Regulations Respecting the Parking of Vehicles at Airports

The Minister of Transport, pursuant to section 3.4(2)Footnote * of the Aeronautics Act and the Ministerial Regulations Authorization OrderFootnote **, made by Order in Council P.C. 1986-1348 of June 5, 1986, hereby revokes the Airport Vehicle Parking Fees Regulations, C.R.C., c. 7, and makes the annexed Regulations respecting the parking of vehicles at airports, in substitution therefor.

Short Title

 These Regulations may be cited as the Airport Vehicle Parking Charges Regulations.

Application

  •  (1) These Regulations apply in respect of parking services provided in an area available to the public at an airport that is operated by the Minister and set out in the schedule.

  • (2) These Regulations do not apply

    • (a) to a member of the Senate or House of Commons for the parking of the member’s vehicle at the Ottawa International Airport in areas identified by the Minister of Transport for such parking;

    • (b) to a judge of the Supreme Court of Canada for the parking of the judge’s vehicle at the Ottawa International Airport in areas identified by the Minister of Transport for such parking;

    • (c) to a member of the Senate for the parking of the member’s vehicle at the airport serving the city, town or municipality wherein the member resides in areas identified by the Minister of Transport for such parking;

    • (d) to a member of the House of Commons for the parking of the member’s vehicle at the airport serving his electoral district in areas identified by the Minister of Transport for such parking;

    • (e) to a judge of the Federal Court of Canada for the parking of the judge’s vehicle at the Ottawa International Airport in areas identified by the Minister of Transport for such parking; or

    • (f) to any person who benefits from the privileges and immunities accorded to diplomatic agents and to consular officers in accordance with the Foreign Missions and International Organizations Act in respect of the parking of the person’s vehicle at Halifax, Ottawa/MacDonald-Cartier International, Lester B. Pearson International or Winnipeg International Airport in areas identified for such parking.

  •  (1) A charge, included in the amount set out in Column III of an item of the schedule, is imposed for the use of the parking service that is set out in Column I of that item of the schedule and provided by the Minister of Transport at the airport set out in Column II of that item of the schedule.

  • (2) The charge referred to in subsection (1) is determined by subtracting from the amount set out in Column III of an item of the schedule the amounts which correspond to the Goods and Services Tax and to any applicable provincial tax.

  • (3) The user of a parking service set out in Column I of an item of the schedule shall pay the amount set out in Column III of an item of the schedule.

 The amount referred to in subsection 3(3) shall be paid

  • (a) where a metered parking space is used, at the commencement of the use of the parking service; and

  • (b) where other than a metered parking space is used, at the commencement or termination of use of the parking service as indicated by a public notice posted at the entrance to the parking lot or structure.
