Marketing Agency pursuant to subsection 17(1) of the <XRefExternal reference-type="act">Farm Products Marketing Agencies Act</XRefExternal><FootnoteRef Canadian Egg Marketing Agency has been empowered to implement a marketing plan pursuant to the <XRefExternal reference-type="regulation" link="C.R.C.,_c._646">Canadian Egg Marketing Agency list-item="no"><Text>Whereas the proposed <XRefExternal reference-type="regulation">Canadian Egg Marketing Agency Quota Regulations</XRefExternal> annexed hereto are of a class to which paragraph 7(1)(d) of the said Act applies by reason of section 2 of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._648">Agencies’ Orders and Regulations Approval Order</XRefExternal>, C.R.C., c. 648, and has been submitted to the National Farm Products Marketing Council pursuant to paragraph 23(1)(f) of the said Act;</Text></Provision><Provision lims:inforce-start-date="2017-09-22" lims:fid="898112" lims:id="898112" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And Whereas the National Farm Products Marketing Council is satisfied pursuant to paragraph 7(1)(d) of the said Act that the making of the proposed Regulations is necessary for the implementation of the marketing plan that the Canadian Egg Marketing Agency is authorized to implement and has approved lims:inforce-start-date="2017-09-22" lims:fid="898142" lims:id="898142" generate-in-text="no"><Text><DefinedTermEn>hen</DefinedTermEn> means a hen belonging to the species <Language xml:lang="la">gallus domesticus</Language>; (<DefinedTermFr>poule</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-22" lims:fid="898143" lims:id="898143" generate-in-text="no"><Text><DefinedTermEn>marketing</DefinedTermEn>, in relation to eggs, means selling and offering for sale and buying, pricing, assembling, packing, processing, transporting, storing and reselling, whether in whole or in processed form; (<DefinedTermFr>commercialisation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-22" lims:fid="898144" lims:id="898144" generate-in-text="no"><Text><DefinedTermEn>processor</DefinedTermEn> means any person who breaks eggs and filters, blends, heat-treats, stabilizes, mixes, cools, freezes and dries eggs; (<DefinedTermFr>transformateur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-22" lims:fid="898145" lims:id="898145" generate-in-text="no"><Text><DefinedTermEn>producer</DefinedTermEn> means any person engaged in the production of eggs; (<DefinedTermFr>producteur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-22" lims:fid="898146" lims:id="898146" generate-in-text="no"><Text><DefinedTermEn>provincial quota</DefinedTermEn> means the number of dozens of eggs that a producer is entitled, under orders, regulations or policy directives, made by the Commodity Board of a province, to market in intraprovincial trade during the period set out in Schedule 1; (<DefinedTermFr>contingent provincial</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-22" lims:fid="898147" lims:id="898147" generate-in-text="no"><Text><DefinedTermEn>special temporary market requirement quota</DefinedTermEn> means the number of dozens of eggs that a producer is entitled, under these Regulations, to market to a processor in interprovincial and export trade to satisfy temporary market requirements for eggs during the period set out in Schedule 1.1; (<DefinedTermFr>contingent spécial pour les besoins temporaires du marché</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-22" lims:fid="898148" lims:id="898148" generate-in-text="no"><Text><DefinedTermEn>vaccine quota</DefinedTermEn> means the number of dozens of eggs that a producer is entitled, under these Regulations, to market to a vaccine manufacturer in interprovincial and export trade during the period lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="898152" lims:id="898152"><Label>3</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="898153" lims:id="898153"><Label>(1)</Label><Text>Subject to subsection (2), these Regulations apply to the marketing of eggs in interprovincial and export trade.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="898154" lims:id="898154"><Label>(2)</Label><Text>These Regulations do not apply to eggs that are placed in an incubator for hatching.</Text></Subsection></Section><Heading lims:inforce-start-date="2017-09-22" lims:fid="898155" lims:id="898155" level="1"><TitleText>Federal Quota Prohibitions</TitleText></Heading><Section lims:inforce-start-date="2017-09-22" lims:lastAmendedDate="2024-12-29" lims:fid="898156" lims:id="898156"><Label>4</Label><Subsection lims:inforce-start-date="2017-09-22" lims:fid="898157" lims:id="898157"><Label>(1)</Label><Text>No producer shall market eggs in interprovincial or export trade unless</Text><Paragraph lims:inforce-start-date="2024-12-29" lims:enacted-date="2024-12-24" lims:fid="898158" lims:id="1506205"><Label>(a)</Label><Text>a federal quota, special temporary market requirement quota or vaccine quota has been allotted to the producer, on behalf of the Agency, by the Commodity