Order Respecting the Withdrawal from Disposal of Certain Lands in Nunavut (The Nunavik Marine Region, Nunavut)

Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraph 23(a) of the Territorial Lands Act, hereby makes the annexed Order Respecting the Withdrawal from Disposal of Certain Lands in Nunavut (The Nunavik Marine Region, Nunavut).

Purpose

 The purpose of this Order is to withdraw certain lands in Nunavut from disposal in order to facilitate the settlement of the Nunavik Inuit claim to the Nunavik Marine Region, Nunavut.

Lands Withdrawn from Disposal

 Subject to sections 3 and 4, the tracts of territorial lands set out in the schedule, including the surface and sub-surface rights to the islands that are within the Nunavik Marine Region, are withdrawn from disposal for the period beginning on the day on which this Order is made and ending on July 31, 2006.

Exceptions

 Section 2 does not apply to the disposition of substances or materials under the Territorial Quarrying Regulations.

Existing Rights and Interests

 For greater certainty, section 2 does not apply to

  • (a) the locating of a claim by the holder of a prospecting permit who was granted that permit before the day on which this Order is made;

  • (b) the recording of a claim referred to in paragraph (a) or that was located before the day on which this Order is made;

  • (c) the granting of a lease under the Canada Mining Regulations to a person with a recorded claim where the lease covers an area within the recorded claim;

  • (d) the issuance of a significant discovery licence under the Canada Petroleum Resources Act to a holder of an exploration licence that was issued before the day on which this Order is made where the significant discovery licence covers an area subject to the exploration licence;

  • (e) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of a significant discovery licence referred to in paragraph (d) where the production licence covers an area subject to the significant discovery licence;

  • (f) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of an exploration licence or a significant discovery licence that was issued before the day on which this Order is made where the production licence covers an area subject to the exploration licence or the significant discovery licence;

  • (g) the granting of a surface lease under the Territorial Lands Act to a holder of a recorded claim under the Canada Mining Regulations or of an interest under the Canada Petroleum Resources Act where the surface lease is required to allow the holder to exercise rights under the claim or interest; or

  • (h) the renewal of an interest.

Geographic Coordinates of the Nunavik Marine Region

The Nunavik Marine Region includes all the marine area, islands, lands and waters within the following boundary:
1Commencing at the intersection of the shore and the Quebec/Newfoundland and Labrador/Nunavut border on the southern shore of McLelan Strait on the Labrador Peninsula at approximately 60°17′54″N latitude and 64°31′24″W longitude;
2thence northeasterly to the intersection of the shore and the Newfoundland and Labrador/Nunavut boundary on the northern shore of McLelan Strait on Killiniq Island at approximately 60°18′27″N latitude and 64°30′39″W longitude;
3thence north across Killiniq Island following the Newfoundland and Labrador/Nunavut boundary to the intersection of the shore and the Newfoundland/Nunavut boundary on the northern shore of Killiniq Island at approximately 60°22′38″N latitude and 64°25′51″W longitude;
4thence northeasterly to a point at the intersection of 60°23′N latitude and 64°24′W longitude;
5thence north in a straight line to a point at the intersection of 61°00′N latitude and 64°24′W longitude;
6thence westerly in a straight line to a point at the intersection of 61°00′N latitude and  64°55′W longitude;
7thence northwesterly in a straight line to a point at the intersection of 61°38′N latitude and 69°00′W longitude, being the point approximately equidistant between Cape Hopes Advance in Quebec and the Gray Goose Islands off the south coast of Baffin Island;
8thence northwesterly in a straight line to the intersection of 63°15′N latitude and  74°00′W longitude, being the point approximately equidistant between the coasts of Quebec and Baffin Island;
9thence westerly in a straight line to the intersection of 63°25′N latitude and 76°10′W longitude, being the point approximately equidistant between the northern Quebec and Baffin Island coasts, east of Salisbury Island;
10thence northwesterly in a straight line to a point at the intersection of 63°52′N latitude and 77°15′W longitude, being the point north of Salisbury Island;
11thence southwesterly in a straight line to a point at the intersection of 63°30′N latitude and 78°47′W longitude, being the point west of Nottingham Island;
12thence southeasterly in a straight line to a point at the intersection of 63°03′N latitude and 78°25′W longitude, being the point southwest of Nottingham Island;
13thence southeasterly in a straight line to a point at the intersection of 63°00′N latitude and 77°40′W longitude, being the point southeast of Nottingham Island;
14thence southwest in a straight line to a point at the intersection of 62°30′N latitude and 80°00′W longitude, being the point northwest of Mansel Island;
15thence southwest in a straight line to a point at the intersection of 62°00′N latitude and 80°45′W longitude, being the point west of Mansel Island;
16thence southerly in a straight line to a point at the intersection of 58°10′N latitude and 81°00′W longitude, northwest of Sleeper Islands and south of Farmer Island;
17thence southeasterly in a straight line to a point at the intersection of 58°00′N latitude and 79°45′W longitude, near the Marcopeet Islands, north of the Sleeper Islands;
18thence southwesterly in a straight line to a point at the intersection of 57°15′N latitude and 80°00′W longitude, south of the Sleeper Islands;
19thence southeasterly in a straight line to a point at the intersection of 57°00′N latitude and 78°40′W longitude, southwest of the King George Islands;
20thence southeasterly in a straight line to a point at the intersection of 56°45′N latitude and 78°15′W longitude, east of the Bakers Dozen Islands;
21thence southerly in a straight line to a point at the intersection of 56°07′N latitude and 78°10′W longitude, southeast of the Salikuit Islands;
22thence northeast in a straight line to a point at the intersection of 56°22′N latitude and 77°25′W longitude, east of the Salikuit Islands and west of the Nastapoka Islands;
23thence southerly in a straight line to a point at the intersection of 56°00′N latitude and 77°30′W longitude, east of Innetalling Island and northwest of Duck Island;
24thence southwesterly in a straight line to a point at the intersection of 55°45′N latitude and 78°00′W longitude, northwest of Kuujjuarapik, Quebec;
25thence southwesterly in a straight line to a point at the intersection of 55°15′N latitude and 79°00′W longitude, southwest of Kuujjuarapik, Quebec and northeast of Long Island;
26thence southwesterly in a straight line to a point at the intersection of 55°00′N latitude and 79°45′W longitude, north of Long Island;
27thence due west along 55°00′N latitude to the intersection of 81°00′W longitude, east of Cape Henrietta Maria, Ontario;
28thence in a southwesterly direction to a point at the intersection of 54°30′N latitude and 81°20′W longitude;
29thence southeasterly in a straight line to a point at the intersection of 54°00′N latitude and 80°50′W longitude;
30thence southeasterly in a straight line to a point at the intersection of 53°45′N latitude and the shore of Quebec, as defined in the Quebec Boundaries Extension Act, 1912, at approximately 79°05′W longitude, south of Chisasibi;
31thence in a general northerly and easterly direction along the shore of Quebec to the point of commencement.
