38 Where a ground of appeal referred to in subsection 28(2) of the Act is set out in a notice of appeal forwarded pursuant to subsection 28(1) of the Act, the Commissioner of Review Tribunals as defined in section 2 of the Canada Pension Plan Regulations shall

• (a) notify the appellant and the Minister that the appellant’s appeal on that ground has been referred to the Court pursuant to subsection 28(2) of the Act; and

• (b) transmit to the Registrar of the Court a copy of the relevant documents pursuant to section 5 of the Review Tribunal Rules of Procedure as relate to the reference.
