Version of section 40 from 2006-03-23 to 2009-07-29:
40 For the purpose of section 38 of the Act, a permanent and severe impairment is
(a) an amputation at or above the elbow or the knee;
(b) the amputation of more than one upper or lower limb at any level;
(c) a total and permanent loss of the use of a limb;
(d) a total and permanent loss of vision, hearing or speech;
(e) a severe and permanent psychiatric condition;
(f) a permanent requirement for the physical assistance of another person for most activities of daily living; or
(g) a permanent requirement for supervision.
