Order Granting Authority to Regulate the Marketing in Interprovincial and Export Trade of Potatoes Produced in New Brunswick

His Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture, pursuant to section 2 of the Agricultural Products Marketing Act, is pleased hereby to make the annexed Order granting authority to regulate the marketing in interprovincial and export trade of potatoes produced in New Brunswick.

Short Title

 This Order may be cited as the New Brunswick Potato Order.

Interpretation

 In this Order,

Act

Act means the Farm Products Marketing Act of New Brunswick; (Loi)

Commodity Board

Commodity Board means the New Brunswick Potato Agency established pursuant to the Farm Products Marketing Act of New Brunswick; (Office)

Plan

Plan means any plan for the marketing of potatoes, established and amended from time to time pursuant to the Acts and any regulations made pursuant to the Acts to give effect to the plan; (plan)

potatoes

potatoes means potatoes produced in New Brunswick; (pommes de terre)

producer

producer means a person engaged in the production of potatoes in New Brunswick. (producteur)

Interprovincial and Export Trade

 The Commodity Board is authorized to regulate the marketing of potatoes in interprovincial and export trade and for those purposes may, with respect to persons and property situated within the Province of New Brunswick, exercise all or any powers like the powers exercisable by it in relation to the marketing of potatoes locally within that Province under the Act and the Plan.

Levies

 The Commodity Board is authorized, in relation to the powers granted to it by section 3 with respect to the marketing of potatoes in interprovincial and export trade, to make orders fixing, imposing and collecting levies or charges from persons situated in the Province of New Brunswick who are engaged in the production or marketing of potatoes, and for such purposes classifying such persons into groups and fixing the levies or charges payable by the members of the different groups in different amounts, and the Commodity Board may use such levies or charges for its purposes, including the creation of reserves, the payment of expenses and losses resulting from the sale or disposal of potatoes and the equalization or adjustment among producers of potatoes, of moneys realized from the sale thereof during such period or periods of time as it may determine.
