SOR/2006-156, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-06-23" lims:fid="889001" lims:id="889001" level="1"><TitleText>Conditions Under Which Goods May Be Transported</TitleText></Heading><Section lims:inforce-start-date="2006-06-23" lims:lastAmendedDate="2006-06-23" lims:fid="889002" lims:id="889002"><Label>3</Label><Subsection lims:inforce-start-date="2006-06-23" lims:fid="889003" lims:id="889003"><Label>(1)</Label><Text>Subject to subsection (3), no person shall transport or cause to be transported within Canada goods that have been imported but have not been released unless</Text><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889004" lims:id="889004"><Label>(a)</Label><Text>the person submits an application in the prescribed form for permission to transport the goods to the chief officer of customs for the area or place in which the transportation of the goods is to begin or, where the person proposes to transport such goods or cause such goods to be transported on a regular basis, to the President;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889005" lims:id="889005"><Label>(b)</Label><Text>the person deposits the security required by subsection 6(1) with the chief officer of customs or the President, as the case may be;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889006" lims:id="889006"><Label>(c)</Label><Text>the person receives permission to transport the goods from the chief officer of customs or the President, as the case may be;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889007" lims:id="889007"><Label>(d)</Label><Text>the person presents a description of the goods in the prescribed form to an officer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889008" lims:id="889008"><Label>(e)</Label><Text>the conveyance or container or part thereof that contains the goods is sealed with a seal issued or approved by the President except where</Text><Subparagraph lims:inforce-start-date="2006-06-23" lims:fid="889009" lims:id="889009"><Label>(i)</Label><Text>the conveyance or container or part thereof is of a nature or size that precludes the sealing thereof,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-06-23" lims:fid="889010" lims:id="889010"><Label>(ii)</Label><Text>the goods are live animals, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-06-23" lims:fid="889011" lims:id="889011"><Label>(iii)</Label><Text>the person has been authorized by an officer to transport the goods or cause them to be transported in an unsealed conveyance or container.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-06-23" lims:fid="889012" lims:id="889012"><Label>(2)</Label><Text>Every person who transports or causes to be transported within Canada goods that have been imported but have not been released shall notify the consignee in the prescribed form of the arrival of the goods.</Text></Subsection><Subsection lims:inforce-start-date="2006-06-23" lims:fid="889013" lims:id="889013"><Label>(3)</Label><Text>Subsection (1) does not apply to the transportation of goods within Canada prior to the time the goods are required to be reported under section 12 of the Act and under the <XRefExternal reference-type="regulation" link="SOR-86-873">Reporting of Imported Goods Regulations</XRefExternal> made pursuant thereto.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-06-23" lims:fid="889015" lims:id="889015">SOR/2006-156, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-06-23" lims:lastAmendedDate="2006-06-23" lims:fid="889016" lims:id="889016"><Label>4</Label><Subsection lims:inforce-start-date="2006-06-23" lims:fid="889017" lims:id="889017"><Label>(1)</Label><Text>If, as the result of an accident or other unforeseen event occurring in the course of transporting goods,</Text><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889018" lims:id="889018"><Label>(a)</Label><Text>a seal is damaged or broken,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889019" lims:id="889019"><Label>(b)</Label><Text>a container or conveyance is damaged or disabled and to preserve the goods they must be removed therefrom, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889020" lims:id="889020"><Label>(c)</Label><Text>a conveyance is damaged or disabled and can no longer be used to transport the goods,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-06-23" lims:fid="889021" lims:id="889021"><Text>the person transporting the goods shall forthwith report the accident or event, as the case may be, to the chief officer of customs for the area or place in which the accident or event occurred or the damage, break or disablement was discovered or to the nearest detachment of the Royal Canadian Mounted Police.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-06-23" lims:fid="889022" lims:id="889022"><Label>(2)</Label><Text>In any case described in paragraph (1)(b) or (c), the goods being transported shall not be transferred to another conveyance or container unless</Text><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889023" lims:id="889023"><Label>(a)</Label><Text>the person who transports the transferred goods or who causes those goods to be transported complies with the requirements of these Regulations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889024" lims:id="889024"><Label>(b)</Label><Text>in the case of goods transferred from a conveyance or container that is sealed,</Text><Subparagraph lims:inforce-start-date="2006-06-23" lims:fid="889025" lims:id="889025"><Label>(i)</Label><Text>the transfer is conducted in the presence of an officer or a police officer who has been requested by the chief officer of customs to supervise the transfer, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-06-23" lims:fid="889026" lims:id="889026"><Label>(ii)</Label><Text>the conveyance or container to which the goods are transferred is sealed with a seal issued or approved by the President.