Regulations Respecting Zoning at St. Catharines Airport

Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 6Footnote * of the Aeronautics Act, is pleased hereby to approve the annexed Regulations respecting zoning at St. Catharines Airport, made by the Minister of Transport.

Short Title
1 These Regulations may be cited as the St. Catharines Airport Zoning Regulations.
Interpretation
2 (1) In these Regulations,
- airport
airport means St. Catharines Airport at St. Catharines, in the regional Municipality of Niagara and in the City of St. Catharines, in the Province of Ontario; (aéroport)
- airport reference point
airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)
- approach surface
approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part II of the schedule; (surface d’approche)
- Minister
Minister means the Minister of Transport; (ministre)
- outer surface
outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (surface extérieure)
- strip
strip means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (bande)
- transitional surface
transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (surface de transition)
(2) For the purposes of these Regulations, the assigned elevation of the airport reference point is 95 m above sea level.
Application
3 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described in Part VI of the schedule.
General
4 No person shall erect or construct, on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point
(a) the approach surface of any strip;
(b) the outer surface; or
(c) any transitional surface.
Natural Growth
5 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a), (b) and (c), the Minister may make a direction that the owner or occupier of the land on which that object is growing remove the excessive growth.
Disposal of Waste
6 No owner or occupier of any land to which these Regulations apply shall permit that land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds.
SCHEDULE(s. 2 and 3)
PART IDescription of Airport Reference Point
The airport reference point, shown on St. Catharines Airport Zoning Plan No. 26-047-81-67, Sheet 5, dated March 30, 1984, is a point distant 100 m measured northwesterly at right angles to the centre line of runway 06-24, from a point distant 615 m measured northeasterly along the said centre line from the southwesterly end of the said runway.
PART IIDescription of the Approach Surfaces
The approach surfaces, shown on St. Catharines Airport Zoning Plan No. 26-047-81-67, Sheets 1, 2, 4, 5, 6, 8, 9, 10, 11 and 12 dated March 30, 1984, are surfaces abutting each end of the strips associated with the runways designated 06-24, 10-28 and 01-19 and are described as follows:
(a) a surface abutting the end of the strip associated with runway approach 06 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m above the elevation at the end of the strip;
(b) a surface abutting the end of the strip associated with runway approach 24 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally diverging at a rate of 15% from each side of the strip end and rising to its intersection with the Canada-United States International Boundary;
(c) a surface abutting the end of the strip associated with runway approach 10 consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 280 m from the projected centre line; said imaginary horizontal line being 62.5 m above the elevation at the end of the strip;
(d) a surface abutting the end of the strip associated with runway approach 28 consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 400 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 280 m from the projected centre line; said imaginary horizontal line being 62.5 m above the elevation at the end of the strip;
(e) a surface abutting the end of the strip associated with runway approach 01 consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 280 m from the projected centre line; said imaginary horizontal line being 62.5 m above the elevation at the end of the strip; and
(f) a surface abutting the end of the strip associated with runway approach 19 consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 280 m from the projected centre line; said imaginary horizontal line being 62.5 m above the elevation at the end of the strip.
PART IIIDescription of the Outer Surface
The outer surface, shown on St. Catharines Airport Zoning Plan No. 26-047-81-67, Sheets 1 to 9, dated March 30, 1984, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the assigned elevation of the airport reference point except where that common plane is less than 9 m above the surface of the ground, the imaginary surface is located at 9 m above the surface of the ground.
PART IVDescription of the Strips
The strips, shown on St. Catharines Airport Zoning Plan No. 26-047-81-67, Sheet 5, dated March 30, 1984, are described as follows:
(a) the strip associated with runway 06-24 being 300 m in width, 150 m being on each side of the centre line of the runway, and 1644.08 m in length;
(b) the strip associated with runway 10-28 being 60 m in width, 30 m being on each side of the centre line of the runway, and 667.10 m in length;
(c) the strip associated with runway 01-19 being 60 m in width, 30 m being on each side of the centre line of the runway, and 822.22 m in length.
PART VDescription of Each Transitional Surface
Each transitional surface, shown on St. Catharines Airport Zoning Plan No. 26-047-81-67, Sheets 1, 2, 4, 5, 6, 8 and 9, dated March 30, 1984, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and centre line produced of each strip extending upward and outward from the lateral limits of each strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip.
