  1. Medical Devices Regulations - SOR/98-282 (Section 1)

     The definitions in this section apply in these Regulations.

    manufacturer

    manufacturer  means a person who sells a medical device under their own name, or under a trademark, design, trade name or other name or mark owned or controlled by the person, and who is responsible for designing, manufacturing, assembling, processing, labelling, packaging, refurbishing or modifying the device, or for assigning to it a purpose, whether those tasks are performed by that person or on their behalf. (fabricant)

      (2) This Division does not apply to a medical device that is identical in every respect to a medical device for which a licence has been issued except that the device is labelled with the name and address of another manufacturer and the name and identifier of the device that that other manufacturer is proposing to sell under its own name or under a trade-mark, design, trade name or other name or mark owned or controlled by it.