</Text></Subparagraph></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-06-23" lims:fid="889028" lims:id="889028">SOR/2006-156, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-06-23" lims:fid="889029" lims:id="889029" level="2"><TitleText>Conditions Under Which Goods May Be Delivered Prior To Release</TitleText></Heading><Section lims:inforce-start-date="2006-06-23" lims:lastAmendedDate="2006-06-23" lims:fid="889030" lims:id="889030"><Label>4.1</Label><Text>For the purposes of subsection 19(1.1) of the Act, the prescribed conditions under which a person may be authorized to deliver or cause goods to be delivered to the place of business of the importer, owner or consignee are as follows:</Text><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889031" lims:id="889031"><Label>(a)</Label><Text>the goods have been reported under section 12 of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889032" lims:id="889032"><Label>(b)</Label><Text>the goods are eligible goods; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889033" lims:id="889033"><Label>(c)</Label><Text>the prescribed conditions set out in section 10.2 of the <XRefExternal reference-type="regulation" link="SOR-86-1062">Accounting for Imported Goods and Payment of Duties Regulations</XRefExternal> relating to the release of eligible goods under paragraph 32(2)(b) of the Act have been met.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-06-23" lims:fid="889035" lims:id="889035">SOR/2005-389, s. 2; SOR/2006-156, ss. 2, 6</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-06-23" lims:fid="889036" lims:id="889036" level="1"><TitleText>Liability of Transporter for Duties</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-06-23" lims:fid="889038" lims:id="889038">SOR/2006-156, s. 3(F)</HistoricalNoteSubItem></HistoricalNote></Heading><Section lims:inforce-start-date="2006-06-23" lims:lastAmendedDate="2006-06-23" lims:fid="889039" lims:id="889039"><Label>5</Label><Text>The prescribed time for proving any of the events described in paragraphs 20(2)(a) to (e) or 20(2.1)(a) to (e) of the Act is 70 days from the earlier of</Text><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889040" lims:id="889040"><Label>(a)</Label><Text>the day on which the goods were reported, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="889041" lims:id="889041"><Label>(b)</Label><Text>the day that the goods were required to be reported under section 12 of the Act.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-06-23" lims:fid="889043" lims:id="889043">SOR/2006-156, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-06-23" lims:lastAmendedDate="2006-06-23" lims:fid="889044" lims:id="889044"><Label>5.1</Label><Text><Repealed>[Repealed, SOR/2006-156, s. 4]</Repealed></Text></Section><Heading lims:inforce-start-date="2006-06-23" lims:fid="889045" lims:id="889045" level="1"><TitleText>Security</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2024-10-21" lims:fid="889046" lims:id="889046"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889047" lims:id="889047"><Label>(1)</Label><Text>Every person who transports or causes to be transported within Canada goods that have been imported but have not been released shall give security to secure his compliance with the requirements of the Act and the regulations respecting the transportation of the goods.</Text></Subsection><Subsection lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="889048" lims:id="1492591"><Label>(2)</Label><Text>The security must be given in accordance with the requirements of the <XRefExternal reference-type="regulation" link="SOR-2024-42">Financial Security (Electronic Means) Regulations</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889058" lims:id="889058"><Label>(3)</Label><Text>Subject to subsection (4), the security referred to in subsection (1) shall be in an amount equal to the greater of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889059" lims:id="889059"><Label>(a)</Label><Text>the duties payable in respect of the goods; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889060" lims:id="889060"><Label>(b)</Label><Text>$1,000.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889061" lims:id="889061"><Label>(4)</Label><Text>Where goods are to be transported or caused to be transported by a person on a regular basis, the security referred to in subsection (1) shall be in an amount that is determined by the Minister, but in no case shall the amount of security be less than $5,000.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889062" lims:id="889062"><Label>(5)</Label><Text>The Minister may, at any time where the Minister considers it necessary, require a person who transports or causes to be transported goods within Canada to increase the amount of security given under subsection (1) to an amount sufficient to ensure the payment of any duties payable in respect of those goods.