Cannabis Exemption (Food and Drugs Act) Regulations

His Excellency the Governor General in Council, on the recommendation of the Minister of Health, pursuant to paragraph 30(1)(j) of the Food and Drugs ActFootnote a, makes the annexed Cannabis Exemption (Food and Drugs Act) Regulations.

Definitions

 The following definitions apply in these Regulations.

cannabis

cannabis means the substance set out in item 1 of Schedule II to the Controlled Drugs and Substances Act, other than cannabis that is sold to be used for the purpose of a clinical trial, as that term is defined in section C.05.001 of the Food and Drug Regulations. (cannabis ou chanvre indien)

designated person

designated person has the same meaning as in subsection 1(1) of the Access to Cannabis for Medical Purposes Regulations. (personne designée)

licensed producer

licensed producer has the same meaning as in subsection 1(1) of the Access to Cannabis for Medical Purposes Regulations. (producteur autorisé)

marihuana

marihuana means the substance referred to as “Cannabis (marihuana)” in subitem 1(2) of Schedule II to the Controlled Drugs and Substances Act, other than marihuana that is sold or imported to be used for the purpose of a clinical trial, as that term is defined in section C.05.001 of the Food and Drug Regulations. (marihuana)

Exemptions

Marginal note:Exemption — cannabis

 Cannabis is exempt from the application of the Food and Drug Regulations if it is produced by a licensed producer or designated person in accordance with the Access to Cannabis for Medical Purposes Regulations.

Marginal note:Exemption — marihuana

 Marihuana is exempt from the application of the Food and Drug Regulations if it is imported or exported by a licensed producer in accordance with an import or export permit issued under the Access to Cannabis for Medical Purposes Regulations.
