(<DefinedTermFr>aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="979081" lims:id="979081" generate-in-text="no"><Text><DefinedTermEn>airport reference point</DefinedTermEn> means the point described in Part I of the schedule; (<DefinedTermFr>point de référence de l’aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="979082" lims:id="979082" generate-in-text="no"><Text><DefinedTermEn>approach surfaces</DefinedTermEn> means the imaginary inclined planes that extend upward and outward from each end of a strip, which planes are more particularly described in Part II of the schedule; (<DefinedTermFr>surfaces d’approche</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="979083" lims:id="979083" generate-in-text="no"><Text><DefinedTermEn>outer surface</DefinedTermEn> means an imaginary plane located above and in the  immediate vicinity of the airport, which plane is more particularly described in Part III of the schedule; (<DefinedTermFr>surface extérieure</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="979084" lims:id="979084" generate-in-text="no"><Text><DefinedTermEn>strip</DefinedTermEn> means a rectangular portion of the landing area of the airport, including the runway, that is prepared for the take-off and landing of aircraft in a particular direction, which rectangular portion is more particularly described in Part IV of the schedule; (<DefinedTermFr>bande</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="979085" lims:id="979085" generate-in-text="no"><Text><DefinedTermEn>transitional surfaces</DefinedTermEn> means the imaginary inclined planes that extend upward and outward from the lateral limits of a strip and the approach surfaces, which planes are more particularly  described in Part V of the schedule. (<DefinedTermFr>surfaces de transition</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="979086" lims:id="979086"><Label>(2)</Label><Text>For the purposes of these Regulations, the elevation of the airport reference point is 340.9 m above sea level.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="979087" lims:id="979087" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="979088" lims:id="979088"><Label>3</Label><Text>These Regulations apply to all land, including public road allowances, that is adjacent to or in the vicinity of the airport, which land is more particularly described in Part VI of the schedule.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="979089" lims:id="979089" level="1"><TitleText>Building Restrictions</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="979090" lims:id="979090"><Label>4</Label><Text>No person shall erect or construct, on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979091" lims:id="979091"><Label>(a)</Label><Text>the approach surfaces;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979092" lims:id="979092"><Label>(b)</Label><Text>the outer surface; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979093" lims:id="979093"><Label>(c)</Label><Text>the transitional surfaces.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="979094" lims:id="979094" level="1"><TitleText>Aeronautical Facilities</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="979095" lims:id="979095"><Label>5</Label><Text>No owner or lessee of any land to which these Regulations apply shall permit any part of that land to be used or developed in a manner that causes interference with any signals or communications to and from</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979096" lims:id="979096"><Label>(a)</Label><Text>any aircraft; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979097" lims:id="979097"><Label>(b)</Label><Text>any facilities used to provide services relating to aeronautics.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="979098" lims:id="979098" level="1"><TitleText>Natural Growth</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="979099" lims:id="979099"><Label>6</Label><Text>Where an object of natural growth that is on any land to which these Regulations apply grows to a height that exceeds in elevation at the location of the object any of the surfaces referred to in section 4, the Minister of Transport may require that the owner or lessee of the land remove the excess growth.</Text></Section></Body><Schedule lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="979100" lims:id="979100" bilingual="no" spanlanguages="no"><ScheduleFormHeading lims:inforce-start-date="2006-03-22" lims:fid="979101" lims:id="979101"><Label>SCHEDULE</Label><OriginatingRef>(Sections 2 and 3)</OriginatingRef></ScheduleFormHeading><Heading lims:inforce-start-date="2006-03-22" lims:fid="979102" lims:id="979102" level="1"><Label>PART I</Label><TitleText>Description of the Airport Reference Point</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="979103" lims:id="979103" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The airport reference point, shown on Fort Frances Airport Zoning Plan No. 59-011 91-60, dated January 14, 1993, is a point which may be located by:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="979104" lims:id="979104" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>commencing at the threshold of runway 30, being the southeastern end of runway 12-30 at Fort Frances Airport, having Universal Transverse Mercator (UTM) coordinates of E 468 118.65 and N 5 388 517.56;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979105" lims:id="979105" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence northwesterly along the centre line of said runway 12-30 684.45 m to a point;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979106" lims:id="979106" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence southwesterly and perpendicular to the centre line of said runway 12-30 40 m to the airport reference point, which point has the UTM coordinates of E 467 542.09 and N 5 388 888.00.</Text></Provision></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="979107" lims:id="979107" level="1"><Label>PART II</Label><TitleText>Description of the Approach Surfaces</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="979108" lims:id="979108" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The approach surfaces, shown on Fort Frances Airport Zoning Plan No. 59-011 91-60, dated January 14, 1993, are planes abutting each end of the strips associated with runways 12-30 and 03-21 and are described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="979109" lims:id="979109" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>an inclined plane abutting the end of the strip associated with the approach to runway 12 having a ratio of 1 m measured vertically to 40 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 1 740 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 336 m from the projected centre line; said imaginary horizontal line being 43.5 m above the elevation at the end of the strip;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979110" lims:id="979110" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>an inclined plane abutting the end of the strip associated with the approach to runway 30 having a ratio of 1 m measured vertically to 40 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 1 800 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 345 m from the projected centre line; said imaginary horizontal line being 45 m above the elevation at the end of the strip;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979111" lims:id="979111" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>an inclined plane abutting the end of the strip associated with the approach to runway 03 having a ratio of 1 m measured vertically to 20 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 890 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 119 m from the projected centre line; said imaginary horizontal line being 44.5 m above the elevation at the end of the strip; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979112" lims:id="979112" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(d)</Label><Text>an inclined plane abutting the end of the strip associated with the approach to runway 21 having a ratio of 1 m measured vertically to 20 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 858 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 115.8 m from the projected centre line; said imaginary horizontal line being 42.9 m above the elevation at the end of the strip.