Regulations Respecting Population Recovery Adjustment Payments

His Excellency the Governor General in Council, on the recommendation of the Minister of Finance, pursuant to subsection 11(2) of An Act to Amend the Federal-Provincial Fiscal Arrangements and Established Programs Financing Act, 1977 and to provide for payments to certain provinces, is pleased hereby to make the annexed regulations respecting the Population Recovery Adjustment Payment Regulations.

Short Title

 These Regulations may be cited as the Population Recovery Adjustment Payments Regulations.

Interpretation

 In these Regulations,

Act

Act means An Act to Amend the Federal-Provincial Fiscal Arrangements and Established Programs Financing Act, 1977 and to provide for payments to certain provinces, being chapter 94 of the Statutes of Canada, 1980-81-82; (Loi)

Minister

Minister means the Minister of Finance. (ministre)

Population Recovery Adjustment Payments

 Sections 8 and 9 of the Federal-Provincial Fiscal Arrangements and Established Programs Financing Regulations, 1977 apply with such modifications as the circumstances require in respect of the amount payable pursuant to subsection 11(2) of the Act as if that amount were a fiscal equalization payment.

 The Minister may make payments to a province out of the Consolidated Revenue Fund on account of any amounts estimated by the Minister to be payable to a province under subsection 11(2) of the Act.

 The Minister shall

  • (a) make a final computation of the amount, if any, that is payable to a province under subsection 11(2) of the Act in respect of each fiscal year in the period commencing on April 1, 1980 and ending on March 31, 1982 not later than 24 months immediately following the end of the fiscal year in respect of which a payment may be made; and

  • (b) where there remains an outstanding amount payable to a province after the final computation referred to in paragraph (a) in respect of the fiscal year in respect of which a payment may be made, the Minister shall pay forthwith to the province the outstanding amount.
