Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraph 23(a) of the Territorial Lands ActFootnote a, hereby makes the annexed Withdrawal from Disposal of Certain Tracts of Territorial Lands in the Northwest Territories (Edéhzhíe (Horn Plateau)) Order.

Purpose
1 The purpose of this Order is to withdraw from disposal certain tracts of territorial lands to facilitate the establishment of Edéhzhíe (Horn Plateau) as an area for protection under the Northwest Territories Protected Areas Strategy.
Lands Withdrawn from Disposal
2 The tracts of territorial lands set out in the schedule, including the surface and subsurface rights to the lands, are withdrawn from disposal for the period beginning on the day on which this Order is made and ending on October 31, 2010.
Exceptions
Disposal of Substances or Materials
3 Section 2 does not apply to the disposal of substances or materials under the Territorial Quarrying Regulations.
Existing Rights and Interests
4 Section 2 does not apply to
(a) the locating of a mineral claim by the holder of a prospecting permit granted before the day on which this Order is made;
(b) the recording of a mineral claim that is referred to in paragraph (a) or that was located before the day on which this Order is made;
(c) the granting of a lease under the Northwest Territories and Nunavut Mining Regulations to a person with a recorded claim if the lease covers an area in the recorded claim;
(d) the issuance of a significant discovery licence under the Canada Petroleum Resources Act to a holder of an exploration licence that was issued before the day on which this Order is made if the significant discovery licence covers an area subject to the exploration licence;
(e) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of a significant discovery licence that is referred to in paragraph (d) if the production licence covers an area that is subject to the significant discovery licence;
(f) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of an exploration licence or a significant discovery licence that was issued before the day on which this Order is made if the production licence covers an area that is subject to the exploration licence or the significant discovery licence;
(g) the granting of a surface lease under the Territorial Lands Act to a holder of a recorded claim under the Northwest Territories and Nunavut Mining Regulations or of an interest under the Canada Petroleum Resources Act if the surface lease is required to allow the holder to exercise rights under the claim or interest; or
(h) the renewal of an interest.

All that portion of the Northwest Territories in the vicinity of the Horn Plateau described as follows:
(1) Commencing at the point of intersection of longitude 118°35′32″ W and the ordinary high water mark of the right bank of the Mackenzie River at approximate latitude 61°18′40″ N;
(2) thence in a northeasterly direction following the sinuosities of the ordinary high water mark of the said river to a point of intersection having latitude 61°26′32″ N at an approximate longitude of 118°24′49″ W;
(3) thence northeasterly in a straight line to a point having latitude 61°27′36″ N and longitude 118°12′00″ W;
(4) thence easterly in a straight line to a point having latitude 61°27′30″ N and longitude 118°04′00″ W;
(5) thence southeasterly in a straight line to a point having latitude 61°26′00″ N and longitude 117°56′23″ W;
(6) thence northeasterly in a straight line to a point having latitude 62°06′00″ N and longitude 117°15′00″ W;
(7) thence northwesterly in a straight line to a point having latitude 62°17′34″ N and longitude 117°31′38″ W;
(8) thence northwesterly in a straight line to a point having latitude 62°32′46″ N and longitude 118°28′28″ W;
(9) thence northwesterly in a straight line to a point having latitude 62°45′48″ N and longitude 119°32′53″ W;
(10) thence northwesterly in a straight line to a point having latitude 62°51′34″ N and longitude 120°04′50″ W;

(17) thence northwesterly in a straight line to the intersection of the ordinary high water mark of the right bank of the Mackenzie River at latitude 62°43′57″ N at an approximate longitude 123°07′37″ W;
(18) thence southerly following the sinuosities of the ordinary high water mark of said river to a point at latitude 62°37′56″ N and having an approximate longitude 123°08′17″ W;
(19) thence southeasterly in a straight line to a point having latitude 62°36′37″ N and longitude 123°00′50″ W;
(20) thence easterly in a straight line to a point having latitude 62°34′58″ N and longitude 122°09′52″ W;
(21) thence southeasterly in a straight line to a point having latitude 62°12′08″ N and longitude 121°18′23″ W;
(22) thence southeasterly in a straight line to the intersection of the ordinary high water mark of the right bank of the Mackenzie River at longitude 120°44′14″ W at an approximate latitude 61°48′18″ N;
(23) thence southeasterly following the sinuosities of the ordinary high water mark of said river to a point at latitude 61°42′00″ N at an approximate longitude 120°40′28″ W;
(24) thence southeasterly in a straight line to a point having latitude 61°36′00″ N and longitude 119°48′00″ W;
(25) thence easterly in a straight line to a point having latitude 61°36′00″ N and longitude 118°54′00″ W;
(26) thence southeasterly in a straight line to a point having latitude 61°29′45″ N and longitude 118°32′23″ W;
(27) thence southerly in a straight line to the point of commencement.
All coordinates are referenced to the 1983 North American Datum, Canadian Spatial Reference System (NAD83, CSRS) and any references to straight lines means points joined directly on a NAD83 Universal Transverse Mercator (UTM) projected plane surface.
Said parcel containing 2,520,000 hectares, more or less.
Subject to a four-kilometer-wide corridor which will be required for a future pipeline and the associated infrastructure, in the Willowlake River area, and which is centered on the existing pipeline ROW shown on CLSR 69975 and filed in the Land Titles Office at Yellowknife as 1972- 28 and 1972-29.