</Text></Provision></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="979113" lims:id="979113" level="1"><Label>PART III</Label><TitleText>Description of the Outer Surface</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="979114" lims:id="979114" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The outer surface, shown on Fort Frances Airport Zoning Plan No. 59-011 91-60, dated January 14, 1993, is an imaginary plane established at a constant elevation of 45 m above the elevation of the airport reference point, except that, where that plane is less than 9 m above the surface of the ground, the outer surface is located at 9 m above the surface of the ground.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="979115" lims:id="979115" level="1"><Label>PART IV</Label><TitleText>Description of the Strips</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="979116" lims:id="979116" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The strips, shown on Fort Frances Airport Zoning Plan No. 59-011 91-60, dated January 14, 1993, are described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="979117" lims:id="979117" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>the strip associated with runway 12-30 is 150 m in width, 75 m being on each side of the centre line of the runway, and 1 488.9 m in length; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979118" lims:id="979118" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>the strip associated with runway 03-21 is 60 m in width, 30 m being on each side of the centre line of the runway, and 860.05 m in length.</Text></Provision></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="979119" lims:id="979119" level="1"><Label>PART V</Label><TitleText>Description of the Transitional Surfaces</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="979120" lims:id="979120" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The transitional surfaces, shown on Fort Frances Airport Zoning Plan No. 59-011 91-60, dated January 14, 1993, are described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="979121" lims:id="979121" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>the transitional surfaces associated with runway 12-30 are inclined planes rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and projected centre line of the strip, extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or with another transitional surface of an adjoining strip; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979122" lims:id="979122" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>the transitional surfaces associated with runway 03-21 are inclined planes rising at a ratio of 1 m measured vertically to 5 m measured horizontally at right angles to the centre line and projected centre line of the strip, extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or with another transitional surface of an adjoining strip.</Text></Provision></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="979123" lims:id="979123" level="1"><Label>PART VI</Label><TitleText>Description of the Land to Which These Regulations Apply</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="979124" lims:id="979124" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The outer boundary of the land to which these Regulations apply, shown on Fort Frances Airport Zoning Plan No. 59-011 91-60, dated January 14, 1993, is described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="979125" lims:id="979125" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>All and singular those certain parcels of tracts of land situate lying and being in the Townships of Miscampbell, McIrvine and Crozier and in the Couchiching Indian Reserve No. 16A, in the District of Rainy River, more particularly described as follows:</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979126" lims:id="979126" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>commencing at the southwestern corner of Lot 4, Concession 2, in the Township of Miscampbell in the District of Rainy River;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979127" lims:id="979127" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence northerly along the western boundary of the said Lot 4, Concession 2, to the northwestern corner thereof;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979128" lims:id="979128" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence easterly along the northern boundary of the said Lot 4, Concession 2, to the intersection thereof with the western boundary of Couchiching Indian Reserve No. 16A;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979129" lims:id="979129" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence southerly along the said boundary to the intersection thereof with a circle having a radius of 4 000 m centred on the airport reference point, the Universal Transverse Mercator (UTM) coordinates of which are E 467 542.09 and N 5 388 888.00;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979130" lims:id="979130" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence northeasterly, easterly, southeasterly and southerly along the arc of the said circle to the intersection thereof with the eastern boundary of Lot 10, Plan T1963;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979131" lims:id="979131" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence southerly along the eastern boundary of the said Lot 10, Plan T1963, to the intersection thereof with the southern boundary of Couchiching Indian Reserve No. 16A, being also the northern boundary of Subdivision Plan SM-19;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979132" lims:id="979132" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence westerly along the northern boundary of the said Plan SM-19 to the intersection thereof with the production northerly of the eastern boundary of Lot 490 on Plan SM-19;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979133" lims:id="979133" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence southerly along the said production northerly across the lane on Plan SM-19 to the northeastern corner of the said Lot 490;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979134" lims:id="979134" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence southerly along the eastern boundary of the said Lot 490 to the southeast corner thereof;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979135" lims:id="979135" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence in a straight line across Maple Street on the said Plan SM-19 to the northeastern corner of Lot 295 on the said Plan SM-19;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979136" lims:id="979136" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence southerly along the eastern boundary of the said Lot 295 to the southeastern corner thereof;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979137" lims:id="979137" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence in a straight line across the public lane between Lot 295 and Lot 98, Plan M-19, to the northeastern corner of the said Lot 98;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979138" lims:id="979138" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence southerly along the eastern boundary of the said Lot 98 list-item="no"><Text>thence southerly in a straight line across Balsam Street, Plan M-19, to the northeastern corner of the northwest quarter of Section 28;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979140" lims:id="979140" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence southerly along the eastern boundary of the said northwest quarter of Section 28 to the southeastern corner thereof;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="979141" lims:id="979141" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence westerly along the southern boundary of the said northwest quarter of Section 28 to the southwestern corner thereof;</Text></Provision><Provision format-ref="indent-0-0" language-align="yes" list-item="no"><Text>thence southerly along the eastern boundary of the said southeast quarter of Section 29 to the southeastern corner
