Regulations Respecting Protection for the Income of Milk Producers for the Period Beginning on August 1, 1995 and Ending on March 31, 1996

Whereas industrial milk and industrial cream are agricultural products to which an agreement under the Farm Income Protection ActFootnote * does not apply;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture and Agri-Food and the Treasury Board, pursuant to paragraph 18(1)(b) of the Farm Income Protection ActFootnote *, deeming it necessary for carrying out the purposes and provisions of that Act, is pleased hereby to make the annexed Regulations respecting protection for the income of milk producers for the period beginning on August 1, 1995 and ending on March 31, 1996.
Short Title
1 These Regulations may be cited as the Protection for the Income of Milk Producers Regulations (1995-2).
Interpretation
2 In these Regulations,
- Canadian Dairy Commission
Canadian Dairy Commission means the corporation established by section 3 of the Canadian Dairy Commission Act; (Commission canadienne du lait)
- milk producer
milk producer means a person who resides in Canada and produces industrial milk or industrial cream in Canada. (producteur de lait)
Application
3 These Regulations apply to industrial milk and industrial cream that
(a) are delivered during the period beginning on August 1, 1995 and ending on March 31, 1996 for sale for use in dairy products; or
(b) was delivered before the period referred to in paragraph (a) for sale for use in dairy products and in respect of which no payment was made by the Canadian Dairy Commission under paragraph 9(1)(c) of the Canadian Dairy Commission Act.
Payment to the Canadian Dairy Commission
4 (1) Subject to subsection (2), the Minister may pay to the Canadian Dairy Commission an amount not exceeding $136,500,000 for the purpose of protecting the income of milk producers earned from the sale of industrial milk and industrial cream by supplementing that income in the amount of $4.62/hL of industrial milk and industrial cream.
(2) The total amount paid to the Canadian Dairy Commission under subsection (1) and section 4 of the Protection for the Income of Milk Producers Regulations (1995-1) shall not exceed $207,500,000.