Board of the province in which the producer’s egg production facilities are located;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-29" lims:enacted-date="2024-12-24" lims:fid="898159" lims:id="1506207"><Label>(b)</Label><Text>the number of eggs marketed does not exceed the federal quota, special temporary market requirement quota or vaccine quota referred to in paragraph (a);</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-29" lims:enacted-date="2024-12-24" lims:fid="898160" lims:id="1506208"><Label>(c)</Label><Text>the producer complies with any subsisting rules of the Commodity Board referred to in paragraph (a) that the Commodity Board has been authorized by the Agency, under subsection 22(3) of the Act, to apply, in performing on behalf of the Agency the function of allotting and administering federal quotas, special temporary market requirement quotas and vaccine quotas;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-29" lims:enacted-date="2024-12-24" lims:fid="898161" lims:id="1506209"><Label>(d)</Label><Text><Repealed>[Repealed, SOR/2024-287, s. 2]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2017-09-22" lims:fid="898167" lims:id="898167"><Label>(e)</Label><Text><Repealed>[Repealed, SOR/2017-206, s. 2]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2017-09-22" lims:fid="898168" lims:id="898168"><Label>(e.1)</Label><Text>in the case of eggs marketed by the producer under a special temporary market requirement quota,</Text><Subparagraph lims:inforce-start-date="2017-09-22" lims:fid="898169" lims:id="898169"><Label>(i)</Label><Text>all such eggs are sold by the producer to a processor at a price not less than the price of eggs of an equivalent variety, class, grade or size sold under the Agency’s Industrial Products Program, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-09-22" lims:fid="898170" lims:id="898170"><Label>(ii)</Label><Text>all such eggs are sold by the producer to the processor pursuant to a contract that has been approved by the Agency; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-09-22" lims:fid="898171" lims:id="898171"><Label>(f)</Label><Text>in the case of eggs marketed by a producer under a vaccine quota</Text><Subparagraph lims:inforce-start-date="2017-09-22" lims:fid="898172" lims:id="898172"><Label>(i)</Label><Text>all such eggs are sold by the producer to a vaccine manufacturer at a price not less than the price of eggs of an equivalent variety, class, grade or size sold under the Agency’s Industrial Products Program,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-09-22" lims:fid="898173" lims:id="898173"><Label>(ii)</Label><Text>all such eggs are sold by the producer to the vaccine manufacturer under a contract that has been approved by the Agency, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-09-22" lims:fid="898174" lims:id="898174"><Label>(iii)</Label><Text>the producer holds a seller’s licence and the vaccine manufacturer holds a buyer’s licence issued under the <XRefExternal reference-type="regulation" link="SOR-87-242">Canadian Egg Licensing Regulations, 1987</XRefExternal>.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-09-22" lims:fid="898175" lims:id="898175"><Label>(2)</Label><Text>Subsection (1) does not apply to eggs marketed under quota exemptions referred to in subsection 7(2).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-09-22" lims:fid="898177" Quota</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="898179" lims:id="898179"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="898180" lims:id="898180"><Label>(1)</Label><Text>Subject to subsection (2), a producer is not entitled to be allotted a federal quota unless, immediately before the coming into force of these Regulations,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="898181" lims:id="898181"><Label>(a)</Label><Text>the producer had a provincial quota that was allotted to him by the Commodity Board of the province in which the producer’s egg production facilities are located; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="898182" lims:id="898182"><Label>(b)</Label><Text>the producer was entitled to a federal quota pursuant to the <XRefExternal reference-type="regulation">Canadian Egg Marketing Agency Quota Regulations</XRefExternal>, C.R.C., c. 656.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="898183" lims:id="898183"><Label>(2)</Label><Text>After the coming into force of these Regulations, a producer is entitled to be allotted a federal quota if, pursuant to the rules of the Commodity Board of the province in which the producer’s egg production facilities are located, the producer is allotted a provincial quota.</Text></Subsection></Section><Heading lims:inforce-start-date="2024-12-29" lims:enacted-date="2024-12-24" lims:fid="898184" lims:id="1506219" level="1"><TitleText>Entitlement to Special Temporary Market Requirement Quota and Vaccine Quota</TitleText></Heading><Section lims:inforce-start-date="2024-12-29" lims:enacted-date="2024-12-24" lims:lastAmendedDate="2024-12-29" lims:fid="898185" lims:id="1506220"><Label>5.1</Label><Text>A producer is entitled to be allotted a special temporary market requirement quota or a vaccine quota if the producer has been allotted, or would be entitled to be allotted, a federal quota under these Regulations.