(<DefinedTermFr>Convention</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1032067" lims:id="1032067" generate-in-text="no"><Text><DefinedTermEn>Preparatory Commission</DefinedTermEn> means the Preparatory Commission for the Comprehensive Nuclear Test-Ban Treaty Organization. (<DefinedTermFr>Commission préparatoire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1032068" lims:id="1032068" generate-in-text="no"><Text><DefinedTermEn>Secretariat</DefinedTermEn> means the Provisional Technical Secretariat of the Preparatory Commission. (<DefinedTermFr>Secrétariat</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1032069" lims:id="1032069" level="1"><TitleText>Legal Capacity</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1032070" lims:id="1032070"><Label>2</Label><Text>The Preparatory Commission and the Secretariat each have, in Canada, the legal capacity of a body corporate.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1032071" lims:id="1032071" level="1"><TitleText>Privileges and Immunities of the Preparatory Commission and Secretariat</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="1032072" lims:id="1032072" level="2"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1032073" lims:id="1032073"><Label>3</Label><Text>Subject to sections 4 to 8, the Preparatory Commission and the Secretariat each have, in Canada, the privileges and immunities set out in Articles II and III of the Convention.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1032074" lims:id="1032074" level="2"><TitleText>Exceptions</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1032075" lims:id="1032075"><Label>4</Label><Text>Acts and regulations that prohibit the import or export of certain articles, as well as the <XRefExternal reference-type="act" link="Q-1.1">Quarantine Act</XRefExternal> and any regulations made under that Act, apply in relation to the property and assets of the Preparatory Commission or the Secretariat.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1032076" lims:id="1032076"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1032077" lims:id="1032077"><Label>(1)</Label><Text>The equipment that the Preparatory Commission or the Secretariat proposes to bring into Canada shall be inspected at the border to verify that it has been authorized to enter Canada in accordance with a list pre-established with the Preparatory Commission.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1032078" lims:id="1032078"><Label>(2)</Label><Text>A member of the Preparatory Commission or the Secretariat may be present at the inspection.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1032079" lims:id="1032079"><Label>(3)</Label><Text>A member of the Preparatory Commission or the Secretariat shall designate any item of equipment that requires special handling or storage for safety purposes and shall, before the arrival of the equipment, inform the appropriate Canadian authorities of the designation.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1032080" lims:id="1032080"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1032081" lims:id="1032081"><Label>(1)</Label><Text>Officials of the Government of Canada may enter any premises of the Preparatory Commission or the Secretariat only with the consent of the Executive Secretary of the Preparatory Commission or an official or expert responsible for the Inspection Team of the Secretariat.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1032082" lims:id="1032082"><Label>(2)</Label><Text>The consent referred to in subsection (1) is considered to have been given if there is a fire, or other emergency, requiring immediate intervention.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1032083" lims:id="1032083"><Label>7</Label><Text>Privileges and immunities do not apply in respect of any property that the Preparatory Commission or the Secretariat has abandoned for more than one year.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1032084" lims:id="1032084"><Label>8</Label><Text>Immunity from legal process does not apply in relation to a motor vehicle that is under the care and control of the Preparatory Commission or the Secretariat and that is involved in an accident that results in death, damages or personal injury to any person.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1032085" lims:id="1032085" level="1"><TitleText>Privileges and Immunities of Officials</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1032086" lims:id="1032086"><Label>9</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1032087" lims:id="1032087"><Label>(1)</Label><Text>Subject to subsections (2) and (3), officials of the Preparatory Commission or the Secretariat shall have, in Canada, the privileges and immunities set out in paragraphs (a) to (c), (e) and (g) of Section 18 of Article V of the Convention, as well as the following privileges and immunities set out in that Section:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1032088" lims:id="1032088"><Label>(a)</Label><Text>immunity from immigration restrictions and alien registration; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1032089" lims:id="1032089"><Label>(b)</Label><Text>the same repatriation facilities in time of international crisis as are accorded to diplomatic envoys.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1032090" lims:id="1032090"><Label>(2)</Label><Text>Subject to subsection (3), officials of the Preparatory Commission or the Secretariat who are Canadian citizens or permanent residents shall have, in Canada, the privileges and immunities set out in paragraphs (a), (c) and (e) of Section 18 of Article V of the Convention.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1032091" lims:id="1032091"><Label>(3)</Label><Text>Immunity from legal process does not apply in relation to a motor vehicle that is under the care or control of an official of the Preparatory Commission or the Secretariat and that is involved in an accident that results in death, damages or personal injury to any person.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1032092" lims:id="1032092" level="1"><TitleText>Privileges and Immunities of Experts on Missions</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1032093" lims:id="1032093"><Label>10</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1032094" lims:id="1032094"><Label>(1)</Label><Text>Subject to subsections (2) to (4), experts performing missions for the Preparatory Commission or the Secretariat shall have, during their journey to and from the place of their missions in Canada, as well as during the period of their missions in Canada, the privileges and immunities set out in Article VI of the Convention.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1032095" lims:id="1032095"><Label>(2)</Label><Text>Subject to subsection (3), experts referred to in subsection (1) who are Canadian citizens or permanent residents shall have, in Canada, the privileges and immunities set out in paragraphs (b) and (c) of Section 22 of Article VI of the Convention.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1032096" lims:id="1032096"><Label>(3)</Label><Text>Immunity from legal process does not apply in relation to a motor vehicle that is under the care or control of an expert performing a mission for the Preparatory Commission or the Secretariat and that is involved in an accident that results in death, damages or personal injury to any person.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1032097" lims:id="1032097"><Label>(4)</Label><Text>Acts and regulations that prohibit the import or export of certain articles, and the <XRefExternal reference-type="act" link="Q-1.1">Quarantine Act</XRefExternal> and any regulations made under that Act, apply in relation to the personal baggage of experts performing missions for the Preparatory Commission or the Secretariat.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1032098" lims:id="1032098" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1032099" lims:id="1032099"><Label>11</Label><Text>This Order comes into force on the day on which it is registered.</Text></Section></Body></Regulation>