PART VIDescription of the Lands to Which These Regulations Apply
The boundary of the outer limits of lands, shown on St. Catharines Airport Zoning Plan No. 26-047-81-67, Sheets 1 to 12, dated March 30, 1984 is described as follows:
Commencing at the southwesterly corner of Lot 181 in the geographic Township of Niagara, now in the Municipality of the Town of Niagara-on-the-Lake;
THENCE northerly along the western boundary of the said Lot 181 to its intersection with the production northeasterly of the southern boundary of Lot 1 Concession 9 of the geographic Township of Grantham, now in the Municipality of Niagara-on-the-Lake;
THENCE southwesterly along the said production across the road allowance between the geographic Township of Niagara and the geographic Township of Grantham to the southeasterly corner of the said Lot 1 Concession 9 in the geographic Township of Grantham;
THENCE southwesterly along the southern boundary of Lots 1 and 2 Concession 9 of the geographic Township of Grantham to the southwesterly corner of the said Lot 2 Concession 9;
THENCE southwesterly in a straight line across the road allowance between Lots 2 and 3 Concession 9 in the said Township to the southeasterly corner of Lot 3 Concession 9 in the said Township;
THENCE southwesterly along the southern boundary of Lots 3 and 4 Concession 9 in the said Township to the southwesterly corner of Lot 4 Concession 9;
THENCE northerly along the western boundary of Lot 4 Concession 9 to the northwesterly corner of Lot 4 Concession 9;
THENCE northerly in a straight line across the road allowance between Concessions 8 and 9 in the geographic Township of Grantham to the southwesterly corner of Lot 4 Concession 8;
THENCE southwesterly in a straight line across the road allowance between Lots 4 and 5 to the southeasterly corner of Lot 5 Concession 8 in the said Township;
THENCE southwesterly along the southern boundary of Lots 5 and 6 Concession 8 to the southwesterly corner of Lot 6 Concession 8;
THENCE in a straight line across the road allowance between Lots 6 and 7 to the southeasterly corner of Lot 7 Concession 8;
THENCE southwesterly along the southern boundary of Lot 7 Concession 8 to its intersection with the boundary between the Municipality of the Town of Niagara-on-the-Lake and the City of St. Catharines;
THENCE northerly along the said boundary between municipalities to its intersection with the southern boundary of Lot 8 Concession 7;
THENCE southwesterly along the southern boundary of Lot 8 to the southwesterly corner of Lot 8 Concession 7;
THENCE in a straight line across the road allowance between Lots 8 and 9 to the southeasterly corner of Lot 9 Concession 7;
THENCE southwesterly along the southern boundary of Lot 9 to the southwesterly corner of the said Lot 9;
THENCE northerly along the western boundary of Lot 9 Concession 7 to its intersection with the southeastern limit of approach surface (06);
THENCE along the southeastern limit of approach surface 06 on an azimuth of 224°10′36″ to a point being the most southerly corner of said approach surface, the co-ordinates of which are N 4 772 039.864 E 637 469.295;
THENCE along the southwestern limit of approach surface 06 on an azimuth of 322°42′27″ a distance of 4 800 m to a point being the northwesterly corner of said approach surface, the co-ordinates of which are N 4 775 857.983 E 634 561.457;
THENCE along the northern limit of approach surface 06 on an azimuth of 61°14′18″ to its intersection with the eastern limit of Grantham Avenue as established by Plan 359, registered in the Registry Office for the Registry Division of Niagara North;
THENCE northerly along the eastern boundary of Grantham Avenue as established by Registered Plan 359, to the northwesterly corner of Lot 1 Registered Plan 359;
THENCE northerly in a straight line across Welland Avenue to the southwesterly corner of Lot 187 Corporation Plan No. 5;
THENCE northerly along the eastern boundary of Grantham Avenue as established by Corporation Plan No. 5, plans 103, 142, 378, 202, all registered in the Registry Office for the Registry Division of Niagara North, to the southern boundary of Carlton Street;
THENCE northerly in a straight line across Carlton Street to the intersection of the northern boundary of Carlton Street with the eastern boundary of Grantham Avenue;
