>a surface abutting the end of the strip associated with runway approach 04 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 325 m from the projected centre line; said imaginary horizontal line being 50 m measured vertically above the elevation at the end of the strip; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="886297" lims:id="886297" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(d)</Label><Text>a surface abutting the end of the strip associated with runway approach 22 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 325 m from the projected centre line; said imaginary horizontal line being 50 m measured vertically above the elevation at the end of the strip.</Text></Provision></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="886298" lims:id="886298" level="1"><Label>PART III</Label><TitleText>Description of the Outer Surface</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="886299" lims:id="886299" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The outer surface, shown on Oshawa Airport Zoning Plan No. 18-013-80-58, Sheets 1 to 9 inclusive, dated June 28, 1984, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the assigned elevation of the airport reference point except where that common plane is less than 9 m above the surface of the ground, the imaginary surface is located at 9 m above the surface of the ground.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="886300" lims:id="886300" level="1"><Label>PART IV</Label><TitleText>Description of the Strips</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="886301" lims:id="886301" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The strips, as shown on Oshawa Airport Zoning Plan No. 18-013-80-58, Sheet 5, dated June 28, 1984, are described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="886302" lims:id="886302" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>the strip associated with runway 12-30 being 300 m in width, 150 m on each side of the centre line of the runway and 1 416 m in length; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="886303" lims:id="886303" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>the strip associated with runway 04-22 being 150 m in width, 75 m each side of the centre line of the runway, and 1 050 m in length.</Text></Provision></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="886304" lims:id="886304" level="1"><Label>PART V</Label><TitleText>Description of Each Transitional Surface</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="886305" lims:id="886305" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Each transitional surface, shown on Oshawa Airport Zoning Plan No. 18-013-80-58, Sheets 1, 2, 4, 5, 6 and 8, dated June 28, 1984, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and the centre line produced of each strip extending upward and outward from the lateral limits of each strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="886306" lims:id="886306" level="1"><Label>PART VI</Label><TitleText>Description of the Lands to Which These Regulations Apply</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="886307" lims:id="886307" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The boundary of the outer limits of lands, shown on Oshawa Airport Zoning Plan No. 18-013-80-58, Sheets 1 to 13, dated June 28, 1984 are described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="886308" lims:id="886308" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Commencing at the southwesterly corner of Lot 24 Concession 3 in the geographic Township of Whitby, now in the Municipality of the Town of Whitby;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="886309" lims:id="886309" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>THENCE northerly along the western boundary of Lot 24 Concession 3 to the northwesterly corner thereof;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="886310" lims:id="886310" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>THENCE easterly along the northern boundary of said Lot 24 Concession 3 to the intersection with the production southerly of the western boundary of Lot 24 Concession 4;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="886311" lims:id="886311" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>THENCE northerly in a straight line across the road allowance between Concession 3 and Concession 4 along the said production to the southwesterly corner of Lot 24 Concession 4;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="886312" lims:id="886312" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>THENCE northerly along the western boundary of Lot 24 Concession 4 to the intersection with the southwesterly limit of approach surface 12;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="886313" lims:id="886313" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>THENCE northwesterly along the southwesterly limit of approach surface 12 on an azimuth of 281°03′30″ to the southwesterly corner of said approach surface, the co-ordinates of which are 4 868 179.857 N., 653 267.056 E.;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="886314" lims:id="886314" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>THENCE northeasterly along the northwesterly limit of approach surface 12 on an azimuth of 19°35′21″ to the northwesterly corner of said approach surface, the co-ordinates of which are 4 872 701.773 N., 654 876.274 E.;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="886315" lims:id="886315" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>THENCE southeasterly along the northeasterly limit of approach surface 12 on an azimuth of 118°07′12″ to the intersection with the northern boundary of Lot 21, Concession 4;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="886316" lims:id="886316" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>THENCE easterly along the northern boundary of Lot 21 Concession 4 to the northeasterly corner thereof;</Text></Provision><Provision lims:inforce-start-date="2006-03-22"