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889064" lims:id="889064">SOR/88-495, s. 1; SOR/91-274; SOR/2001-197, s. 4</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="1492592" lims:id="1492592" lims:enactId="1447739">SOR/2024-41, s. 34</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-06-23" lims:fid="889065" lims:id="889065" level="1"><TitleText>Records</TitleText></Heading><Section lims:inforce-start-date="2015-10-24" lims:lastAmendedDate="2015-10-24" lims:fid="889066" lims:id="889066"><Label>7</Label><Subsection lims:inforce-start-date="2015-10-24" lims:fid="889067" lims:id="889067"><Label>(1)</Label><Text>Every person who transports or causes to be transported goods into Canada, or transports or causes to be transported within Canada goods that have been imported but have not been released, shall keep all invoices, bills, accounts and statements, or a copy thereof, relating to the transportation of the goods and, in addition, shall keep</Text><Paragraph lims:inforce-start-date="2015-10-24" lims:fid="889068" lims:id="889068"><Label>(a)</Label><Text>in the case of goods transported to Canada, a copy of any report that is made in writing or by electronic means under section 12 of the Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-10-24" lims:fid="889069" lims:id="889069"><Label>(b)</Label><Text>in the case of goods that have been imported into Canada but have not been released, the description of the goods referred to in paragraph 3(1)(d), or a copy thereof.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-10-24" lims:fid="889070" lims:id="889070"><Label>(2)</Label><Text>In addition to the records described in subsection (1), for the purposes of section 22 of the Act, every CSA carrier that transports eligible goods that have been authorized for delivery under paragraph 32(2)(b) of the Act to the place of business of the importer, owner or consignee of the goods shall keep the following records:</Text><Paragraph lims:inforce-start-date="2015-10-24" lims:fid="889071" lims:id="889071"><Label>(a)</Label><Text>records relating to goods delivered to the place of business;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-10-24" lims:fid="889072" lims:id="889072"><Label>(a.1)</Label><Text>records by means of which the CSA carrier receives the instructions referred to in paragraph <XRefInternal>13</XRefInternal>(2)(d), <XRefInternal>16</XRefInternal>(2)(d), <XRefInternal>18</XRefInternal>(2)(d) or <XRefInternal>20</XRefInternal>(2)(d) of the <XRefExternal reference-type="regulation" link="SOR-86-873">Reporting of Imported Goods Regulations</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-10-24" lims:fid="889073" lims:id="889073"><Label>(b)</Label><Text>records relating to goods that are not delivered to the place of business because they fall within one of the events described in paragraphs 20(2.1)(a) to (d) of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-10-24" lims:fid="889074" lims:id="889074"><Label>(c)</Label><Text>names and addresses of terminals and warehouses owned or operated by the CSA carrier;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-10-24" lims:fid="889075" lims:id="889075"><Label>(d)</Label><Text>lists of the CSA carrier’s equipment used to transport the eligible goods, usage logs and maintenance records for that equipment, dispatch records and records indicating whether that equipment is owned or leased;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-10-24" lims:fid="889076" lims:id="889076"><Label>(e)</Label><Text>the names of commercial drivers as defined in section 1 of the <XRefExternal reference-type="regulation" link="SOR-2003-323">Presentation of Persons (2003) Regulations</XRefExternal> that the carrier employs who hold an authorization under those Regulations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-10-24" lims:fid="889077" lims:id="889077"><Label>(f)</Label><Text>the names and addresses of persons who own and operate transportation equipment and who have a written contract to provide their equipment exclusively to the CSA carrier.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-10-24" lims:fid="889078" lims:id="889078"><Label>(3)</Label><Text>In addition to the records described in subsection (1), for the purposes of section 22 of the Act, a person referred to in that section is required to keep the original or a copy of the following records:</Text><Paragraph lims:inforce-start-date="2015-10-24" lims:fid="889079" lims:id="889079"><Label>(a)</Label><Text>records by means of which the person gives the Agency information under subsection 12.1(1) of the Act in the circumstances set out in section <XRefInternal>13</XRefInternal>, <XRefInternal>15.2</XRefInternal>, <XRefInternal>16</XRefInternal>, <XRefInternal>17.1</XRefInternal>, <XRefInternal>18</XRefInternal>, <XRefInternal>19.1</XRefInternal>, <XRefInternal>20</XRefInternal>, <XRefInternal>21.1</XRefInternal>, <XRefInternal>24</XRefInternal> or <XRefInternal>25</XRefInternal> of the <XRefExternal reference-type="regulation" link="SOR-86-873">Reporting of Imported Goods Regulations</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-10-24" lims:fid="889080" lims:id="889080"><Label>(b)</Label><Text>records by means of which the person notifies the Agency of a change to information under section <XRefInternal>30</XRefInternal> of those Regulations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-10-24" lims:fid="889081" lims:id="889081"><Label>(c)</Label><Text>any acknowledgement of receipt of that information or that change to information received from the Agency.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-10-24" lims:fid="889082" lims:id="889082"><Label>(4)</Label><Text>A person who is required to keep records referred to in subsection (1), (2) or (3) that are created from other records is, for the purposes of section 22 of the Act, also required to keep the other records.</Text></Subsection><Subsection lims:inforce-start-date="2015-10-24" lims:fid="889083" lims:id="889083"><Label>(5)</Label><Text>For the purposes of section 22 of the Act, the period that the records are required to be kept is three years beginning on January 1st of the calendar year following the calendar year during which the goods to which the records relate were transported.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-10-24" lims:fid="889085" lims:id="889085">SOR/2005-389, s. 4;
