40 For the purpose of section 38 of the Act, a permanent and severe impairment is

• (a) an amputation at or above the elbow or the knee;

• (b) the amputation of more than one upper or lower limb at any level;

• (c) a total and permanent loss of the use of a limb;

• (d) a total and permanent loss of vision, hearing or speech;

• (e) a severe and permanent psychiatric condition;

• (f) a permanent requirement for the physical assistance of another person for most activities of daily living; or

• (g) a permanent requirement for supervision.