</Text><HistoricalNote><HistoricalNoteSubItem level="1"><TitleText>Relationship of Federal Quota to Provincial Quota</TitleText></Heading><Section lims:inforce-start-date="2007-12-30" lims:lastAmendedDate="2007-12-30" lims:fid="898190" lims:id="898190"><Label>6</Label><Text>Subject to these Regulations, the quantity of eggs that a producer is authorized to market from a province under a federal quota during the period set out in Schedule 1 shall equal the provincial quota allotted to the producer for that period by the Commodity Board of the province minus the quantity of eggs marketed by the producer in intraprovincial trade lims:inforce-start-date="2007-12-30" lims:fid="898195" lims:id="898195"><Label>(1)</Label><Text>The Commodity Board of a province shall allot federal quotas to producers of that province in such a manner that, during the period set out in Schedule 1, the aggregate of the number of dozens of eggs referred to in paragraphs (a) to (c) will not exceed the applicable number of dozens of eggs set out in column 2 of that Schedule in respect of that province:</Text><Paragraph lims:inforce-start-date="2007-12-30" lims:fid="898196" lims:id="898196"><Label>(a)</Label><Text>the number of dozens of eggs produced in the province and authorized to be marketed by producers under federal quotas allotted on behalf of the Agency by the Commodity Board of the province;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-12-30" lims:fid="898197" lims:id="898197"><Label>(b)</Label><Text>the number of dozens of eggs produced in the province and authorized to be marketed by producers in intraprovincial trade under provincial quotas allotted by the Commodity Board of the province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-12-30" lims:fid="898198" lims:id="898198"><Label>(c)</Label><Text>the number of dozens of eggs produced in the province and anticipated to be marketed by producers under quota exemptions granted by the Commodity Board of the province.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-12-30" lims:fid="898199" lims:id="898199"><Label>(2)</Label><Text>For the purposes of paragraph (1)(c), eggs marketed under quota exemptions include</Text><Paragraph lims:inforce-start-date="2007-12-30" lims:fid="898200" lims:id="898200"><Label>(a)</Label><Text>eggs marketed by a producer whose flock of hens is below the flock size specified by the Commodity Board of the province as the flock size below which the eggs produced therefrom may be marketed under a quota exemption;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-12-30" lims:fid="898201" lims:id="898201"><Label>(b)</Label><Text>hatching eggs authorized by the Commodity Board of the province to be marketed for human consumption; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-12-30" lims:fid="898202" lims:id="898202"><Label>(c)</Label><Text>eggs marketed by any organization that is granted an exemption by the Schedule in respect of that province:</Text><Paragraph lims:inforce-start-date="2015-12-27" lims:fid="898210" lims:id="898210"><Label>(a)</Label><Text>the number of dozens of eggs produced in the province and authorized to be marketed by producers under special temporary market requirement quotas allotted on behalf of the Agency by the Commodity Board of the province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-27" lims:fid="898211" lims:id="898211"><Label>(b)</Label><Text>the number of dozens of eggs produced in the province and authorized to be marketed by producers in intraprovincial trade under quotas equivalent to those referred to in paragraph (a) allotted by the Commodity Board of the province.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-12-27" lims:fid="898212" lims:id="898212"><Label>(2)</Label><Text>The Commodity Board of a province shall allot vaccine quotas to producers of that province in such a manner that, during the period set out in Schedule 2, the aggregate of the number of dozens of eggs referred to in paragraphs (a) and (b) will not exceed the applicable number of dozens of eggs set out in column 2 of that Schedule in respect of that province:</Text><Paragraph lims:inforce-start-date="2015-12-27" lims:fid="898213" lims:id="898213"><Label>(a)</Label><Text>the number of dozens of eggs produced in the province and authorized to be marketed by producers under vaccine quotas allotted on behalf of the Agency by the Commodity Board of the province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-27" lims:fid="898214" lims:id="898214"><Label>(b)</Label><Text>the number of dozens of eggs produced in the province and authorized to be marketed by producers in intraprovincial trade under quotas equivalent to those referred to in paragraph (a) allotted by the Commodity Board of the
